THE UTTAR PRADESH SUGARCANE LAWS (AMENDMENT) ACT, 1961

An Act
to amend the Uttar Pradesh Sugarcane (Regulation of Supply and Purchase) Act, 1953 (U.P.
Act No, XXIV of 1953) and the Untar Pradesh Sugarcane (Purchase Tax) Act, 1961 (U.P. Act
No. IX of 1963) for certain purposes
Whereas the U.P. Sugareane Laws (Amendment) Ordinance, 1961 (LL.P. Ordinance
No. IIL of 1961), was promulgated by the Governor under Article 213 of the Constitution of
India;
‘And whereas itis necessary and expedient that the said Ordinance be replaced by an
Act of the Legislature
Inishereby enacted in the Twelfth Year of the Republic of India as follows:
1. Short ttle and estent
(1) This Act may be called the Uttar Pradesh Sugarcane (Regulation of Supply and
Purchase and Purchase Tax) (Amendment) Act, 1961
@) Itextends to the whole of Uttar Pradesh
2. Amendment of Section 18 of U.P. Act No. XXIV of 1953.
{In sub-section (1) of Section 18 of the Uttar Pradesh Sugarcane (Regulation of Supply
and Purchase) Act, 1953, for the words and comma “for every one maund of cane purchased
by the factory or the gur, rab or khandsari sugar manufacturing unit”; the words and commas
for every one quintal of cane purchased by the factory or the gur, rab or Khandsari sugar
manufacturing unit, as the case may be" shall be substituted,
3. Amendment of Section 3 of U. P. Act No. IN of 1961.
In sub-section (1) of Section 3 of the Uttar Pradesh Sugarcane (Purchase Tax) Act,
1961-
(1) tm clause (a), for the words “twenty-five naya paise per maund” the words “sixty-
seven naya paise per quintal” shall be substituted; and
(©) In clause (b), for the words “six naya paisa per maund” the words
paisa per quintal” shall be substituted.

4. Repeal of U.P. Ordinance No. Ill of 1961 -
“The Uttar Pradesh Sugarcane Laws (Amendment) Ordinance, 1961. is hereby repeated
and the provisions of Sections 6 and 24 of the U.P. General Clauses Act, 1904 (11.P. Act I of
1904), shall apply as fit were an enactment repealed and re-enacted by an Uttar Pradesh Act.
