Shon•titie and 1..(I) This Act may be called the Amity,University Uttar Pradesh Act, 2005; ' commencement .. t

.. • (2) It shall be deemed to have come ITO force on January, 12, 2005.

Definitions: 2. In this Act, unless the context otberwit e requires;

(a) • "Academic Couneir means the Academic Council . of the

University; . (b) "Bohol" means the Board of Studies-and the Planning Board, or

any other Board of the University; • . . (c) "Chancellor", "Vice-Chancellor" and "Pro-Vice Chancellor"

mean. respectively the Chancellor, the Vice-Chancelior and the Pro-Vice Chancellor of the University; .

(d) "Court'-' means the Court of the University; ..

(e).."Director/Principal" means the Head of an Institution; College, School; Polytechnic and Industrial Training Institute or the person appointed for the purpose to act as such in his absence;

0 "Department" means a Department of Studies, and includes a

Center of Studies and Research; . - ,

. - (g) "Employee" means any person appointed by the University, and includes a teacher or any other niember.ofthe staff of the University;

(7o "Executive Council" means .the Executive Council of the- University; • ,

(a) "Faculty" means a Faculty of the University;

0) "Foundation" means the. Ritnand Balved Education Foundation, registered under the Societies Registration Act, 1860;

(k) "Hostel" means Scholars/Students Hostel of the University; -

"Treasurer", "Registrar"; "Deputy Registrar", "Finance Officer", "Controller of Examinations", "Librarian", or "Proctor" means respectively the Treasurer, the Registrar, the Deputy Re.istrar, the Finance Officer, the Controller of 7xaminations, the Librarian or the Proctor of the University;

"Uqiversity" means the Amity University Uttar Pradesh established under this Act by the Foundation;

(r) "Visitor" means the Visitor of the University.

3.11) There shall be established at Gautam Buddha Nagar, Uttar Pradesh a University by the Foundation in the name of the Amity University Uttar Pradesh.

(2) The University shall be a body corporate.

4. The sponsoring body, the Foundation shall, for the purposes of establishing the University under this Act, fulfil the following conditions, namely :—

(a) duly possess with title rights for 30 years or more, minimum SO' acres or contiguous land earmarked for the University;

• (b) construct on the land referred to in clause (a) buildings of at least 24,000 sq. metres carpet area, out of which at least 50 per cent shall be for

.academic and administrative purposes; (a) install equipments in offices and laboratories worth, minimum

Ps. 5 crores in the building referred to in clause (6); (d) appoint teachers and establish infrastructure of• the

department/schools for the purpose of teaching and/or research in at least seven subject as per standards laid down by the University Grants Commission;

(e) make the Statutes and the Ordinances for the administration and functioning of the University;

W such other conditions as may be required by the State Government to be fulfilled before the establishment of the University. 5. (1) The University shall start operation only after the State Government

issues to the Foundation a letter of authorization for the commencement of the . functioning of the University.

(2) The:State Government shall issue the letter Of authorization on receipt of - an unainbiguous affidavit alongwith documents by the Foundation to the effect that all conditions referred to in section 4 have been fulfilled.

. 6. The objects of the University shall be to diseminate and advance knowledge by providing instructional, research and extension facilities • in such

.branches of learning as it may deem fit and the University shall endeavor to provide to students and teachers the necessary atmosphere and facilities for the promotion of:—

innovations in education leading to restructuring of courses, new methods of teaching and learning and integral development of personality,

studies in various disciplines;

• • (d) national integration, secularism, international understanding and ethics.

7. The University shall have the following powers, namelYf:—

to provide for instruction in such branches of learning as the University may, from time to time, determine and to make provisions for research and for the advancement and dissemination of knowledge;

to impart and promote the study of science, technology, medicine, - management and other professional courses dnd also history culture, philosopy and distant educational programs, etc; t.

to grant, subject to such conditions as the University may determine, diplomas or certificates to, and confer degrees or other academic distinctions on the basis of examinations, evaluation or any other method of testing on persons, and to withdraw any such diplomas, certificates, degrees or other academic distinctions for good and sufficient cause;

to institute Directorships, Principal ships, Professorships, Readerships, Lecturerships and other teaching or academic posts required by the University and to make appointments for the same;

to create administrative, ministerial and other posts and to make appointments thereto;

to appoint/engage persons working in any other University or Organization having 'specific knowledge permanently or for a specified period;

0 to co-operate, collaborate or associate with any other University or Adthority or Institution in such manner and for such purpose as the University may determine;

(k) to establish and• maintain schools, institutions and such Centers, specialized Laboratories or other units for research and instructions as are in the opinion of the University, necessary for the furtherance of its object;

(7) to institute and award fellowships, scholarships, studentships, medals - and prizes;

(m) to establish and maintain hostels for students of the University;

to make provisions for research and consultancy, and for that purpose to enter into such arrangements with other institutions or bodies as the University may deem necessary;

to declare centre, an institution, a Department, or school, as the case • may be, in accordance with the Statutes;

to determine standards for admission into the University, which may include examination, evaluation or any other method of testing;

to demand and receive payment of fees and other charges;

to supervise the residents of the students of the University and to make arrangements for promoting their health and general welfare;

to make special arrangements in respect of women students as the

University may consider desirable;

to regulate and enforce discipline.among the employees and students of the University and take such disciplinary measures in this regard as may be

deemed necessary by the University;

to make arrangements for promoting the health and general welfare r

to receive donations and to acquire, hold, manage and dispose of any property, movable including trust and document proparties or immovable

8. (1) Admission to the different academic programmes shall be made in. Admission Standards

accordan. ce with the laws for the time, being in force.

, (2) The •University shall ensure that the academic standards of the courses

o ffered by the University are in accordance with the guidelines of the University

'Grants Conunission. .

(3) The teacher student ratio shall be in accordance with the guidelines of the

GniYersity Grants Commission. •

. 9. The University shall be open to persons of either sex and of whatever race,

. • (3) The Visitor shall have the right to take any action in the cases of dispute

referred to him by the Chancellor.

University. 12. (1) The Chancellor shall be appointed by the State Government in

consultation with the Foundation. •

(2) The Chancellor shall hold office during the pleasure of the State

Government.

(3) The Chancellor may by 'writing under his hand addressed to the State

Government, resign his office.

(4) Subject to the provisions of this section, the Chancellor shall hold office for a term of five years from the date on which he enters upon his office:

Provided that is-Chancellor shall notwithstanding the expiration of his term

continue to hold office-until his successor enters upon his office.

The Vice- Chancellor

The Chancellor shall, by virtue of his office, be the Head of the University.

The Chancellor shall, if present, preside at the Convocation of the University held for conferring degrees.

13..(1) The Vice-Chancellor shall be appointed by .the Chancellor in such manner as may be prescribed, for a period of five years.

The Vice-Chancellor shall be the principal executive and academic officer

of the University and shall be the Chairman of the Executive Council and the

Academic Council of the University, and shall exercise general supervision and

control over the affairs of the University and give effect to the decisions of the authorities of the University.

The Vice-Chancellor may, if he is.of the opinion that immediate action is necessary on any matter, exercise any power conferred on any authority of the

University by or under this Act and shall convey to such authority the action taken by, him on such matters:

Provided that if the authority concerned is of the opinion that such action

ought not have been taken, it may refer the matter to the visitor whose decision thereon shall be final:

Provided further that any person in the service of the University who is

aggrieved by the action taken by the Vice-Chancellor under this sub-section, shall have the right to appeal against suth action to the Chancellor within one month from the.

date on which a decision on such action is communicated to him and there upon the Chancellor may confirm, modify or reverse action taken by the Vice-Chancellor.

The Vice-Chancellor shall exercise such powers and perform such other functions as may be prescribed.

14. (1) The Pro-Vice-Chancellor shall be appointed by the Vice-Chancellor and shall exercise such powers and perform such functions as may be prescribed.

The Pro-Vice-Chancellor appointed under sub-section (1) shall discharge his duties in addition to his duties as a professor.

The Pro-Vice-Chancellor shall assist the Vice-Chacellor in discharging day fo day duties as and when required by the Vice-Chancellor.

The Pro-Vice-Chancellor shall get honorarium of such amount as may be determined by the Foundation.

15. (1) The Registrar shall be appointed in such manner as may be prescribed.

The Registrar shall have the power to enter into agreements, sign ,

documents and authenticate records on behalf of the University and shall exercise such

other powers and perform such other functions as may be prescribed.

The Registrar shall be the Ex-officio secretary of the Executive Council and the Academic Council.

16. (1) The Treasurer shall be appointed in-,such manner, and shall exerCise

such powers and perform such function as may be prescribed.

(2) The Treasurer shall assist the Vice-Chancellor in all financial matters

including annual budget, annual auditing, allocation of funds, etc. 2

the principles governing seniority of service of employees;

the procedure for settlement of disputes between employees or students and the University;

0) the conferment of honorary degrees;

(k) the withdrawal of degrees, diplomas, certificates and other academic distitnctions;

(4) Notwithstanding anything contained in the foregoing sub-sections the Chancellor may direct the University to make provisions in the statutes, in respect of

any matter specified by him and if the Executive Council is unable to implement such a direction within sixty days of its receipt, the Chancellor may, after considering the reasons, if any, communicated by the Executive Council for its inability to comply with such direction, make or amend the Statutes accordingly as he may deem fit.

28. Subject to the provisions of this Act and the Statutes, the Ordinances shall

be made by the Executive. Council with the prior approval of the Chancellor which may provide for all or any of the following matters, namely:—

the admission of students to the University and their enrolment as

such;

the courses of study Co be laid down for all degrees, diplomas and certificates of the University;

the medium of instruction and examination;

the award of degrees, diplomas, certificates and Other academic distinctions, the qualifications for the same and the means to be taken relating to the granting and obtaining of the same.

the fees to be charged for courses of study in the University and for admission to the examinations, degrees, diplomas and certificates of the University;

69 the conditions for the award of fellowships, scholarships, studentships, medals and prizes;

(g) the conduct of examipatiOns, including the term of office and manner of appointment and the duties of examining bodies, examiners and moderators;

(11) the conditions of residence of the students of the University;

(i) the special arrangements, if any, which may be made for the residence, discipline and teaching of women students and the prescribing of special courses of studies for them within the University;

6) the appointment and emoluments of employees other than those for whom provision has been made in the Statutes;

(k) the establishment of Centers of Studies, Boards of Studies,• Interdisciplinary Studies, Special, Centers, Specialized Laboratories and other Committees;

(7) the manner of co-operation and collaboration with other Universities and authorities including learned bodies or associations;

(in) the creation, composition and functions of any other body which is concidered necessary for improving the academic mileser of the Univeristy;

(n) the remuneration to be paid to the examiners, moderators,

invigilators and tabulators;

(a) such other terms and conditions of service, of teachers and other

academic staff as are not prescribed by the Statutes;

29. (I) The annual report of the University shall be prepared under the

direction of the Executive Council and -shall be submitted to the Court on or after such date as may be mese: ibed and the Court shall consider the report in its annual meeting.

30. (1) The annual accounts and balance 'sheet of the University shall be prepared under the directions of the Executive Council and shall, once at least t every year and at intervals of not more than fifteen months, be audited by an experinced and qualified firm of chartered Accountant of repute. .

A copy of the annual accounts, together with the audit report thereon, shall be submitted to the Court and the Chancellor along with the observations of the Executive Council.

any observations made by the Chancellor on the annual accounts shall be brought to the notice of the Court and the Executive Council and the observations, if any, shall after being reviewed by the Executive Council, be submitted to the Chancellor.

31. (1) Every employee of the University shall be appointed engaged as per provision of the Statutes.

(2) Any dispute arising between the University and any of the employees It appointed substantively, shall be referred to the Executive Council who shall decide the dispute after affording an opportunity to the employee within three Months from the date of its reference.

The aggrieved employee, may file an appeal against the order of the Executive Council to the Chancellor of the University.

Any dispute in respect of any employee engaged temporarily or on ad-hoc or part time or casual basis shall be heard and decided finally by the head of the concerned department.

The decision of the Chancellor shall be final and no suit shall lie in any Court in respect of the matters decided by the Chancellor.

(I) Any student or candidate for an examination whose name has been .removed from the rolls of the University by the orders or resolution of the Academic Council, Proctorial Board or Controller of Examination, as the case may be, and who has been debarred from appearing at the examinations of the University for more than one year, may within ten days of the date of receipt of such orders or copy of such- resolution by him in writing appeal to the Vice-Chantellor who may confirm, modify or reverse the decision to the aforesaid authorities or the concerned Committee, as the case may be.

(2) Any decision taken by the Vice-Chancellor shall be final. •

The University may constitute for the benefit of its employees such pension or Provident Fund or provide such insurance .schemes as it may deem fit- in such manner and subject to such conditions as may be prescribed.

34: If any question arises as to whether any person has been duly nominated or appointed as or is eptitled to be a member or an authority or other body of the University. the matter shall be referred to the Chancellor whose decision thereupon shall be final..

Where arty authority of the University is given power by this Act or the Statutes to appoint Committees, such Committees shall . save as otherwise provided,. consist of the members of the authority concerned and of such other persons as the

' authority in each case may think fit.

All vacancies among the members (other than ar-officio members) of any authority or other body of the University shall be filled, as soon as may be convenient by the person or body who appointed, nominated or co-opted the members whose place has become vacant. The person appointed or co-opted to such vacancy shall be a member of such authority or body for the remaining term for which he has been • appointed or-co-opted.- •

Condition of 3]_ (1) Every employee of the University shall be appointed engaged as per 55m“ 0f- provision of the Statutes. employees (2) Any dispute arising between the University and any of the employees appointed substantively, shall be referred .to the Executive Council who shall decide the dispute aﬁer affording an opportunity to the employee within three months from the date of its reference. (3) The aggrieved employee, may ﬁle an appeal against the order of the Executive Council to the Chancellor of the' University. - (4) Any dispute in respect of any employee engaged temporarily or on ad—hoc or pan time or casual basis shall be heard and decided ﬁnally by the head of the concerned department. ’ (5) The decision of the Chancellor shall be ﬁnal and no suit shall lie in any Court in respect of the matters decided by the Chancellor. (1) Any student or candidate for an examination whose name has been 'removed from the rolls of the University by the orders or resolution of the Academic Council, Proctorial Board or Controller of Examination, as the case may be and who has been debarred from appearing at the examinations of the University for more than , one year may within ten days of the date of receipt of such orders or copy of such- ‘ . ‘ resolution by him 1n writing appeal to the Vic-e Chancellor who may conﬁrm, modify ‘ or reverse the decision to the aforesaid authorities or the concerned Committee, as the case may be. 40. (I) The University shall establish a permanent endowment fund of at least

all contibutions made by the Foundation; and

all contributions made in this behalf by any other person on body

which are not prohibited by any law for the time:being in- force.

(2) The moneys credited to the general fund shall' be applied to meet all the

recurring expenditures of the University. _

42. (1) The University shall also establish a devielopnient fund to which Develogment , following moneys shall be credited, namely;

The University shall not be eligible for any grant-in-aid or any financial assistance from the State Government or any other body or Corporation owned and controlled by the State Government.

The fees charged for different academic programmes shall be in accordance with laws for the time being in force.

It shall be the duty of the University or any authority or officer of the University to furnish such informations or records relating to the administration or finances and other affairs of the University as the State Government may call for.

The State Government, if it is of the view that there is a violation of the provisions of the Act or the Statutes or Ordinances, made thereunder may issue such directions to the University under section 50 as it may deem necessary.

(1) If the University proposes its dissolution in accordance with the law governing its constitutions or incorporation, it shall give at least six months written notice to the State Government.

(2) On receipt of notice refer to in sub-section (I) the State Government shall made such arrangement for administration of the University from the date of dissolution of the University and until the last batch of students in regular courses of studies of the University complete their courses of studies in such manner as may be prescribed. •

(1) The expenditure for administration of the University during the taking over the liabilities of the University under section 47 shall be met out of the permanent endowment fund the general fund and the development fund. •

(2) If the nand; referred to sub-section (1) are not sufficient to meet the expenditure of the University during the taking over the liabilities of the University such expenditure may be met by disposing of the properties or assets of the University by the State Government. .

(1) Where the State Government is satisfied that the University is not functioning in accordance with the provisions of this Act on receipt of a complaint with respect to the management of the Univeristy, it shall require the University to show. cause with in such time which shall not be less than two months, as to why the University should not be de-recognized.

If, 1 pon receipt of the reply of the University to .the nntice given under sub-section (1), the State Government is satisfied that a prima-facie case of . mismanagement or violation of the provisions of this Act the rules the Statutes, the Ordinances there ander is made out, it shall order such enquiry as it deems necessary..

For the purposes of an inquiry under sub-section (2), the State Government shall, by notification, appoint an officer or authority as the enquiring authority to enquire into and report upon.the allegations of mismanagement violation of the provisions of this Act the Rules, the Statutes, the Ordinances or. any .direction

issued thereunder. . • . •

Where the State Government considers it necessary or. expedient to.

suspend the Court for the purposes of an inquiry with respect to .the affairs of ;he Univers,ity, it may, by notification, order the suspension of the Court. as the -case rhay:tit be, and make such arrangenient for the administration of the University as it considers

Every inquiring authority appointed under- sub-section (3) shall while performing its funclions under this Act have all the poweis of Civil Court under the. Code of Civil Procedure, 1908 tying a suit and in particular in respect of the following

If, upon receipt of the inquiry report, the State Government is satisifed that the University has been mismanaged or has violated any provision of this Act, the Statues . and the Ordinance thereunder it may,-by notification, de-recognize the University with the prior approval of the University Grants

Commission.

During the period of the management of the University 'under sub-section (6), the State Government may utilized the permanent endownrnent fund, the general fund or the development fund for the purposes of the management of the affairs of the University . If the funds of the University are not sufficient to meet the requisite expendit4re. of the University ,the

State Government may dispose of the assets or the properties of

the University to meet the said expenses.

(8) Every notification under sub-section (6), shall be laid before both Houses of the State Legislature.

The State Government may issue such directions from time to time to the University on policy_ matters not in consistent with the

6 provisions of this Act as it may deeTh necessary. Such directions shall be

complied with by the University.

(I) The State Government may for the purposes of removing any difficulties, particularly in relation to the transition from the provisions of the Uttar Pradesh State University Act, 1973 to the provisions of this Act, direct that the provisions of this Act shall during such period as may be specified in the order, have effect subject to such adaptations, whether by way of modification addition or omission as it may deem necessary or

expedient:

Provided that no such order shall be made after two years from

the date of commencement of this Act.

Every order made under sub-section (1) shall be laid before both the Houses of the State Legislature as soon as may be after it is made.

No order made under sub-section (1) shall be called in question in any court on the ground that no difficulty as is referred to in

that sub-section existed or was required to be remm?ed. •

• 52. (1) The Amity University Uttar Pradesh Ordinance, 2005 is

hereby repealed. . .

(2) Notwithstanding such rekal, anything done or any action taken under the Ordinance referred to in sub-section (I) shall be deemed to have been dorre.or taken under this Act as if the provisions of this Act

were in force at all material times.

With a view toencouraging private University in the field of higher education, it has been 'decided, to establish and incorporate a teaching University at Gaut= Buddha Nagar in Uttar Pradesh sponsored Ritnand Balved Education Foundation, New Delhi which is a society registered under the Societies Registration Act, 1860.

Since the State Legislature was not in session and immediate legislative action WaS necessary to: implement the aforesaid decision the Amity University Ltd& Pradesh 'OrdinaACe, 2005 (U. P. Ordinance no. 1 of 2003) was prothidgated by the Governor on'Januaty'1Z 2005: •

Thereafter, it has been decided, to:make-certain bmendments n the. provisions of the Ordinance, such as reducing the:amount of Pernianent Endowment Fund from RS1, ten :croft, to Rs. one crore and omitting the provision for making Ordinances with respect to the admission/fee,concession and of the
