Short title.

AN ACT

further to amend

the Lucknow University Act, 1920 ; the Allahabad University Act, 1921 ; the Agra University Act, 1926 ; the Gorakhpur University Act, 1956 ; the Varanaseya Sanskrit Yishva Yidyalaya Act, 1956 ; and the Kanpur and Meerut Universities Act, 1965.

It is hereby enacted in the Twenty-second Year of the Republic of India a follows :

CHAPTER I Preliminary

This Act may' be called the Uttar Pradesh Universities (Amendment)Act, 1971.

CHAPTER II

Amendment of the Lucknow University Act, 1920

In section 10 of the Lucknow University Act, 1920, in sub-section (40,— after clause (ii) the following clause shall be inserted, namely :— "(ii-a) Where the Chancellor does not consider any of the persons

recommended by the Committee to be suitable for appointment as Vice-Chancellor or if one or more of the persons recommended is or are not available for appointment and the choice of the Chancellor is restricted to less than three persons, he may call for fresh retain mendations from the Committee."

CHAPTER HI

Amendment of the Allahabad University Act, 1921

In section 11 of the Allahabad University Act, 1921, in sub-section (4),-t

after clause (ii) the following clause shall be inserted, namely "(ii-a) Where the Chancellor does not consider any of the persons

recommended by the Committee to be suitable for appointment as Vice-Chancellor or if one or more of the persons recommended is Or are not available for appointment and the choice of the Chancellor is restricted to less than three persons, he may call for fresh recom- mendations from the Committee."

Amendment of the Agra University Act, 1926

In section 9 of the Agra University Act, 1926 (hereinafter in this Chaiter referred to as the principal Act), in sub-section (4),—

"(ii-a)-Where the Kulapati does not consider any of the persons recommended by the Committee to be suitable for appointment as Upa-Kulapati or if one or more of the persons recommended is or are not available for appointment and the choice of the Kulapati is res- tricted to less than three persons, he may call fresh recommendations from the Committee."

Amendment of section 28.

Repeal of U. P. Ordinances no. 4 and no. 9 of 1971.

In section 28 of the principal Act— (i) in sub-section (1), the words "not being a college maintained

exclusively by the Government" shall be omitted; 00 in sub-section (3), the words "other than a college maintained

exclusively by the Government" shall be omitted, After section 47 of the principal Act, the following section shall be

inserted and be deemed always to have been inserted, namely :— "47-A. No act or proceedings of any authority or other body of: the

University shall be called in question merely the ground of the existence of any vacancy in

membership thereof or any defect in its constitution, or of some perm* having taken part in the proceedings thereof who is subsequently discovered not to have been entitled so to do."

(I) The principal Act shall during a period beginning on the date specified in Column III of Schedule I and ending on the expiration of three years (or suck shorter period as the State Government may by notification in the Gazette direct), from the commencement of this Act have effect and be deemed to have had ens subject to the amendments specified in Columns I and II of the said Schedule.

(2) Anything done or purporting to have been done or any action taken e purporting to have been taken under the principal Act as amended by the Kanpur and Meerut Universities (Removal of Difficulties) Order, specified in Schedule II, shall be deemed to have been done or taken under the principal Act as amended by this Act and to be and always to have been as valid as if the provisions of this Act were in force at all material times, any judgment, decree or order of any Court to the contrary notwithstanding.

(1) The Statutes of the Kanpur and Meerut Universities purporting t have been made under sub-section (1) of section 31 of the principal Act and pub- lished respectively with notifications nos. CI(R)/4699/XV-39(9)-66 and CI(R 7578/XV-39(9)-66, dated September 28, 1968, in Gazette Extraordinary at same date as purporting to have been amended by the Kanpur and Meerutlhib versities (Removal of Difficulties) (Third) Order, 1968, published with notification no. CI(R)1109881XV-39(9)-1966, dated December 31, 1968, in the Gazette Extr ordinary of the same date (hereinafter in this section referred to as the said Pint Statutes), are hereby enacted as forming part of the principal Act during a period beginning on September 28, 1968 and ending on the expiration of three years (in such shorter period as the State Government may by notification in the Garet direct), from the commencement of this Act and the principal Act shall; -to - tie extent of any inconsistency with the provisions of the said First Statutes, hay- effect and be deemed to have had effect subject to such provisions.
