IN pursuance of Inc provisions of clause (3) of Article 348 of the Coast i tution, of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Raha Vishwavidyalaya (Sanshodhan) Adhiniyan!, 1998 (Uttar Pradesh Adhiniyam Sankhya 9 of 1998) as passed by the Uttar Pradesh Legislature and assented to by the Governor on February 12, 1998.

AN ACT

further to ainendlthe Uttar PradeshiState Universities Act, 1973

IT IS HEREBY enacted in the Forty-ninth Year of the Republic of India as follows :-

1. (1) This Act may be called the Uttar Pradesh State Universities (Amendment) Act, 1998.

(2) Sections 2,4, 5 and 6 shall be deemed to have come into force on September 19, 1997 and the remaining provisions shall Cote into force at once.

2. After section 3I-A of the Uttar Pradesh State Universities Act, 1973, hereinafter referred to as the principal Act, the following section shall be inserted, namely : —

6,31-AA. (1) Notwithstanding anything contained in any other Promotion to the Provision of this Act, an Assistant Professor Post of Associate substantively appointed in the Faculty of Professor and Professor Medicine Or Dental sciences of the university

of Lucknow or an Associate Profersor, sub-t,Ifstantively appointed, or promoted under this section, in the said Faculties of the said University, who has put in such length of service and possesses such qualifications as may be prescribed, may be given personnel promotion respectively to the post of Associate Professor or Professor."

(2) The promotion under sub-section (I) shall be given on the recommendation of the Selection Committee, constituted under clause (a)

of sub-section (4) of section 31, in such manner and subject to such conditions as may be prescribed.

Explanation :—With regard to rhe Faculty of mod icine or Dental

Sciences of the University of Lucknow, the word "Reader" referred to in clause (a) of sub-section (4) of section 31 shall be construed as "Associate Professor".

following sub-section shall be suhs thole d, namely :—

"(6) Notwithstanding anything contained in the foregoing sub- section the State _Government may in order to implement any decision taken by it in the !metes? of learringi teaching or research or for the benefit of teachers, students or other staff or on the basis of any suggestion or recommendation of the University Grants commission or the State or national education policy with regard to the qualifi- cation of the teachers, require the Executive council to make new or additional Statutes or amend or renal the Statutes referred to in sub-section (I) or sub-section (1-A) within a specified time and if the Executive Council fails to comply with such requirement the State Government may, with the assent of the Chancellor, make new or additional Statutes or amend or repeal the Statutes referred to in sub-section (1) or sub-section (I -A)."

5, In sect ion 57 of the principal Act in clause (ii) for the words "the Statute or Ordinances" the words “the Statute or Ordinances or has failed to comply with the orders of the Director of Education (Higher Education) made on the basis of the rec.ommeodation of the Uttar pre desh Higher Education services Commission under the Uttar Pradesh Higher Education Services Commission Act, MO," shall be substituted.

6. In section 65 of the principal Act, in sub-section (2) the words "and thereafter till his successor is duly appointed", shall be omitted.

.7. (I) The Uttar Pradesh State Universities ( Amendment)

Ordinance, 1997 it hereby repealed. •

(4 Notwithstanding such repeal, anything done or any action taken under the provisions of the principal Act, as amended by the Ordinance referred to in sub-section (1) shall be deemed to have been done or taken under the eoriesponding provisions of the principal Act as amens'ed bY this AM as if the provisions of this Act 9bere in force at all material times.
