IT 1S HEREBY enacted in the Fifty-eighth Year of the Republic of India as
follows :-
1(1) This Act may be called the Uttar Pradesh Public Premises (Eviction of —Shorttitle,
Unauthorized Occupants) (Amendment) Act, 2007.

STATEMENT OF OBJECTS AND REASONS
The Estate Department of the State Government is the manager of
certain public premises, which
are under occupation of various classes of ineligible persons.
The said premises are needed for public
purpose and the State Government is of the opinion that in view of
the acute shortage of public premises,
the said public purpose is not being fulfilled.
Since the State Government is under an obligation to provide
suitable accommodation and
- offices to several classes of eligible persons and organiz
ation and the procedure for eviction prescribed
under the Uttar Pradesh Public Premises (Eviction of Unauthorized Occu
pants) Act, 1972 is cumbersome
and time consuming and is not appropriate for centain classes of
building/occupants, it has become
necessary for State Government to get such public premises as a
re occupied by the persons/organisations |
not eligible for such occupation be vacated to fulfill the said ob
ligation. °
2. Keeping in view of the above problem it has been considered ex
pedient to ex¢lude such Public
Premises as are under the administrative control of the Estate Departmen
t and which are in occupation of
non-official, non-governmental organisations, trusts, political parties
etc., from the purview of the Uttar
Pradesh Public Premises (Eviction of unauthorised occupants)
Act, 1972 (U.P. Act No. XXII of 1972) and
to take necessary action to evict unauthorised occupants. It has
, therefore, been decided to amend the said
Act to provide for the exclusion of the residential premises al
lotted to Ministers, Members of Parliament,
Legislatures, non-governmental organisation, trusts, non-officia
ls, political parties and such other persons
who do not come in the field of eligibility. |
