CHAPTER I

PRELMINARY

I. This Act may be called the Uttar Pradesh Higher Education Grantii Coininission Act; 1974.

In this Act unless the context otherwise requires—

.. (s) !Chairman ' means the Chairman of the Commission, and includes the Vice-Chairman of any other member for the time being performing the, functions of the Chairman;

'College', means an affiliated college or associated college to whi the privilege of affiliation or recognition as such is granted by University ;

'Commission' means, the Uttar Pradesh Higher Education Gras Commission establisehd under section 3 ;

'fund' Or 'fund of the Commission' means the fund constant under section 14;

'Member.' means a member of the Commission and includes t Chairman ; •

'prescribed' means prescribed by rules made under this Act ;

'regulations' means regulations made under . this Act;

'university' means a University as defined in clause (20) section 2 of the Uttar Pradesh State Universities Act, 1973.

, CHAPTER H

EslABLISHMENT OF THE COMMISSION

State Government, to be appointed by it as Chairman ; two persons of academic eminence, one of whom shall be a pen

8: (1) The Commission may associate with itself, in such manner and for such purposes as may be determined by regulations, any person whose assistance or advice it may desire in carrying out any of the provisions of this Act.

‘(2) A person associated with it by the Commission under sub-section (1) for any purpose shall have a right to take part in the diseussions relevant to

Government on the allocation Of any grants to Universities and CoReps for any general or specified purpose out ot the Consolidated Fund of the State;

(c) wher ii appears to it that any grant allocated by it to a College under clause (b) or by the State Government on its recommendation

under clause (d) has not been or is not being utilised for the purpose for which it was allocated and wholly or partly disbursed, make such direct arrangements as it may think fit for the proper utilization of the grant for such purpose, including any direct payment for purchase of equip- ment or direct payment of salaries, and may for that purpose require the College to refund the grants already disbursed or deduct the same from any further grant already allocated or that may be allocated to it;

advise the State Government, if such advice is asked for, on the establishment of a new University or college or on proposals, connected with the expansion of the activities of any University or college;

advise any University, if such advice is asked for through the Chancellor on the establishment of a new college or on proposals con- nected with expansion of the activities of any college ;

advise the State Government or any University on any question which may be referred to the Commission by the State Government or the UniversitY, as die case may be ;

collect information on all such matters 'relating to higher educa- tion in India and other countries as it thinks fit and make the same avail- able to any University or college ;

require a University or college to furnish it with such information; as may be needed relating to the financial position of the University or college or the studies in the various branches of learning undertaken in that University or college, together with all relevant information relat- ing to the standards of teaching and examination in that University or college respecting each of such branches of learning ;

perform such other functions as may be prescribed or as may bel

deemed necessary by the Commission for advancing the cause of higher education in the State or as may be incidental or conducive to th6 discharge of the above functions.

Inspection. 12. (1) For the purpose of ascertaining the financial needs of a Universit

or a college the Commission may, with the consent of the University, cause an, inspection of any department or departments thereof to be made in such manner:

it may think fit and by such person or persons as it may direct.

(2) The Commission shall communicate to the University its views regard to the results of any such inspection and may, after ascertaining the' opinion of the University, recommend to the University the action to be take4 as a result of such inspection.

Commission. State Legislature in this behalf, pay to the Commission, in each financial year, such sums as may be considered necessary for the performance of The functions, of the Commission under this Act.

17. (1) The Commission shall cause to be maintained such books of Account and atcounts and other books in relation to its account in such form and in such Audit'

, (2) 'The commission shall, as soon as may be after closing its annual aecounts, prepare statement of accounts in such form, and forward the same to the Accountant General by such date as the State Government may, in con- sultation with die Accountant General determine, for audit under section 14 of-the Comptroller ahd Auditor Generals' (Duties, Powers and Conditions of Service) Act, 1971.

(3) The,annual accounts of the Commission together with the audit report thereon shall he forwarded to the State Government and the Government shall

CHAPTER EV

MISCELLANEOUS

20. (1) The State Government may, by notification in the Gazette, dele- gate, either unconditionally or subject to such conditions as it thinks fit, to the Commission any of its powers and functions under the Uttar Pradesh State Universities Act, 1973, or under rule made under section 17 thereof but exclud- ing the power to make such rules and may at any time modify or withdraw such delegation.

(2) . The Commission may, delegate, either unconditionally or,subject to such conditions as it think fit, to its Chairman, Vice-Chairman or any of its officers, any of its powers and functions, including any powers with regard to the incurring of expenditure in connection with the maintenance of the office .and internal administration of the Commission but excluding any power or function delegated to it under sub-section (1), and may at any time modify or withdraw such delegation.

(3) Subject to die provisions of sub-sections (I) and (2), the Chairman may delegate, either unconditionally or subject to such conditions as he thinks fit, to the Vice-Chahanan or the Secretary, any of his powers and functions and May at any time modify or withdraw such delegation.
