IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is

pleased to order the publication of the following English translation of the Civil Vidhi (Uttar Pradesh

Sanshodhan) Adhiniyam, 2019 (Uttar Pradesh Adhiniyam Sankhya 16 of 2019) as passed by the

Uttar Pradesh Legislature and assented to by the President on November 29, 2019. The Nyay Anubhag-3 is

administratively concerned with the said Adhiniyam.

THE CIVIL LAWS (UTTAR PRADESH AMENDMENT) ACT, 2019

AN

ACT

further to amend the Code of Civil Procedure, 1908 and the Arbitration and

Conciliation Act, 1996 in their application to Uttar Pradesh.

Jr IS HEREBY enacted in the Seventieth Year of the Republic of India as

follows:-

CHAPTER-1

PRELIMINARY

1. This Act may be called the Civil Laws (Uttar Pradesh Amendment) Short title

Act, 2019.

CHAPTER-2

AMENDMENT OF THE CIVIL PROCEDURE CODE, 1908

In section 102 of the Code of Civil Procedure, 1908 hereinafter in this

chapter referred to as the principal Act for the words "twenty five thousand rupees",

the words "fifty thdusand rupees" shall be substituted.

In section 115 of the principal Act for the words "five lakh rupees", the

words "twenty five lakh rupees" shall be substituted.

CHAPTER-3

AMENDMENT OF THE ARBITRATION AND CONCILIATION ACT, 1996

In section 2 of the Arbitration and Conciliation Act, 1996 in Amendment of .

sub-section (1)for clause (e) the following clause shall be substituted, namely :- section 2 of

Act no. 26 of 1996

"(e) 'Court' means the principal Civil Court of original jurisdiction in a

district, which shall include the court of the Additional District Judge where so

assigned by the District Judge and includes the High Court in exercise of its ordinary

original civil jurisdiction, having jurisdiction to decide the questions forming the

subject-matter of the arbitration if the same had been the subject-matter of suit, or any

Court of Small Causes."

STATEMENT OF OBJECTS AND REASONS

With a view to providing speedy justice to the general public and ensuring speedy

disposal of arbitration cases, it has been decided to amend sections 102 and 115 of the Civil

Procedure Code, 1908 and clause (e) of sub-section (1) of section 2 of the Arbitration and

Conciliation Act, 1996 ill their application to Uttar Pradesh.

The Civil Laws (Uttar Pradesh Amendment) Bill, 2019 is introduced accordingly.
