IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the Doctor Ram .Manohar Lohiya Rashtriya

further to amend the Doctor Ram Manohar Lohiya National Law University

Uttar Pradeh Act, 2605.

IT IS HEREBY enacted in the Fifty-ninth Year of the Republic of Ind

follows :-

l. This Act may be called Doctor Ram Manohar Lohiya National Law

University, Uttar Pradesh (Amendment) Act, 2008.

General 2. In Doctor Ram Manohar Lohiya National Law University, Uttar Pradesh amendment in Act, 2005 hereinafter referred to as the principal Act, for the word 'Chairman" and U.P. Act no.28 of 2005

"Director" wherever occurring including marginal heading, the word "Chairperson"

and "Vice-Chancellor" shall respectively be substituted.

Amendment of 3. In section-9 of the principal Act, in sub-section (1), section 9

clause (ii) and clause (iii) appearing under the heading "Nominated

Members" shall be omitted;

in clause (iv) and clause (vi) appearing under the heading

"Nominated Members" for the words "nominated by the State Government",

substituted.

4. In section 12 of the principal Act, in sub-section (5), for the words "the

General Council for confirmation" the words "the General Council" shall be

substituted.

5.1n section 14 of the principal Act, in sub-section (1),-

in clause (vii) and clause (viii) for the words "nominated by the State

Government", the words "nominated by the Chairperson of the General

Council," shall be substituted;

in clause (ix)for the words "whole time senior professors" the words

"senior professors" shall be substituted.

. tsectian shall be inserted, namely

"(3) If an urgent action by the Executive Council becomes necessary, the

Chairperson of the General Council may permit the business to be transacted

by circulation of papers to the members of the Executive Council. The action

proposed under this sub-section shall not be taken unless agreed to by one-third

of the total members of the Executive Council. The action so taken shall be •

forthwith intimated to:all the members of the Executive Council and the matter shall be reported in the next meeting of the ExeCutive Council."

7. In section 21 of the principal Act, in sub-section (1), in clause (ii) for the words "the chairman in consultation with the General Council" the words "the Chairperson" shall be substituted.

8. In section 27 of the. principal Act,—

after sub-section (I) the folloWing sub-section shall be inserted, namely :—

MA) Notwithstanding anything to the contrary contained in sub-clause (1), the Chairperson of the General Council, if satisfied, may grant extension for another term of five years to the Vice- Chancellor continuing in office after completing four . years in office and the matter shall be reported in the next meeting of the General Council;"

in sub-section (2), in clause .(ii) for the words "nominated by the Chairperson of the General Council", the words ."nominated by the Chairperson of the General Council" shall be substituted.

9. In section 32 of the principal Act, in sub section (3),—

for the,words "and the Visitor may, by order, direct" the words "and the Visitor shall, by order, direct" shall be substitutd,., and

for the words "as may be specified in that order" the words "as may be specified in the order of the Visitor— shall be substituted.

10. In section 43 of the principal Act, —

(a) in sub-section (2) for the words "punishment of debarring a student from the examination or" the words "punishment of" shall be substituted. .

(b) after sub-section (2) the following sub-section shall be inserted, namely:—

"(3) If any student is aggrieved by the order .of the Executive Council, he may. prefer an appeal to the Chairperson of the General Council within a period of thirty days from the date of the receipt of the order of such punishment passed by the Executive Council."

STATEMENT OF OBJECTS AND REASONS

Doctor Ram Manohar Lohiya National Law University Uttar Pradesh Act, 2005 has been enacted to provide for the establishment and incorporation of National Law University at Lucknow in Uttat Pradesh and for the matters connected therewith or incidental thereto. With a view to ensuring that the. • work of the University should be carried out promptly it his been decided to amend the said Act to provide mainly for:

In section 19 of the principal Act, after sub-section (2) the following sub- Amendment of 1-5661.in shall be inserted, namely :— seetion l9 Amendment of section 21 Amendment of ' section 27 Amendment of section 32 Amendment of Section 43 Doctor Ram Manohar Lohiya National Law University Uttar Pradesh Act, 2005 has been enacted l0 provide for the establishment and incorporation of National Law University at Lucknow in Uttar' Pl’adesh and for the matters connected therewith or incidental thereto. With a View to ensuring that the - Work of the University should be carried out promptly it has been decided to amend the said Act to provide I mainly for : _ (a) substituting the words "Diréc‘tor" by the ‘word "Vice-Chancellor", ‘

(b) abolishing, the provision for nomination of two members of the Uttar Pradesii

Legislative Assembly and two members of the Lok Sabha as the members of the General Council':

(c) empowering the Chairperson of General Council to nominate :— a Vice-Chancellor of a University of Uttar Pradesh and five eminent persons a

the members of the General Council instead of the State Government;

Excutive Council ;

(d) empowering .the Chairperson of the General Council to permit the business to

Chancellor to continue in office for another term of five years ;

(f) giving right to. a student to prefer an appeal to the ChairPerson of the General Council

against the order of Excutive Council under sub-section (2) of section 43. Doctor Ram Manohar Lohiya National Law University Uttar Pradesh (Amendment) Bill, 2008 1
