Sher to amend the Court Fees Act, 1870, in its application to Uttar Pradesh.
It is hereby enacted in the Twenty-first Year of the Republic of India as
ollows :—
I. (1) This Act may be called the Court Fees (Uttar Pradesh Amendment)
0.1970. commencement.
It extends to the whole of Uttar Pradesh.
It shall come into force on such date as the State Government may
by notification in the Gazette appoint.
2, In Schedule II to the Court Fees Act, 1870, as amended in its applica-
tion to Uttar Pradesh, in Article I ("Application or petition") —
(i) in clause (c), in the second column, for sub-clause (2) and the
entry relating to it in the third column, the following sub-clause and
entry shall be substituted, namely :—

"(2) Under article 226 or article One hundred rupees.
227 of the Constitution, or by way of
special appeal against a judgment or
order including a judgment or order
passed on a petition filed before the
'commencement of the Court Fees (Uttar
Pradesh Amendment) Act, 1970 passed

(ii) at the end., the following proviso thereto shall be inserted, namely :
Provided that—
. no court fee shall be payable under clause (e) on an applica-
tion or petition under section 491 of the Code of Criminal Procedure,
1898. or under article 226 of the Constitution for writs in the
nature of habeas corpus or in relation to any proceeding relat-
ing thereto;
the court fee payable on an application or petition for
adjournment of hearing of any case shall be double the court fee
payable on an ordinary application or petition under clause (b),
clause (c), clause (d) or sub-clause (5) of clause (c), as the
case may be.
3. Chapter VI of the Uttar Pradesh Taxes and Fees Laws (Amendment) Repeal of Chap-
Ordinance, 1970 is hereby repealed. ter VI of U. P.
