अ ध�नयम, 2010 को सशंो धत करने के &लए �वधेयक।
भारत गणरा,य के च-सठव/ वष1 म/ राज�थान रा,य �वधान-
म3डल �न5 न&ल6खत अ ध�नयम बनाता हैः-
1. स,ं-. त नाम और /ार0 भ.- (1) इस अ ध�नयम का नाम
राज� थान पश ुच�क� सा और पश ु �व�ान �व� व�व�यालय (सशंोधन)
अ ध�नयम, 2013 है।
(2) यह 10 जून, 2013 को और से @व�ृत हुआ समझा जायेगा।
2. 2010 के राज� थान अ�ध3नयम स.ं 13 क4 धारा 24 का
सशंोधन.- राज� थान पश ुच�क� सा और पश ु �व�ान �व� व�व�यालय
अ ध�नयम, 2010 (2010 का अ ध�नम स.ं 13) कE धारा 24 म/,-
(i) उप-धारा (1) म/, �व�यमान अ&भH यिJत ‘‘रा, य सरकार कE
सलाह से’’ के � थान पर अ&भH यिJत ‘‘रा, य सरकार के
परामश1 से’’ @�त� था�पत कE जायेगी; और
(ii) उप-धारा (4) के ��वतीय परO तकु म/, �व�यमान अ&भH यिJत
‘‘पPसठ वष1 कE आय’ु’ के � थान पर अ&भH यिJत ‘‘स�तर
वष1 कE आय’ु’ @�त� था�पत कE जायेगी।
3. 3नरसन और 6याविृ�तयां.- (1) राज� थान पश ुच�क� सा और
पश ु �व�ान �व� व�व�यालय (सशंोधन) अQयादेश, 2013 (2013 का
अQयादेश स.ं 12) इसके �वारा �नर&सत �कया जाता है।
(2) ऐसे �नरसन के होत े हुए भी, उJ त अQ यादेश �वारा यथा
सशंो धत मलू अ ध�नयम के अधीन कE गयी सम�त बात/, कार1वाइयां या
�कये गये आदेश इस अ ध�नयम �वारा यथा सशंो धत मलू अ ध�नयम
के अधीन �कये गये समझे जाय/गे।
उ:े� य; और कारण; का कथन
कुलप�तयT कE �नयिुJत कE पU�त और सेवा�नविृ�त कE आय ु
म/ एकVपता रखने के &लए, राज� थान पश ुच�क� सा और पश ु �व�ान
�व� व�व�यालय अ ध�नयम, 2010 कE धारा 24 को सशंो धत करने का
�व�न� चय �कया गया था।
चूं�क राज�थान �वधान सभा सW म/ नहXं थी और ऐसी
पYरि�थ�तयां �व�यमान थीं िजनके कारण राज�थान के रा,यपाल के
&लए तरुOत कार1वाई करना आव�यक हो गया था, इस&लए, उOहTने 10
जून, 2013 को राज� थान पश ुच�क� सा और पश ु�व�ान �व� व�व�यालय
(सशंोधन) अQ यादेश, 2013 (2013 का अQयादेश स.ं 12) @[ या�पत
�कया जो राज�थान राजपW, असाधारण, भाग 4 (ख) म/ \दनाकं 12
जून, 2013 को @का&शत हुआ।
यह �वधेयक पवू]Jत अQयादेश को @�त�था�पत करने के &लए
ईि^सत है।
अतः �वधेयक @�ततु है।

24. कुलप3त.- (1) �व� व�व�यालय का एक कुलप�त होगा
िजसकE �नयिुJत उप-धारा (2) म/ �न\द1_ ट �वचयन स&म�त �वारा
&सफाYरश �कये गये पशपुालन और पश ु �व�ान म/ �व[ यात
&शbाशाि�WयT के पनैल म/ से रा, य सरकार कE सलाह से कुला धप�त
�वारा कE जायेगी और ऐसे पनैल म/ उJ त स&म�त के �कसी भी सद� य
का नाम अतं�व1_ ट नहXं होगा।
(2) से (3) XX XX XX XX XX
(4) कुलप�त तीन वष1 कE कालाव ध के &लए पद धाYरत करेगा
और दसूरX पदाव ध के &लए �नयिुJत का पाW होगा �कO त ुत� प� चात ्वह
कुलप�त के पद को धाYरत करने के &लए पाW नहXं होगा या नहXं होगी:
परO त-ु
(क) कुला धप�त, आदेश �वारा, �नदेश दे सकेगा �क कुलप�त,
िजसकE पदाव ध समा^ त हो गयी है, एक वष1 कE कुल कालाव ध से
अन धक कE ऐसी कालाव ध के &लए पद पर बना रहेगा, जो आदेश म/
�व�न\द1_ ट कE जाये; और
(ख) कुलप�त, कुला धप�त को सबंो धत, अपने ह� ताbर स\हत
लेख �वारा एक मास का नो\टस देने के प� चात ्अपने पद का � याग कर
सकेगा/सकेगी:
परO त ुयह और �क कुलप�त के Vप म/ �नयJु त H यिJत य\द,
अपनी पदाव ध के दौरान या उसके �कसी �व� तार के दौरान पPसठ वष1
कE आय ु@ा^ त कर लेता है या कर लेती है तो अपने पद से सेवा�नव�ृत
हो जायेगा/हो जायेगी।

(AMENDMENT) BILL, 2013
(To be introduced in the Rajasthan Legislative Assembly) A

to amend the Rajasthan University of Veterinary and Animal
Sciences Act, 2010.
Be it enacted by the Rajasthan State Legislature in the
Sixty-fourth Year of the Republic of India, as follows:-
1. Short title and commencement.- (1) This Act may be
called the Rajasthan University of Veterinary and Animal Sciences
(Amendment) Act, 2013.
(2) It shall be deemed to have come into force on and from
10th June, 2013.
2. Amendment of section 24, Rajasthan Act No. 13 of
2010.- In section 24 of the Rajasthan University of Veterinary and
Animal Sciences Act, 2010 (Act No. 13 of 2010),-
(i) in sub-section (1), for the existing expression "on the
advise of the State Government", the expression "in
consultation with the State Government" shall be
substituted; and
(ii) in second proviso to sub-section (4), for the existing
expression "age of sixty five years", the expression
"age of seventy years" shall be substituted.
3. Repeal and savings.- (1) The Rajasthan University of
Veterinary and Animal Sciences (Amendment) Ordinance, 2013
(Ordinance No. 12 of 2013) is hereby repealed
(2) Notwithstanding such repeal, all things done, actions
taken or orders made under the principal Act as amended by the
said Ordinance shall be deemed to have been done, taken or made
under the principal Act as amended by this Act.
STATEMENT OF OBJECTS AND REASONS
In order to maintain uniformity in the method of
appointment and retirement age of the Vice-Chancellors, it had
been decided to amend section 24 of the Rajasthan University of
Veterinary and Animal Sciences Act, 2010.
Since the Rajasthan Legislative Assembly was not in
session and the circumstances existed which rendered it necessary
for the Governor of Rajasthan to take immediate action, she,
therefore, promulgated the Rajasthan University of Veterinary and Animal Sciences (Amendment) Ordinance, 2013 (Ordinance
No. 12 of 2013) on 10th June, 2013, which was published in the
Rajasthan Gazette, Part IV (B) Extraordinary, dated 12th June,
2013.
This Bill seeks to replace the aforesaid Ordinance.
Hence the Bill.

24. The Vice-Chancellor.- (1) There shall be a Vice-
Chancellor of the University who shall be appointed by the
Chancellor on the advise of the State Government from a panel of
eminent educationists in veterinary and animal sciences
recommended by the Search Committee referred to in sub-section
(2) and such panel shall not contain the name of any member of the
said committee.
(2) to (3) xx xx xx xx xx xx (4) The Vice-Chancellor shall hold office for a period of
three years and shall be eligible to be appointed for a second term
but thereafter he or she shall not be eligible to hold office of the
Vice-Chancellor:
Provided that-
(a) the Chancellor may, by order, direct that a Vice- Chancellor, whose term of office has expired,
shall continue in office for such period, not
exceeding a total period of one year, as may be
specified in the order; and
(b) the Vice-Chancellor may, by writing under his or her hand addressed to the Chancellor and
after giving one month notice, resign his or her
office:
Provided further that a person appointed as Vice-
Chancellor shall retire from his or her office if, during the term of
his or her office or any extension thereof, he or she completes the
age of sixty five years.
