Wlrereas it is expediemt to establish and constitute a teachingand affiliating Cultural University in the world's largest river island Majuli in the Starc of Assm.
It is hcreby enacted in the Sixty-eigbth Year ofthe Re,public of India as follo\rs;-
(1) This Act may be called the Majuli University of Culnre Act' aofi.

PRELIMINARY
ln this Act, unless ttre context othcnrise rcquires,-
(a) '*Acadwric council" means the Acadenric council ofthc University;
(b) *Affiliatod lnstitgtion" mcans a College oran Institution affitiatcdto the University and inchrdcs a college or an institution desned to be an affitiated college of in$titution under this Act;
(c) "Board" tn€an$ thc Board of Management of the Univsrsity;
(d) "Board of Studics" moans the Board of Studies of the University;
(e) "Clancellor" m&ans the Cha.ncellor of the tJniversity; ifi ..College,' mr/nsan Institution admitted tothe Univcrsify in accordanco with thc provisions of fhis Act and the Statutes and includcs a College managed by the University;
G) ..Consti&rent Cdlbge" meaor a Ccllege established, managed, maintsined snd controlled by thc university slld includesa Collegc ot an institution deemed to be a eonstitueat college of the Universify;

(1) The Chancellor, the fust Vice-Chanceltor, Memebers of the Board and the Academic Council and all psrsons, who may hereafter become such Chanoallor, Officers and Menrbers so long as &ey oontinuc to hold zuch office or membership shall constitutea body corporatc, by the name of the tvlajuli University of Culture and such body corporate shall have pe,lpetual succession anda corlrrron s€el and may sue and be sucd by that nams. Ttre headquartErs of the University shall be located in Majuli Disfrist of Assam.
$ubject to the provisions of this Act ard the Statutes,the Univensity shall be compot€ot to acquire and hold property both movable and immovablo, to lease, sell or othsrwise Eansferany movable or immovable property, which may have become vestod in" or may have becn ocquired by it for the purposes of the University and to coatrflct and do all other things necessary for the purpose ofthis Act.
4. The Univcruity skell have following objects:-
(i) to promote education, rescarch and faining in various sphcres of

Provided tirat tAe University may, in consultation withthe Governnrent, I€scrye Seats for the membsrs of the Backn'ard Clals of Citizms or Schedulcd Castes or Schcduled Tribes or women or aoy otler category of persons for the prypose of admission as studcnts to any of the constitucnt colloges orthe institutions of the University of affiliated collegesand irstifirtiors.

CHAPTER.III
T}IE CHANCELLORA}.ID OFFICERS OF THE UNTVERSITY

The Chancellor shall exeroise the powers of overall supervisioa ovrrthc University and take requisite $teps to de.rc[op it as cen$e of excpllcnce in creativity, reeearch aad leanring. Thc Chsnoellor man cither szo moto or on a refersrcc made to him by the Vice-Chancellor under tbe provision of sub'section
(8) of *mtion 10 or by the Sane Government, by order in writing, annut any prcccedingS of any of the authorities of the University u&icb is not ia conhrmity with this Act, thc Statutes,the Regulations, the Rulcs, or any other lsrv for the tirne being in force:
Pmvidd &at bcfore making any such order, the Chancellor shail call upon nrch autlrority to show cause as to whyany such ord*rshould not be made and considerthc cause il*y, shown by such auttroriry wi&in a period not cxceeding sixty days at maybe fixed by thc Charsellor.
Tle Ciranccllor shall havc the right to suspend or disnriss aoy of the ruthorities of the univssity and to take mcasures forthe interim administation of the Univcrsity:
PrCIvidd that bafore taking any such actiorr the Chrncellor shall give an opportunity to such authority to show causs &5 to why such an action should nat bc aken.
Every propod, for the confermert of au honorary degree strall be subject to confirmationof thc Chascellor. Ar rypcsl shall lia to ths Chsocellor against any ordcr of dismissal passd by the Board or the Yice-Ctlancellor against any cmployee concerned.

The Chancellor shall have powcr to remove Se Vice-Chailcellor from office by aa order in uniting on chargss of mismanagcment of funds or misconduct or for any other good and sulEcient rsa80n3:
Previded that orders removing the Yice-Chanccllor under this sub-section *all not bc passed until such charges arc proved by an enquiry conductcd by an officor not below the rank of Secptary to the Govarnmer! appointed by the Chancellor for the purposc:

No ptrson who has complcrcd severty yeafil of age shallbe eligible to hold the officc of the Vicc{hancellor' thc Vice-Chanccllor shall hold of,fice fot a terrr of fivt years from the d.sts on u&ichhe enters upoa his office and shallbe eligible for reappoinnncnt for another tcrm till he dtainsthe age of seventy, trihichever is ear{ier, following ttre Poceduro specified in sub.soction(1 ).
The remuneration payable to, and the other conditions of service of the Vice€hancellor shall be determfurcd by the Chancellor:
Providd tbat the crnolurnen8 and other conditioos ofthe service shall not be vuicd to thc disadvantage of the Vicc' Clrancellor during his tsnure as Vicc4hancellor. The Vics-Chsnccllor *rall be thc principal of scademicsand exccutive officer of thc University and all ottrer officsr$ ofthe Universiry shsll be subject to general rupelvision and control of the Yice-Clrancellor.
The Vice Ctrancellor shall be the Chsirnsn ofthe Board and the Acadcmic Council,and shall be entitled to be prcscmt at and ta address any meeting of any autho,rity of the University, but shall not be entitted to rrote, &ereat, ualsss he is a rnembcr of the authority ooncerned.
It shatl be the duty ofthe Vice-Chanccllor to ensure thatthe provisions of this Act, the StatuEs, Regulations and Rulcs are obscrved and hc shall have all the pow€rs neccssary for this ptrrpose.

(6) Subject to the provisions of this Act and ttrc $tatutcs, thc Vice- Chffccllor strall have {re power,
(a) to rirake ap,pointmcnt to posts of non-teaching employccs or to such posts as may be prescribed and speciff their dutics;
(b) to suspend, dismiss or othetwise pwrish any non-teaching employoc ofthe University; and
(c) to take disciplinary action against shrdents ofthe University
{7> The Yice-Chancellor shall have the power to convere mcctings of the Board or the Academic Council or any other authority of the University.
(S) It shall be the duty of tho Vice-Chancellor to cnsr&o that thp prcccedings of thc Univsffiity are carried on in accordance with the providons of *ris Act, the Stahrtes, the Rcgulations and the nrles made thers under. If the Vics-Chancellor is of opinion that ary proceedings sr order of an authority of the Universityis violativc of any of ttrc provisions af thi* Act or the Statutes, Regul*ions or Rules made there under, he may by an ardcr in lrniting, stay &e opcration of such proceedings or ordersaad send a rsport and m*ke a reference to thc Chancellor for a final decision in accordancc with the provisions of sub-section (a) of section ?,
(9) The Vic*-Chanccllor shall exercisc such other powers and perform such oths flmctions a$ may be prescribed by ttre Statutcs and the Regulations

Statutes.
The Regisftr shall be rcsponsible for,-
(a) the orstody of the recods and the common seal ofthc University;
(b) a permanent rccord of the academic pedormance of smdents of thc University includingthe cours&s takcn, grades obtained, degrees awarde{ prizes or othcr distinctloru won and any othcr items pe*aining to thc acfldomio performance of the students;
(c) cxecuting all contacts on betralf ofthe Universitfi afld
(d) acting as ths Sccrstry of the arfhoritics of thc University. The Rsgistar shs.ll cxcrcise $uch othu powers and porfonn such othcr duties as are impoeed on him by the Statutes. Suits and other legal proceedings by or against the Uniraersity shall be institrscd by or against the Registrar. The Board shall appoiat a person selectcd ftom among a panel oontaining the namss of officers belonging to thc Assam fiaance Service, Class-I ffrnished by the Governmcnt or from any other sourcc as mey be provided in thc Statutes, as the Financc and Accounts Officer of the University for such periods and on zuch terms as rnay beprescribed by the Statutcs.

(a) act as the Treasurer of the University and be responsible for the propr investnent of the funds and managements of the assets of the University;
(b) exersfu€ gencral supe*ision over operation of all funds;
(c) tcndsr advice with regard to financial nansactioas of thc University;
(d) prcsent annual financial cstirnates and statc,lnent of accounts;
(e) cnsurc utilization of the allocations for the programmed schenres and projects of the University;
(f) scn*inize the stateinent of accounts of tbe constislent collcgcs or othsr institutions mairtained by the University and submit rtport thereon to the Vice-Chancellor and the Board;
(g) rcceiye all coutributions, grants, bcquests, endowments and intcrests on investrrcnb on behalf ofthe University; (hi collect fees, fines, sale proceeds and other amounts of casrral insome accruablo to the University;
(i) opcrate schsmos relating to scholarship funds, stipends and fcllowship amounts;

The first Statutcs of the Univasity shall be made bytbe Govenrment by notification in the Official Ga"f,ttc and shall continue to bo in forcc rmtil amendcd or supersedcd by Statutes made by the Board in accordance with the pmvisions of this scction.
The Board rusy, &om time to timc, make new or additional Stahrtcs or may amend or repeal the Statgtes in the mannor hereinaftsr provided.
No Stahrtegatrccting the powersor duties of any authotity ofth1 University shall bc *aatby the Board unless the draft ofsuch Stahrtes is refen€d by ttre Vice-Cfiancellor to such authority concerned for expressing its views tlrereon within such period as msy bc specifiedin the refer€,lrc€ or within such further period as the-Vioe{hancellor rnay allow and views, if any, so expressed are duly considsred.
Every
-statute
passed by the Board shall be submitted to the
Governmerrt, who may give or wittrhold its 4pproval thersto or refer it back to the board for reconsideration withsuch observations as itmay deem fit.
No Statutes passed by thc Board shall be valid until approved by the Govemment and it shall come into force on the date of iX publiodion in the Offrcial Gaeette or such other dates that the Govemment may fix.
The Asademic Corrncil ma5 subject to the approval of the Bomd, make regulations consist€nt with this Act and the Statutes' The rcgutations may provide for the cxercise of all or aoy of the powers and frmctions cnumerated iu clause (ii) of section l8 of this Act.
Every Regulation shall come into force on the date ofits pubtication in the Officiat Gazette or on such other prospcctive dateas the Board may direct
The Acadcmic Council, Faculties and the Board of Studies of the University may, subject to the approval of the Board, make des consist€nt with &is Act and the Statutes and the Regulations rnade thcreunder.
The nrle may provide for,-
(a) the giving of notices to the mcrnbers of each authority,the dates of mrctings and the business to be transacted at such mectiugs and also for keeping a record of thc proceedings of rnectings.
(b) the procedure to be followed at the mcctings and number of membors required to form the quorum for the mectiags.
(o) all matters solcly concerning such authority or the matters not provided for by this Act, the Statutes or the Regrrlations made under this Act.
The Board may refusc to approve the rules submittcd to it or may return them to the authority concerned for furthcr consideration or may approve the rules wi&out modification or subject to such modification as the Board may decrn fit.

39 AII acts and ordem done or passcd in good faith by the University, any of its authorities, bodies or officers shall bc final and accoilingly no suit or legal proceedings shall be instituted against, * A"*rg. claimcd from the University or its au&orities, tr6dies or officers for anything done or purporting to be done or aay order passed in good faith in pursuance of this Act,the Statutes, Regulations and rules made there undcr. If any qgestion arises regarding the intcrpretation ofany provision of this Act or any Statutcs or as to whether a person has i*ot A,*V appoinrcd or nominated or is entitled to be a member of nny auttrb*ty or body of the University, ttrc matlor shallbe rcferred tothe Chancellor.
Thc Chancellor shall aftcr taking such advice as he maydeem nccessary decide the question and his decision thcreon shallbe Iinal.
The Government shatl have the right to causc inspection, to be made by such persoq or psrsons as they may direct, ofthe University, its buildings, libraries, museulns, workshopsand equipmcnt ot any institrrtion maintained, afiiliated to or approved by th" University, and to cause enquiry to be made ia respect of any matter connected withthe University.
The Government shall, before taking any action undcrsub- section(l), give notice to the University ofttreir intentionto cause such inspection or cnquiry to be made and the University shallbe entitled to be represented thereaL
The Government shrll communisate to the Board the rcsult of any inspoction or inquiry made under sub-s€ction (l) andmay, after ascertaining the opinion of the Board thereon, oonvey their vicws to the Vice-Chancellor aod to the Board. The Governmcnt may, after considering views of theVice Chanoellor and the Board on the result of any inspectionor inquiry made under sub-section (l) advise the Universityupon the action to be taken in the matter.
The Board shall report to the Government the action, if any, which is proposed to bc taken or has boeo taken upon the resuit of any inspection or inquiry made under sub-section (1). A .report under sub-section (5) shall be submitted tothe Govemment wi& the opinion of the Board thereon and within such time as lhe Government may direct,
Where the Board does not, within a reasonable time, takeany action referred to in sub-section (a) to the satisfaction ofthe Governmerrt, the Government rnay after consideringany explanation furnished by the Board in the matter, issue such dircctions as it may think fit, and thc Board shall comply with such directions.

With the prior approval of the Government, the Universitymay make *ppropnute provisions for thc benefit of its officers, teachers and other-cmployees under its control in mattcrs of lrnsion, insurancc and provident firnd and for such othcr bcnefits as it may dcem fit, in such manncr .N may be prescribed by the Statutes.
If any difliculty arises as to the first constitution of any Authority of the University or otherwise in first giving effect tothe provisions of thii Act after the comrnencement of this Act,the Smrc Oovcmment may) by order, take suoh appropriate nece$sary astiorL which appasrs to it to be necessary for ttre puqpose of rcmoving the difficulties.
