An Act to amend the Madhya Pradesh Zila Yojana Samiti Adhiniyam, 1995.

Be it enacted by the Madhya Pradesh Legislature in the Fiftieth Year of the Republic of India as follows :-

1. This . Act may be called the Madhya Pradesh Zila Yojana Sarni ti (Sanshodhan) Adhiniyam. I 999.

Amendment of 2. For the existing long title of the Madhya Pradesh Zila Yojana Samiti Adhiniyarn, tong title. 1995 (No. 19 of 1995) "1ereinafter referred to as the Principal Act), the following long title

shall be substituted, namely :-

Pradesh Gazelle (Extra-ordinary)" dated the 4th January 2000.] An Att further to amend the Madhya Pradesh Zila Yojana Samiti Adhiniyam, 1995. BE it enacted by the Madhya Pradesh Legislature in the Fiftieth Year of the Republic of India

as follows :-•

Short '-rttle.,..aad_ I. (I) This Act may be called the Madhya Pradesh ZiJa_yojana ·samiti (Dwitiya-sansnodhan)

oL ___.2....ln-Seetiorrhf,nrnaclhya Pr~ Zi1a Yojana Samiti Adhiniyam, 1995 (No. 19 of 1995) (hereinafter referred to as the Principal Act), for clause (b), the following clause shall be

substituted. namely :-

Amendment of Section 3.

Substitution of new Section ror Se-ctior.4. Composition of Committees.

"(b) "District' means a district as construed in the Madhya Pradesh Land Revenue Code, 1959 (No. 20 6f 1959) and includes one or more such revenue districts, or pans thereof, as are comprised Wi~in the Zila Pa0chayat constituted for the district.". 3. In Section 3 of the Principal Act,-

(i) in sub.section (I), for the words "in each district", the words "for a revenue district or a group of revenue districts -and parts thereof with a common Zila Panchayat" shall be substituted ;

,,, -(ii) after sub-section (2), the following sub-section shall be inserted, namely :-"'(3) Where the term of the existing members of the Municipality/Zita Panchayat has expired and the elected members cease to be members of the committee then the committee with remaining members shall continue to discharge the functions tiil new elections are held.".

4. For Section 4 of the Principal Act, the following section shall be substitured, namely .- ·•4_ (I) The Committee shall consist of JO, 15 or 20 members in different districts, as specified

in the Schedule.

(2) (i) Four-fifths of the total number of members of the .Cominittee shall be elected in the Prescribed manner by and from amongst the elected members of the Zila Panchayat and of the Munic1palities in the district or group of revenue districts. as the case may be.

· . (ii) The nuljlber of members to be elected from the rural and urban areas shail be as nearly as is possible, in proportion to the ratio between th~ population of the rural and urban areas of the district or group of revenue districts. as the case may be.

where the number uf members of the committee. as specified in the sch~dule is-

fifteen one member; or

twenty two members to be. nominated by the State Government:

Provided tha_t the Collector of the district which describes the Zila Pancbayat shall be the Member-Secretal3/- of the Dis trict Planning Committee.

(4) Tj,e members nominated under clause (c) of sub-section (3) shall hold office for such rerm as may be notified by the Slate Governnient. ·

5. A~ction(2) of Section 5 of the PrincipaJ-Act;-the following sub-seclion--Sha!Lhe--Amendment of ted, namely :- · Section S.

"(3) The President of the Zila Panchayat and the Mayor of the Municipal Corporation in the district shall also he permanent special invitees. in case they are not elected Members of the Committee.".

Promulgated by the Governor of Chhattisgarh in the fifty-second yea r of the Republic of India

An Ordinance to amend the Chhattisgarh Zila Yojana Samiti Adhini yam, 1995.

Whereas it is expedient to amend the Chhattisgarh Zila Yojana Sami ti Adhiniyam, 1995;

AND WHEREAS the State Legislature is not in session, and the Govern or of CHA TilSGARH

is satisfied that circumstances exit which render it necessary for him to take immediate action :-

NOW THEREFORE, in exercise of the powers conferred by clause ( I) of Article 213 of the

Constitution of India, the Governor of Chhattisgarh is pleased to promulgate the followin,

ordenance :-

( I) This Ordinance may be called the Chhattisgarh Zila Yojna Sam iti Adhiniyam (Sanshodhan

Adhyadesh, 200 I.

(2) It extends to the whole of Chhattisgarh.

(3) It shall come into force on such dale as the State Govermnrn• m ay, by notification, appoinl fo

different areas.

namely,:-

"An Act to constitute District Planning Committee for the purpose o f Article 243-ZD or th

Constitution of India.

For sub-section (I) of Section 3 of the Principal Act, the followin g sub-section shall t

substituted, namely :-

"( I) There shall be constituted for a revenue district or a group of dis tricts, and parts thereo

having a common Zila Panchayat, a District Planning Committee, to c onsolidate the plans prepar<

by the Panchayats and Municipalities in the district and to prepare a d raft development plan for tt

district as whole.

Section 7-A of the Principal Act shall be omitted.

For the schedule to the Principal Act, the following schedule shall be substituted, namely :-

THE CHHAITISGARH ZILA YOJANA SAMITI (SANSHODHAN)ADHINIYAM, 2015

Au Act further to amend the Chhattisgarh Zlla Yojana Samiti Adhiniyam, 1995

(No. 19ofl995).

Be it enacted by the Chhattisgarh Legislature in the Sixty-sixth Year of the Republic of [ndia. as follows:-

(1) This Act may be called the Chhattisgarh Zila Yojana San1iti (Sanshodhan) Adhiniyam, 2015.

(2) It shall come into force from the date ofits publication in the Official Ga.zette.

For the Schedule appended to the Chhattisgarh Zila Yojna Samiti Adhiniyam, 1995 (No. 19 of 1995), the following shall be substituted, namely:-
