I THE MADHYA PRADESH .MANTRI (VETAN TATHA BHATT.A) ADHINIYAM, 1972. [Received the assent or the Governor on the 14th August 1972; iw.ent first published Jn the I "Madhya Pradesh G~ette", Extraordinary, dated the 22nd August 1972].

1 An Act to provide for the Salaries and Allowances ot the Minbters.

Be it enacted by lhe Madhya Pradesh Leg:islature in the Twenty-lhird Year of lhc Reubhc I of India as follows :-

I I. This Act may be called the Madhya Pradesh Mantri (Vellln T.uha Bhntlll) Adhiniyam, 1972

2. In this Act unless the context otherwise requires, "Ministers" includes "Cluef Minister".

*3. There shall be paid to each Minisier, Minister of State, Deputy Minister nnd Parlinmcnwy Secretary, a salary of one thousand five hundred rupee$ per mensem.

I. *"4. (l} There shall be paid Lo the Chief Minister a Surnptuary Allowance of five thousand rupees per mensem, to each Minister a Sumptuary Allowance of two tho..isand five hundred rupees per mensem, to each Minister of State a Sumputary Allowance of one thousand five hundred rupees per mensem and to each Deputy Minister and Parliamentary Secretary a Sumptunry Allowance of I

five hundred rupees per mensem.

(2) There shall be paid Lo each Minister, Minister of State, Deputy Minister and Parliamentary Secretary a Constituency Allowance of three thousand rupees per mcnsom.

(3) There shall be paid to each Minister, Minister of Swe, Deputy Miru:.ter and Parliamentary Secretary a Daily Allowance of two hundred rupees per day during the term of office.".

5. (1) Each Minister, Minister of State, Deputy Minister and Parliamentary Secretary shall be entitled, without payment of rent, to the use of a furnished residence througho111 his term of office at .Bhopal and for the period of the one month immediately thereafter, and no charge shall fall on the Minister or Minister of State or Deputy Minister or Parliamentary Secrc:t.u-y per:.ouaUy in respect of the maintenance of such residence.

Explanatioo.-For ~c purposes of this Section "residence'' includes lhc staff quarters and other building appurtenant there to and the garden thereof and "maintenance" in relation to a residence includes the payment of local rates and taxes and the provision of electricity and waler.

(2) If a Minister or a Minister of State, or a Deputy Minister or a Parliamentary Secretary, does not avail of the benefit of sub-section (1), he shall, in lieu thereof, be entitled to a house- rent allowance equal to twenty per centum of the salary payable to him under Sccuon 3.

8. A Minister, a Minister of State, a Deputy Mini~tcr, and a Parliamemary Secretary ~hall not,-

(a) during lhe 1enure of his office for wluch he draws salary nnd allowance, pracrice any profession or engage in any trade or undenake for remunera11on any employment other than his duues as Minister, Minister of St.ate, Deputy Minister or Parliamentary Secretary ; and

9. (1) A Minister, a Minister of St.ate, a Deputy Minister, and a Parliamentary Secretary shall in accordance wilh the made rule made in this behalf by the State Government, be entitled to-

, (a) travelling allowance for himself and the members of his family dependent upon

him and for the transport of his and his family's effects-

(i) in respect of the journey to Bhopnl from his usual pince of rei.1dence out of Bhopal for assuming office ; and

(ii) in respect of the journey from Bhopal to usual pince of re:.i<lence out of BHOPAL on relinquishing office; and

(b) travelling and daily nllowances in respect of tours un<lena.kcn by him 10 the discharge of his official duties whether by land, !sea, or wr

(2) Any travelling allowance under th.is secuon may be paid 10 Cll!;h or free offic1.il transport provided in lieu thereof.

(3) In addition to travelling and daily allowances payable in respect of tour~ :.pecified in clause (b) of sub-section (1), a Ministcr, a Minister of Stute, a l:x!puty t.tinu,Ler. and .i Parli.imcm:u-y Secretary shall be entitled, without payment of any charge, 10 accommondauon in and provision of electricity at circuit houses and Rest Houses maintained by the State Government, tor the period of their stay during such tours.

• 9-A. All allowance payable and furnished residence without payment of rent and other prequ1sities admissible to a Minister, a Minister of State, a Deputy Minister, nml o Pdrli.uncnt.iry Secretary under this Act shall be exciusive of Income Tax which shall be payable by the Slate Government at the maximum rate payable by a Minister, a Minister of SWLe, a Dc1 uty Mmi:.ter, or a Pnrliamentary Secretary as the case may be. Out of lhe total amount of im.:omc accruing from the above allowance and perquisnes payable to a Min.ister, a Minister of Stnte, a Deputy Minister, or a Parliamentary Secretary lhe amount of lhe linut of exempLion from Income Tax and standard deduction, what soever as admissible from ume 10 time, shall not be deducted."

10. The date on which any person becomes or cease~ 10 be d Mini~ter, a Mmistcr of State, a Deputy Minister, or a Parliamentary Secretary, shall be noufied ta the Gaz.eue nnd :my such notification shall be conclusive evidence of tbe fact that he became or ceased lo n Minister, a Minister of State, a Deputy Minister, or a Parllamcntary Secretary on that date for all the purposes of this Acc.

II. (I) The State Government mAy, by notification, make rules for carrying out the purposes Po"tr 1o oukr of this AcL. rules.

(2) All rules made under this Act shall be laid on the table of the Legislative Assembly.

12. The provisions of sub-section (3) of Section 9 shnlJ be deemed 10 have come into force on the 21st January, 1957.

An Act to further to amend the Chhatt1sgarh Mantrl (vetan tat ha bhatta) Adhlnlyam, 1972 (No. 25 of 1972.)

Be ir enacted by Chhanisgarh Legislative in the Fifty-fifth year of rhc Republic oflndia as follows :-

This Act may be called the Chhauisgarh Maniri (vctan 1a1ha bhaua) (sanshodhan) Adhiniyam, 2004 (No. 19 of 2004).

(ii) Ir shall extend co the whole of Chhatt1sgarh.

(iii) fr shall come into force from the date of lls publication in the official gazelle.

For Sub-section ( I ) and (2) of Section 4 of the Chha11isgnrh Mantri (v.:t3n latha bhatlll) Adhiniyam, 1972 (No. 25 of 1972) (hereinafter referred lo as the Principal Acl) 1hc following Sub-sections shall be substii\Jled namely :-

(I) There shall be paid to the Chief Minister seven hundred and eighty three rupees per day, 10 Minister seven hundred and sixty seven rupees per day, 10 Minister of State' seven hundred and fi fty rupees per day, to Deputy Mmisrer seven hundred and forty two rupee:1 per day and to parliamentary Secrerary seven hundred and thirty three rupees per day as daily allowances during the term oi their office.

(2) There shall be paid· 10 each Minister, Minisrcr of Srarc, Ouputy Minister and Parliamentary Secretary a constituency allowances of five thousand rupees per mensem.
