the Governor is pleased to order the' publication of the following English translation of the
Uttar Pradesh Sahakari Samiti (Sanshodhan Tatha Vaidhikaran) Adhiniyam, 1976 (Uttar Pra-
desh Ad hiniyam Sankhya 40 of 1976), as passed by the Uttar Pradesh Legislature and assented
to by the Governor on November 20, 1976:

further to amend the Uttar Pradesh Co-operative Societies Act, 1965 and to
provide for matters connected therewith.
IT IS HEREBY enacted in the Twenty-seventh Year of the Republic of India
as follows :—
I. This Act may be called the Uttar Pradesh Co-operative Societies
(Amendment and Validation) Act, 1976.
2: After section 26 of the Uttar Pradesh Co-operative Societies Act, 1965
(hereinafter referred to as the principal Act), the following section shall be
inserted and be deemed to have been inserted with effect from June 25, 1076,
namely :—
"26-A. (1) . Any individual Who is qualified for admission to membership
under the provision of this Act, the rules and the bye-laws

notice to such individual to show cause why he should not be removed

provide for matters connected therewith.
IT 15 HEREBY enacted in the Twenty-seventh Year of the Republic of India -. >
as follows :— I
Shortliilq 1. This Act may be called the Uttar Pradesh Co-operative Societies
(Amendment and Validation) Act. 1976.
Insertion of new 2'. After section 26 of the Uttar Pradesh Cooperative Societies Act, 1965 _

3. In section 29 of the principal Act,—
in sub-section• -(2)7 the proviso shall be omitted and be deemed to
have been omitted with effect from June 25, 1976.

and be deemed to have been substituted with effect from February 16,

"(4) (a) Where, for any reason whatsoever, the election of the
elected members of the Committee of Management has not taken
place or could not take place before expiry of the term of elected
members, the Committee of Management shall, notwithstanding
anything -to the contrary in this Act or the rules, or the bye-laws
of the Society, cease to exist on the expiry of such term.
(b) On or as soon as may be after the expiry of such term, the
Registrar shall appoint an Administrator for the management of
the affairs of the society until the reconstitution of the Committee
of Management in accordance with the provisions of this Act, the
rules and the bye-laws of the society, and the Registrar shall have
power to change the Administrator from time to time:
Provided that so long as no Administrator is appointed under
this sub-section, the Secretary or the Managing Director, as the
case may be, of the society shall be in charge only of the current
duties of the Committee of Management.
Explanation—Where results of the election of members of the
Committee of Management have not been or could- not be declared, for
any reason whatsoever, before the expiry of the term of the elected mem-
bers of the outgoing Committee, it shall be deemed that the election of
the elected members of the Committee has not taken place within the
meaning of this sub-section ;";
for sub-section (6), the following sub-section shall be substituted
and shall be deemed to have been substituted with effect from
February 16, 1976, namely
"(6) The Administrator appointed under sub-section (4) shall
as soon as may be, but not later than the expiry of one year from
the date of commencement of the Uttar Pradesh Co-operative
Societies (Amendment and Validation) kat, 1976 or from
thefl date of his appointment, whichever is later, arrange for the
reconstitution of the Committee of Management in accordance
with this Act, the rules and the bye-laws of the society to take
over the management of the society from him.
Explanation—Notwithstanding that the process of election may
have commenced before the appointment of Administrator under
sub-section (4), a fresh process of election shall be commenced
after such appointment"
sub-section (7) shall be omitted and be deemed to have been
omitted with effect from February 16, 1976.
In section 34 of the principal Act, in sub-section (I), in the second
proviso, for the words "Provided further that" occurring in the beginning,
the words "Provided further that notwithstanding anything contained in the
preceding proviso," shall be substituted and be deemed to have been substituted
with effect from January 17, 1972.
After Chapter XI of the principal Act, the following new Chapter shall
be inserted, and be deemed to have been inserted with effect from August 28,
1976, namely :—
"CHAPTER XI-A
Insured Co-operative Banks
Chapter 'insured co-operative bank' means a co-operative
bank insured under the Deposit Insurance Corporation
Act, 1961; hereinafter in this Chapter referred to as the
said Act.

such co-operative bank, it may require the Registrar to pass an order • -
for supersession of the Committee of Management or other managing •

appoint an administrator therefor for such period or periods not
exceeding five years in the aggregate as may, from time to time, be
specified by the Reserve Bank and the Registrar shall pass an order
accordingly and the remaining provisions of sections 35 and 36 shall.,
apply in relation to such an order as if it were an order made under •
section 35, but the requirements of that section to afford the Corn- '
mittee of Management an opportunity of being heard and to obtain . -
the opinion of the general body of the society shall not be
applicable;

in the event of the Chairman and members of the Committee
of Management of an insured co-operative bank vacating their
respective offices under sub-section (1) or sub-section (2) of section
35-A, the Reserve Bank may require the Registrar to make such':
arrangements as it thinks proper for the management of the affairs •
of such bank and the Registrar shall pass an order accordingly,
and the remaining provisions of section 35-A shall apply in relation •
to such an order as if it were an order made under that section:

co-operative bank or of the supersession of the Committee of
Management or other managing bodies (by whatever name called)':

6. Notwithstanding any judgment, decree or order of any court,—
(1) any order passed or purporting to have been passed before the...
commencement of this Act, by the Registrar under sub-section (4);
of section 29 of the principal Act, shall be deemed to be valid as if the,,
amendments made in the said sub-section by this Act were in force at,
all material times ;
the Registrar may pass any such fresh order in accordance with the -
provisions of the said section 29 as amended by this Act as he may think fit ;, ,
every nomination of Chairman of the Committee of Management
of a Society made or purporting to be made by the State Government under '
section 84 of the principal Act, shall be deemed to be validly made as

from February 16, 1976.
(1) . The Uttar Pradesh Co-operative Societies (Amendment and
Validation) Ordinance, 1976 and the Uttar Prndesh Co-operative Societies
au- (Second Amendment) Ordinance, 1976, are hereby repealed.
(2) Notwithstanding such repeal anything done or any action taken Under
the principal Act as amended by the said Ordinances shall be deemed to
have been done or taken under the corresponding provisions of the principal
Act as amended by this Act as if the provisions of this Act. were in force
at all material times.
