Pr is HEREBY enacted in the Twenty-seventh Year of Republic of India
as follows :
(1) This Act may be called the Uttar Pradesh Legislative Chambers
(Members' Emoluments) (Second Amendment) Act, 1976.
(2) It shall come into force on such date as the State Government may
by notification -appoint in this behalf.
In the Uttar Pradesh Legislative Chambers (Members' Emoluments)
Act, 1952 (hereinafter referred to as the principal Act) , in the long title
for the words "salaries and allowances" the words "salary, allowances and
pension" shall be substituted.

new section 3-A. 7. After section & of the principal Act, the following section shall be
inserted, namely :—
"3-A. (1) With effect from the commencement of the Uttar Pradesh
Pension. Legislative Chambers (Members' Emoluments) (Second
Amendment) Act, 1976, there shall be paid a pension of three hundred
rupees per mensem to every person who has served for a period of five
years whether continuous or not,—
as a member of the Uttar Pradesh Legislative Council ; or
as a member of' the Uttar Pradesh Legislative Assembly; or
partly as a member of the Uttar Pradesh Legislative Council
and partly as a member of the Uttar Pradesh Legislative Assembly
Provided that where any person has served as aforesaid for a
period exceeding five years, there shall be paid to him an additional..
pension of fifty rupees per mensem for every completed year in
excess of five, so, however, that in no case the pension payable to-
such person shall exceed five hundred rupees per mensem .
Provided further that where any person is entitled to a pension
under the Salaries, Allowances and Pension of Members of it
Parliament Act, 1954,—
where the amount of pension admissible under the said if;
Act is Rs.500 per mensem or more he shall not be entitled to anyf.

Explanation—For the purposes of this section, the Uttar Pradeshl*,
Legislative Council or the Uttar Pradesh Legislative Assembly shall
include the United Provinces Legislative Council or the United Provincerr
I Legislative Assembly, respectively, which functioned between August 15;
1947 and the commencement of the Constitution and thereafter as a 4
House of the provisional Legislature for the State. .

Insertion of
new section S-A. 7. After section a of the prlnflpai Act, the followmg section shall be e
inserted, namely :— 5‘
“3A. (1) With eEect from the commencement of the Uttar Pradosh' '-
Pension. Legislative Chambers (Members' Emoluments) (Second_-'
Amendment) Act, 1976, there shall be paid a pension of three hundred
rupees per mensem to every person who has served for a period of five _'
years whether continuous or not,—
(a) as a member of the Uttar Pradesh Legislative Council ; or _
(b) as a member of'the Uttar Pradesh Legislative Assembly; ,01-
(c) partly as a member of the Uttar Pradesh Legislative Council '5
and partly as a member of the Uttar Pradesh Legislative Assembly
Provided that where any person has served as aforesaid {or a',
period exceeding five years, there shall be paid to him an additional»:
pension of fifty rupees per mensem for every completed year in It
excess of live, so, howev , that in no case the pension payable to-
such person shall exceed five hundred rupees per mensem: _
Provided further that where any person is entitled to a pension
under the Salaries, Allowances and Pension of Members of 4,:
Parliament Act, 1954,— g;

(i) where the amount of pension admissible under the saidfj
Act is, Rst500 per mensem or more he shall not be entitled to an '
pension under this section;
(ii) where the amount of pension admissible to him underr
the said Act is less than R5500 per menscm then he shall be.
entitled to a pension under this section only to the exten
of thelamount by which the pension admissible .under that Act
falls short of R5500 per men'sem. ' - ‘7;
Explanation—For the purposes of this section, the Uftar Prades
Legislative Council or the Uttar Pradesh Legislative Assembly shall ,
include the United Provinces Legislative Council or the United Provinces‘
Legislative Assembly, respectively, which functioned between August 15... ,
1947 and the commencement of the Constitution and thereafter as I
House of the provisional Legislature for the State, '
(2) Where any person entitled to pension under sub-section (1),-
(a) is elected to the office of the President or VicePresident or
is appointed to the office of the Goycmor of any State or thei
Administrator of any Union Territory; or
(17) becomes a member of either House of Parliament, or the
Uttar Pradesh Legislative Council or the Uttar Pradesh Legislative
Assembly; or
(r) is employed on a salary under the Central Government 01‘.-_
any State Government. or any Corporation ownedor controlled by.
the Central Government or any State Government or any local", ‘
authority or becomes otherwise entitled to any remuneration from?

Provided that where the salary or remuneration payable to such person
for holding such office or being such member or so employed, or where
remuneration referred in clause (c) payable to such person, is, in either
Case, less than the pension payable to him under sub-section (I), such
person shall be entitled to receive as pension under that sub-section
only an amount which falls short of the amount of pension to which
he is otherwise entiiled under that sub-section.
(3) Where any person entitled to pension under sub-section (1) is
also entitled to any pension from the Central Government (not being
a pension under the Salary, Allowances and Pension of Members of
Parliament Act, 1954 or a pension given in his capacity as freedom
fighter) or any State Government, or any Corporation owned
or controlled by the Central Government, or any State Govern-
ment or any local authority, under any law or otherwise, then—
where the amount of pension to which he is entitled under
such law or otherwise, is equal to or in excess of that to which
he is enitled under sub-section (1) , such person shall not be
entitled to any pension under that sub-section ; and
where the amount of pension to which_ he is entitled under
such law or otherwise, is less than that to which he is entitled under
sub-section (1) , such person shall be entitled to pension under that
sub-section only of an amount which falls short of the amount of
pension to which he is otherwise entitled under that sub-section.
(4) In computing the number of, years, for the purposes of sub-
section (I) , the period during which a person has served as a Minister,
Speaker, Chairman, Deputy Minister, Deputy Speaker, Deputy Chairman
or Parliamentary Secretary, by virtue of his membership in the Uttar
Pradesh Legislative Assembly or the Uttar Pradesh Legislative Council,
shall also be taken into account."
8. In section 5 of the principal Act, in sub-section (2), af er clause (e), Amendment of
the following clauses shall be inserted, namely :— section 5.
' (f) the form in which certificates, if any, shall be furnished by any
person for the purposes of claiming any pension under this Act ;
(g) the manner of payment of pension under this Act."
