AN ACT

further to amend the Uttar Pradesh Nagar Mahapalika Adhiniyam, 1959, the

U. P. Municipalities Act, 1916 and the U. P. Town Areas Act, 1914.

Ii is HEREBY enacted in the Twenty-eighth Year of the Republic of India

as follows :— CHAPTER I Preliminary

I. (1) This Act may be called the Uttar Pradesh Urban Local Self-GoVern- ment Laws (Amendment) Act, 1977.

(2) It shall be deemed to have come into force on April 27, 1977. CHAPTER II

Amendment of the U. P. Nagar Mnhapalika Adhiniyam, 1959

2. In section 6 of the Uttar Pradesh Nagar Mahapalika Adhiniyam, 1959, hereinafter in this chapter referred to as the principal Act—

in sub-section (1), after clause (c), the following clause and

Explanation shall- be inserted, namely

"(d) Paden Sadasyas comprising all members of the Council of States and the State Legislative Council who have their residence in the city.

Explanation— For the purposes of this clause, the place of resi- dence of a member of the Council of States or the State Legislative Council shall be deemed to be the place of his residence mentioned in the notification of his election or nomination, as the case may be."

after sub-section (3), the following sub-sections and Explanation

shall be inserted, namely "(4) If none of the Sabhasads or Vishishta •Sadasyas under this

section belongs to the Safai mazdoor class, the State Government may, by a like notification, nominate one person belonging to the said class as a Sabhasad and thereupon the strength of the Maha- palika shall stand varied to that extent.

(5) If any member of the State Legislative Council representing the Local Authorities constituency does not have his residence in any city, he will be deemed to be Paden Sadasya of such one of the Maha- palikas situated within his constituency, as he may choose.

Explanation—A person shall be deemed to belong to the Safai maz- door class if he belongs to such a class of scavengers by occupation or to such of the Scheduled Castes traditionally following such occupation as may be notified by the State Government."

In section 8-A of the principal Act, in sub-section (2), in the proviso,

for the words "three years", the words "one year" shall be substituted.

CHAPTER III Amendment of the U. P. Municipalities Act, 1916

In section 9 of the U. P. Municipalities Act, 1916, hereinafter in this chapter referred to as the principal Act—

(i) after clause (c) the following clause and Explanation shall be inserted,

namely :— "(d) Ex-officio members comprising all members of the Council

of States and the State Legislative Council who have their residence within the limits of the Municipality.

Explanation—For the purposes of this clause, the place of resi- - deuce of a member of the Council of States or the State Legislative Council shall be deemed to be the place of his residence mentioned ' in the notification of his election or nomination, as the case may

be.";

Municipalities Act, 1916 Amendment of 4. In section 9 of the U P. Municipalities Act, 1916, hereinafter in this sectiou9 ofU. CHAPTER V

Miscellaneous

Notwithstanding the amendment of section 8-A of the Uttar Pradesh Transitory pr. Nagar Mahapalika Adhiniyam, 1959 by section 3, elections for all the Nagar

Mahapalikas shall be held in accordance with the provisions of the said Act by March 31, 1978.

(1) The Uttar Pradesh Urban Local Self-Government Laws (Amend- ment) Ordinance, 1977 is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the principal Acts mentioned in Chapters II,III and IV, as amended by the afore- said Ordinance shall be deemed to have been done or taken under the corres- ponding provisions of the Principal Acts, as amended by this Act, as if the pro- visions of this Act were in force at all material times.
