THE UTTAR PRADESH STATE LEGISLATURE (MEMBERS' EMOLUMENTS
AND PENSION). (AMENDMENT) ACT, 2013
(UP. ACT No. 4 OF 2013)
(As passed by the Uttar Pradesh Legislature)

ACT
further to amend the Uttar Pradesh State Legislature (Members Emoluments
and Pension) Act, • 1980:.
IT IS HEREBY enacted in the Sixty-fourth Year of the Republic of India as
follows :—
.1._(1)_This.Act_may.be called the Uttar Pradesh State Legislature (Members'
Emoluments and Pension) , (Amendment) Act, 2013.
.(2) It shall -come into force on April, 01, 2013.
2. In section 5 of the Uttar Pradesh State Legislature (Members' Emoluments
and Pensicin) Act, 1980, hereinafter referred to as the principal Act,—
(a) in sub-section (1)for the words and figures "and not exceeding two
lakh rupees per annum from June 01, 2008" the words and figures "and not
exceeding two lalch rupees per annum from June 01, 2008 and not exceeding
two lalch fifty thousand rimees per annum from June 01, 2013" shall be
substituted;
in sub-section (2) for the words "fifty thousand rupees" the words
"sixty thousand rupees" shall be substituted;
in the first proviso, in clause (b) for the .words 'eight thousand
rupees" the words "ten thousand rupees" shall be substituted.
3. In section 15 of the principal Act,—
in sub-section (1) for the words "five hundred rupees" the words
"seven hundred fifty rupees" shall be substituted;
in sub-section (2) for the words "two hundred fifty rupees" the
words "four hundred rupees" shall be substituted;
in sub-section (3) for the words "two hundred fifty rupees" the
words "four hundred rupees" Shall be substituted.
4. In section 16 of the principal Act, sub-section (3) shall be omitted. Amendment of

5. In section 24 of the principal Act, in sub-section (1) for the. words "seven Amendment of

thousand rupees" the words "eight thousand rupees" shall be substituted,

. 6. In section 26-A of the principal Act, after sub-section (2) the following Amendment of
sub-section shall be inserted, namely:— • •

"(3) Sub-section (2) shall apply also to a spouse who is alive on the date -
of -commencement of the Uttar 'Pradesh State Legislature (Members! ..
Emoluments and Pension) (Amendment) Act, 2013 of such ex-member as
died before March 05, 2010. Such spouse shall be entitled for family_pension .
with effect frem April 01, 2013."

further to amend the Uttar Pradesh State Legislature (Members' Emolumertts
and Pension) Act-1980-
IT IS HEREBY enacted in the Sixty-fourth Year of the Republic of India as
follows: —

STATEMENT OF OBJECTS AND REASONS
The members of either house of State Legislature, are entitled to get monthly emoluments and
other facilities under the .Uttar Pradesh State Legislature (Members' Emoluments, and Pension) Act, 1980..
.Ex-members are also entitled to get pension and others benefits under the said Act. Spouses of
ex-member
.N;vho died on or after March 05, 2010 are also entitled to get family pension Under the Act.
In view of price rise and increase of responsibilities, it has been decided to revise, the allowances;
• railway coupons and other amenities admissible to, the members of the State Legislature and to increases -
the pension and railway coupons admissible to ex-mem. tiers.
. The spotises of ex-members
who died before March 05, 2010; are not getting benefit, of family
pension. To remove this. discrepancy it has also been decided to provide for giving, the benefil of family
pension to such spouses. •
The Uttar Pradesh State Legislature (Members'. EmoluMents and Pension) (Amendment)
Bill, 2013' is introduced accordingly.

_ .Who died on or after March 05,2010 are also entitled to get family pension under the Act
