IN pursuance of the provisions of clause (3) of Article 348 of the Constitu-
tion of India, the Governor is pleased to order thep ublication of the following
English translation of the Uttar Pradesh SahakariSamiti (Sanshodhan) Adhi.
niyam, 1977 (Uttar Pradesh Acilliniyam Sankhya 17 of 1977), as passed by the
Uttar Pradesh Legislature and assented to by the Governor on October 22, 1977:

AN
ACT
further to amend the Uttar Pradesh Co-operative Societies Act, 1965
IT IS hereby enacted in the Twenty-eighth Year of the. Republic of India as
follows
I. This Act may be called the Uttar Pradesh Co-operative Societies
(Amendment) Act, 1977.
2. In section 20 of the Uttar Pradesh Co-operative Societies Act, 1965,
hereinafter referred to as the principal Act, in the proviso,-
(a) in clause (aa), after the existing Explanation which shall be re-
numbered as, Explanation I, the following explanations shall be inserted,
namely:-
Explanation the case of a transaction between a society and its
member where there is no document evidencing the transaction in which
the due date is specified the expression 'clue date', for the purposes of the
preceding explanation shall mean the date of expiration of six months
from the date of transaction.
Explanation III-A member shall cease to be treated as defaulter if he
pays the sum for non-payment of which such member became defaulter-
in the case of an election, on or before the date fixed under
the rules for deciding objections against the provisional voters' list:
in any other case, before the commencement of the meeting":
(13) in clause (b), /or the words, "appointed according to the bye-laws",
the words "appointed in the prescribed manner" shall be substituted.
Amendment of
3. In section 28 of the principal Act, in the proviso, for the words "the
section 23. bye-laws of the society shall - provide for the final authority vesting in the dele-
gates of such members elected in the manner provided in the bye-laws" the
words "the final authority shall vest in the delegates of such members elected in
the manner prescribed" shall be substituted.
Amendment of 4. In section 29 of the principal Act-
section 29. (a) in sub-section (3) at the end, the following proviso shall be
inserted, namely- "Provided that the State Government may by notification direct that
in respect of such class of Co-operative Societies as may be specified, the
superintendence, direction, control and conduct of elections of the

ACT
further to amend the Uttar Pradesh Cooperative Societies Act, 1965
l u IT IS hereby enacted in the Twenty-eighth Year of the.Republic of India at

Short title. 1. This Act may be called the Uttar Pradesh Cooperative Societies
(Amendment) Act. 1977.
Mme“ a, 2. in section 20 of the Uttar Pradesh (So-operative Societies Act. 1965.

Aaco.ll.1966. (a) in clause (M), after the existing Explanation which shall be re
numbered as, Explanation I, the following explanations shall be inserted,
namely :—
'Explanatian Il—In the case of a transaction between a society and its
member where there is no document evidencing the transaction in which
the due date is specified the expression 'due date'_ for the purposes of the,
preceding explanation shall mean the date of expiration of six months
from the date of transaction.
Explanation III—A member shall cease to be treated as defaulter if he
pays the sum for non-payment of which such member became defaulter—
(i) in the arse of an election, on or before the date fixed under
the rules for deciding objections against the provisronal voters' list;
- (ii) in any other case, before the commencement of the meeting";
(b) in clause (12) , for the words, “appointed according to the bye-laws".
the words “appointed in the prescribed manner" shall be subslttuled.
Amendment at 5. In section 225 of the principal Act, in the proviso. for the words “the
Ni“ 28- bye-laWs of the society shall-provide for the final authority vesting in the dele-
tes of such members elected in the manner provided in the bye-laws" the
words "the final authority shall vest in the delegates of such members elected in
the manner prescribed" shall be substituted.
Amendment of 4. In section 29 of the principal Act—
maroon. ((1) in sub-section (3) at the end, the following proviso shall be
inserted, namely— , '
"Provided that the State Government may by notification direct that
in respect of such class of Cooperative Societies as may be specrfied 91;:
superintendence, direction, control and conduct of elections 0

members and Chairman and Vice-Chairman of the committees of manage-
ment shall vest in the Registrar and such selection may be held other-
wise than in any meeting, notwithstanding anything contained in clause (b)
of section 32.";
(b) in sub-section (6), for the words "one year" the words "eighteen
months,' shall be substituted and the words "or from" the words "or
of one year from" shall be substituted.
5. In section 31 of the principal Act, foi sub-section (1) the following Amendment of
sub-section shall be substituted and deemed to have been substituted on section 31.

(1) 'Except in the case of an apex society there shall be a secretary
of every co-operative society, to be appointed and removable by the
society subject to the provisions of the rules and regulations framed under
sections 121 and 122. The emoluments and other conditions of service
of the Secretary shall be such as may be prescribed in the bye-laws of the
society made in conformity with the rules and regulations made in this
behalf :
Provided that where a service for the post of secretaries common to
any class of co-operative societies has been created under section 122-A,
the recruitment, appointment, removal and other conditions of service
of persons appointed to such posts, including persons appointed to such
posts before the creation of such service, shall be governed by the
provisions of that section and the rules made thereunder.".
6. in section 70 of the principal Act, in sub-section (1), at the end the
following proviso shall be inserted, namely—
"Provided that a dispute relating to an election under the provisions
of this Act or rules made thereunder shall not be referred to the Registrar
until after the declaration of the result of such election".
7. After section 104 of the principal Act, the following section shall be
inserted, namely—
"I04-A. (1) The Registrar may, either before or after the institution

punishable with fine only, then such composition fee shall not exceed
the maximum amount of fine fixed for the offence.
(2) Where the offence is so compounded—
before the institution of the prosecution, the offender shall not
be liable to prosecution for such offence and shall, if in custody be
set at liberty;
after the institution of the Prosecution, the composition shall
amount to aquittal of the accused."
8. For section 122-A of the principal Act, the following section shall he
substituted and deemed to have been substituted on October 3, 1975, namely-
1 92-A. (1) Notwithstanding anything contained in this Act, the State
Government may by rules provide for the creation of

the State Government may think fit, common to such
co-operative societies and prescribe the method of recruitment, appoint-
ment, removal and other conditions of service of persons appointed to
any such service.
(2) When any such service is created, all employees of such societies
existing on the date of creation of such service on the posts included in
such service, shall be deemed to have been provisionally absorbed in the
service with effect from the date of creation of such service :
Provided that any such employee may, by notice in writing to the
prescribed authority within the prescribed period, intimate his option of
not becoming a member of such service, and in that event his services in

ment shall vest in the Registrar and such selection may be held other-
wise than in any meeting, notwithstanding anything contained in clause (b)
of section 321";
(b) in sub-section (6), [or the words "one year" the words “eighteen

of one year from" shall be substituted.
5.1n section 51 oi the principal Act, fov subsection (1) the following
subsection shall be substituted and deemed to have been substituted on
October 3, 1975, namely—
(1) “Except in the case of an apex society there shall be a secretary
of every cooperative society, to be appointed and removable by the
society subject to the provisions of the rules and regulations framed under
sections 121 and 122. The emoluments and other conditions of service
of the Secretary shall be such as may be prescribed in the bye-laws of the
society made in conlormity with the rules and regulations made in this
behalf :
Provided that where a service for the post of secretaries common to
any class of cooperative societies has been created under section l22-A.
the recruitment, appointment, removal and other conditions of service
of persons appointed to such posts, including persons appointed to such
posts before the creation of such service,‘ shall be governed by the
provisions of that section and the rules made thereunder.".
G. In section 70 of the principal Act, in sub-section (1), at the end the
following proviso shall be inserted, namely—
"l’rovided that a dispute relating to an election under the provisions
of this Act or rules made thereunder shall not be referred to the Registrar
until after the declaration of the result of such election".
I. After section 104 of the principal Act, the following section shall be
inserted, namely—
“104-A. (l) The Registrar may, either before or after the institution

and he shall be entitled to compensation from the society which shall be—

(a) in the case of a permanent employee, a sum equivalent to his
salary (including all allowances) for a period of three months or
for the remaining period of his service, whichever is less ;
(6) in the case of a temporary employee, a sum equivalent to his
salary (including all allowances) for a period of one month or for
the remaining period of his service, whichever is less.
(3) An employee provisionally absorbed under sub-section (2) may
be absorbed finally in the service if found suitable after screening in
accordance with the instructions issued by the Registrar; and the
services of any such employee as is not found suitable for absorption in
the service shall stand determined with effect from the date of issue of
orders in that behalf by the prescribed authority and until such autho-
rity is prescribed, by the officer specified by the Registrar in that behalf
in such instructions and he shall be entitled to compensation as laid
down in clause (a) or clause (b) of sub-section (2) according as he was
a permanent or a temporary employee."
9. In section 130 of . the principal Act,— Amendment of
section 130.
(a) in sub-section (1), the words "after previous publication," shall
be omitted;
in sub-section (2) , for clause (xii) the following clauses shall be
substituted, namely—
" (xii) the election of the members and chairman and vice-chair-
man of the Committee of Management of a co-operative society,
including delimitation of constituencies, reservation of seats for
women and members belonging to weaker sections, settlement of
election disputes, and levy of fees in respect of any such matter;
(xiiA) the nomination of women and members belonging to
weaker sections in the committee of management of a co-operative
society ;";
sub-section (3) shall be omitted.
10. In section 131 of the principal Act, in sub-section (1),— Amendment of
section 131.
(i) after the words "inconsistent with the express provisions of this
Act" the words "or the rules made thereunder" shall be inserted;
(ii) after the words "according to the provisions of this Act," the words
"and the rules made thereunder" shall be inserted.
11. For sub-section (1) of section 133 of the principal Act, the following
sub-section shall be substituted, namely—
"(I) The State Government may from time to time, by notification
make such incidental and consequential order as may appear to it to be
necessary or desirable for the removal of any difficulty in any matter
relating to elections under the provisions of this Act or rules made
thereunder."

Amendment of 9. In section 130 ofthe principal Act,—
