The Assam Fiscal Responsibility and Budget Management (Amendment) Act, 2005

AN

ACT

further to amend the A ssam Fiscal R esponsibility and Budget Management

Preamble W hereas it is expedient further to am end the Assam Act

Assam Fiscal Responsibility and Budget M anagement xxvn of Act, 2005 hereinafter referred to as the principal Act, in the manner hereinafter appearing;

It is hereby enacted in the Fifty-sixth Year o f the Republic o f India as follows :-

Short title, extent and commence- ment.

Amendment of section 4.

1. (1) This Act m ay be called the A ssam Fiscal R esp o n sib ility and B udget M an ag em en t (Amendment) Act, 2005

(2) It shall have the like extent as the principal Act.

(3) It shall come into force at once. {

2. In the principal Act, in section 4, in sub-section (3),- (i) in clause (i), for the existing provision, the following shall be substituted, namely :-

"(i) eliminate revenue deficit within four financial years beginning on the first day o f April, 2005 and ending on the 31 st day o f M arch, 2009;" ;

(ii) in clause, (v), for the existing provision, the following

shall be substituted, nam ely :- "(v) reduce fiscal deficit to 3% o f the estimated Gross State Dom estic P roduct w ithin a period o f four financial years beginning in the 1 st day o f April, 2005 and ending on 31 st March, 2009;" ;

Insertion of 3. In the principal Act, after section 12, the following

new section new^ection 12 A shall be inserted, namely

" 12 A. Bar o f jurisdiction o f Civil Court.- No civil court shall have jurisdiction to question the legality of any action taken by, or any decision o f the State Government, underthis Act."
