(1) (1) “Appellate Authority” means an officer appointed Or designated by the State Government by Notifieation; “coaching institute” means a registered institute, established, ran, .szl.ch'm'm‘stIr.=:rr.3<.'1_1:;y~ any person or body of persons, society or regjst"erexd"" institute or Trust to provide preparation for compe-tlfl'tive examination or academic support to students in secondary and higher secondary levels, for more than 20 students, under section 3 of this (iif) (1v) (V) (v1) (v11) न (vii1) (1x) Act; “curriculum” means the curriculum prescribed by All India / State Level Competitive FExaminations / different Roards or Council; “(Jovernment” means the State Government of Manipur; “srescribed” means prescribed by Rules, Regulation and Notifications under this Act; “registered coaching ‘nstitute” means the coaching nstitute registered under this ACE “Registering Authority” means an officer or authority appointed Or authorized by the State Government by ~otification, to perform the functions and discharge the duties of the registering authority under all or any of the provisions of the Act; “registration” means registration made under section 3 of this AcCt] | | | “registration certificate” means registration certificate ~ issued under this Act; (x) (xi) (x11) (x111) (xav) “registration fee” means requisite fee for the registration of cecaching institute; - “registration number’ means the registration number given under this Act by the Registering Authornity; “riles” means the ruies made under section 9 of this Act: “student” means students enrolled in coaching institute . «“yition fees” means the amount taken from the enrolled students for academic suppoit by the regist"er.ed c'oac?hm-"g institute, namely- admission Tfees, course fees, examination fee etc. =§ 4 %-B
REGISTRATION . OF CHAPTER -2 COACHING INSTITUTE / SYLLABUS PRESCRIBED BY COACHING INSTITUTE/ COMPETITIVE EXAMINATION |/ ACADEMIC SUPPORT / ADMISSION FEES / REGISTRATION FEES (2) After the commencement of this Act, no coaching institute without obtaining valid . उ support tor . preparation of 3) (4) (1) The coaching institutes already conducting coaching shall have to be registered within one month from the enactment of this Act shall be estabhished or nan registration certificate. . The tenure of registration shall be for three 'years. After the commencement of this Act, any person who desires to establish or run codehing institute sh]alll have to apply before the Registering Authority along with such fee as may be prescribed in the following manner — B (d) Determination® of curreculum — different kinds of academic support and duration for | (b) () completion ofcurriculum shall be clarified.. Academic qualification of teachers — The teaching shall be performed by non-government teachers or retired - teachers having at least graduation qualification and the bio-data of the teachers, their academic qualifi-clafion and ,expezn".e-nce. shall be. mentioned | Tuition fees — (1) The coaching mstitute shall have to issue a prospectus, mentioning different curmiculum and duration of completion of curriculum along with the tuition fees | (2) Under the curriculum, it shall be mandatory to mention the prospectus the number .of lectures tutoral, group discussions etc न Physical Infrastructure — (1) Within the basic structure of the coaching institute, minmimum one sq. meter area should be for each student (2) Other facilities — Under this, the following facilities shall be made. available by every coaching mstitute:- | (1) Sufficient furniture (bench/ desk etc.); (i1) Sufficient lighting arrangement (electrification); । established and Establish- ment/ registration . of coaching, imstitute for: the ac ademic - curriculum Curriculum. for! | and different competitive examinations.

In case of rejection of application submitted for registration certificate, copy of the order with reasons to that effect shall be given to the applicant. CHAPTER - 3 न PENALTY Penalty. 6. (1) The Registering Authorty shall have such power which ‘s vested in the civil courts under Civil Procedure Code 1908 (entral Act - for consideration of any suit namely:- No.5 of 1908 (i) to accept evidence with proof through affidavit; | (i) to summon and to enforce aftendance of any person, and his examination on oath; ' (ii1) to emforce production of records; and (iv) to award cost. (2) In case of viola’ti_on of any pr-ov'i"s'_ion of this Act or the rules and notification issued under this Act, the coaching nstitute shall be liable to penalty as follows:- 5 (i) Rupees twenty five thousand for the first offence. (i) Rupees one lakh <hall be for the second लिए की, (111) In case of proot of allegations against the coaching o otitute after the second offence, the registration shall be cancelled by the Registering Authority, after show-cause and oiving sufficient opportunity of being heard.
CHAPTER — 4 | APPELLATE AUTHORITY AND DISPOSAL OF COMPLAINTS o 7. The complaints under this Act shall be filed before the Disposal of Registering Autherity. Such complaints shall be disposed of complaints. within _t.hirty_ days from the date of its receipt by the Registering Authority after making the necessary inquiry: Provided that the Registering Authority may impose such penalty or cancel the registration, as the case may be, as provided under this Act. 8. In case, a coaching institute is aggrieved against any orders Appellate under Section 4, 5, 6 and 7, such institute may file appeal Authority, before the Appellate Authority within thirty days against such order. The Appellate Authority shall dispose of the appeal within forty five days of filing of appeal. The decision of the Appellate Aunthority shail be final. CHAPTER — 5 MISCELLANEDUS 9.
