pleased to order the publication of the following English translation of the Uttar Pradesh Rajya Vidhan Mandal

further to amend the Uttar Pradesh State Legislature (Members' Emolument's
and Pension) Act, 1980.
IT IS HEREBY enacted in the Sixty- sixth Year of the Republic of India as
follows:-

I .•(1) This Act may be called the Uttar Pradesh State Legislature (Members'
Emoluments and Pension) (Amendment) Act, 2015.
(2) It shall come into force on April 1,2015.
2. In section 3 of the Uttar Pradesh State Legislature (Members' Emoluments
and.Pension) Act, .1980, hereinafter referred to as the principal Act, in sub-section (1)
for the words "eight thousand rupees" the words "ten thousand rupees" shall be
substituted.
3. In section 4 of the principal Act for the words "twenty two thousand
rupees" the words "thirty thousand rupees" shall be substituted.
4. In section 5 of the principal Act—
for sub-section (1) the following sub-section shall be substituted,
namely :—
"(1) Subject to the provisions of this Act, every member of the
Assembly or:the-Council, whether or not-he holds any office referred to
in clause (i) of section 2, shall be provided, in the manner prescribed
with railway coupons of such value not exceeding three lalch twenty five
thousand rupees per Annum from June 1, 2015 as may be used by such
member for 'himself and for the members of his family for travel by any
railway in any class at any time within or outside Uttar Pradesh in
accordance with such principles as may be prescribed." • .
in sub-section (2) for the words "sixty thousand rupees" the words
"eighty thousand rupees" shall be substituted;.
in the first proviso to sub-section (2),—
(i) in clause (a) for the words "coupons of equal value" the words
"coupons of equal value or reimburse the fare" shall be substituted;

"eighteen thousand rupees" shall be substituted. •
5. In section 15 of the principal Act,— "
(a) in sub-section (1) for the words "seven hundred fifty rupees" the
words "one thousand rupees" shall be substituted;

further to amend the Uttar Pradesh State Legislature (Members' Emolumertts
and Pension) Act, 1980 '
IT IS HEREBY enacted in the Sixty- sixth Year of the Republic of India as
follows: -
l. '(1) This Act may be called the Uttar Pradesh State Legislature (Members

andtPension) Act, .1980,.hereinafter referred to as the principal Act, in sub-section (1)
for the words “eight thousand rupees” the words “ten thousand rupees" shall be

3, In section 4 of the principal Act for the words “twenty two thousand

41 In section 5 of the principal Act—
(a) for sub-section (1) the following sub-section shall be substituted,
namely :— .

his option, may be reimbursed for actual expenses incurred on such medical

8. In section 24 of the principal Act,—

in sub-section (I) for the words "eight thousand rupees" the words
"ten thousand rupees" shall be substituted;
in the proviso for the words "seven hundred rupees" the words
—one thousand rupees" shall be substituted.
9. In section 26-A of the principal Act,—
in sub-section (I) for the words "50% pension otherwise admissible
to the deceased member at the time of death," the words “pension otherwise .
admissible to the deceased member at the time of death or a pension of rupees
ten thousand whichever is greater" shall be substituted;
in sub-section .(2) the ,words and figures "who is entitled to a
pension under sub-section (1) of section .24" shall' be omitted and for the
.figures and words' "50% pension of such ex-member at the time of death or a
. pension of rupees ten thousand whichever is greater" shall be
substituted;
for sub-section (3), the following sub-section shall be substituted,
namely :—
“(3) Sub-section (1) and sub-section (2) shall also apply to a
spouse who is alive on-the date of commencement of the Uttar Pradesh
State Legislature (Members' Emoluments and Pension) (Amendment)
Act. 2015-”

STATEMENT OF OBJECTS AND REASONS
The members' of either house of State Legislature are entitled - to get monthly emoluments and
other facilities under the Uttar Pradesh State Legislature (Members' Emoluments and Pension) Act, 1980.
Ex-members are also entitled-to get-pension and other-benefits under the said Act. Spouses of ex-members
are also entitled to get family pension under the said Act.
In view of price rise and increase of responsibilitias, it has been decided to. revise, pay,
allowances, railway coupons and other amenities admissible to the members of the State Legislature and to
increase pension and railway coupons admissible to ex-members.

(b) in sub-section (2) for the words “four hundred rupees" the words t

The spouses of those ex-members
who expired before the year 1977 are not getting benefit of
family pension. To remove this discrepancy it has also been decided to provide for giving the benefit of
family pension to such spouses. Moreover amounts of pension, additional pension, family pension are
enhanced and a minimum limit of Rs. 10,000/- for family pension is also introduced.
The Uttar Pradesh State Legislature (Members' Emoluments and Pension) (Amendment) Bill,
2015 is introduced accordingly.
