ACT
further to amend the Uttar Pradesh State Legislature (Members Emoluments
and Pension) Act, 1980
IT 1S HEREBY enacted in..the Forty-eighth Year of the Republic of India
as follows:— •
This Act may he called the Uttar Pradesh State Legislature (Members'
Short title
Emoluments and Pension) (Amendment) Act, 1997. • -
In section 4 of the Uttar Pradesh State Legislature (Members' Emoluments
and Pension) Act, 1980, here in after referred to as the principal Ac1 for the
words "two
thousand and .six hundred rupees" the, words "three, thousand rupees" shall be
substituted.
In section 5 of the principal Act,—
(n) for the words "not exceeding sixty-five thousand rupees Per annum" the
words "not exceeding eighty-five thousand rupees per annum from June 1,
1997" shall be substituted;
(b) after the exiting proviso (he' following proviso shall be
inserted,
namely:—
"Provided further that whenever there is an increase in the railway fare of
first class, the State Government may by a notified order make a proportional
increase in the value of railway coupons.".
4. In section 15 of the principal Act,—
in sub-section (I)for the words "one hundred fifty :woos" he words
"two hundred rupees" shall be substituted;
in sub-sections (2) and (3) for the words "one hundred rupees" the words
"one hundred and twenty five rupees" shall be Substituted.
5. After
Chapter 4 of the principal Act, the following Chapter shall be
inserted, namely:—

SECRETARIAL ALLOWANCE
15—A. Every member of the assembly or the council, whether or not
s_ecretaaL he holds any of the office referred to in clause (0 of
allowance section 2 including the leader of op- p-tisition shall be
entitled to receive for the duration of his membership or, as :he case may be,
during the whole of the term in which he holds such office, secretarial
allowance at the rate of two hundred rupees per month,"

IT IS HEREBY enacted in .the Forty-eighth Year of the Republic of India
as follows:— '- - -
I. This Act may he called the Uttar Pradesh State Legislature (Metnbcrs‘
Emoluntents and Pension) (Amendment) Act. 1997. '
2. In section 4 ol' the Uttar l’radesh State Legislature (Members' Emoluments
and Pension) Act, 1980, here in alter referred to as the principal Act, fat the words "two
thousand and six hundred rupees" theuwords “three. thousand rupees“ shall be
substituted.
3. In section 5 of the principal Act,—
(0) for the words “not exceeding sixty-live thousand rupees per annum" the
words “not exceeding cightyd'ive thousand rupees per annum from June I.
l997" shalt be subrti/ulezl;
(b) after the exiting proviso the following proviso shall be interred,
namely:—
“Provided further that whenever there is an increase ill the railway fare of

4. In section 15 ot’ the principal Act,—
(a) in sub-section (”for the words “one hundred fifty rupees" the words

5. After Chapter 4 of the principal Act, the followiiig Chapter shall be

6. In section I7—A of the principal Act for
the words "not exceeding rupees
one lakh" the •North "not exceeding rupees two WI" shall be
substituted.
. 7. For
section 24 of the principal Act, the following section shall be
substituted, namely:—
"24. Every person who has served as a member of the Assembly or
Pension
the Council for any period shall be entitled to a pension at the
to. e rate of one thousand two hundred and fifty
. rupees per tnonth
member throughout his life:
Provided that where any person has served as aforesaid for period
exceeding one year, he shall he entitled to an additional pension at the
rate of one hundred rupees per month for every completed year in excess
of one year."
8. In- section 25 of the principal Act,—
for clause (a),
the following clause shall be substituted,
namely:—
"(a).
where a person is entitled to any pension under the provisions of the
Salaries, Allowances and Pension of Members of Parliament Act. 1954
and such pension is equal to or exceeds theamout of pension admissible
under section 24"
in clauses (b) and (c), for the wocds

9. ln section 26 of the principal Act, for
