the Governor is pleased to order the Publication of the following English translation of the
Uttar Pradesh Rajya Vidhan Mandal (Sadasyon Ki Uplabdhiyan Aur Pension) (Dwitiya
Sanshodhan) Adhiniyam, 1986 (Uttar Pradesh Adhiniyam Sankhya 22 of 1986), as passed by

ACT
further to amend the Uttar Pradesh State Legislature (Members' Emoluments
and Pension) Act, 1980
IT Is nanny enacted in the Thirty-seventh year of the Republic of India
"EIS follows :
(1) This Act may be called the Uttar Pradesh State Legisleture (Memberse Short title and
Emoluments end Pension) (Second Amendment) Act, 1986. commencement
(2) It Shall come into force at once except sections 2,4, 5 and 6 which shall
be deemed to have come into force with effect from April 1, 1986.
In the Uttar Pradesh State Legislature (Membars' Emoluments and
Pension) Act, 1980, hereinafter referied to as the principal Act, in siction 15,—
for • the words "Every member" occurring in the beginning, the
words "Every_member,_whether_or_not_he_holds_any__office referred to
in clause (i) of section 2" shall be substituted, and
after clause (v-b), the following clause skill be inserted, namely:—
"(v-c) The said allowance shall, notwithrtanding anylhing con-
tained in the preceding clauses, be payable in the ca-se of a member
holding any office referred to in clause (i) of section 2 for each day
during the whole of the term in which he holds such office ;"

2. In the Uttar Predesh State Legislature (Membsrs’ Emolumcnts and Amendment of
Pension) Act, 1980, hereinafter refcncd to as the principal Act, in StClion 15,—- section 15 of (LP.

3. After 3ection 17 of the pi incipal Act, the following section shr-11 be in-
serted under a new Chapter V-A , ; namely :—
"CHAPTER V-A
Provision of Loon to .11(embers
17-A. The State'.-Govertnnent may provide for grant of repayable

person who is a member, whether or not he holds any office referred
to in clause ki) of section 2, or who has held office as a member of the

4. In section 24 of the principal Act,—
for the wot ds "five hundred rupees" the words "seven
fifty rupees" shall be substituted ;
in the proviso, for the words "fifty rupees" the words "one hun-
dred rupees" and for the words "seven hundred and fifty rupees" the
words "one thousand five hundred and fifty rupees" shall be substituted.
5. In section 25 of the 'principal Act,—
in clause (a), for the words "seven hundred and fifty rupees" the
'Words "one thousand five hundred and fifty rupees" shall be substineed;.
in clause (b), for the words "seven hundred and fifty rupees" the
words "one thousand five hundred and fifty rupees" shall be substituted;.

6. In section 26 of the principal Act, for the welds "seven hundred and •
fifty rupees", wherever occurring, the v•erds "one thousand five hundred and
fifty rupees" shall be substituted.
7. In section 28 of the principal Act, for sub-section (1), the following •
sub-section shall be substituted and be deemed always to have been substituted,.
namely :—
"(1) Where any Government dues (such as rent or charges for accom-
modation, telephone dues, etc.) are reported to be outstanding against
a member and appropriate claims or bills in support thereof are received
from the concerned authority, ard such member fails to pay such dues,..
an amount equivalent to such dues, or where any repayable advance
has been provided by the Government to a member then an amount
equivalent to such advance or any instalment thereof due from such
member, together with interest, if any, shall be deducted by the Secretary •
from the salary or travelling or daily or compensatory accommodation
or any other allowance bill of such member.
(1-A) In case of a person who has ceased to be a member or a person •
who is not a member at the time when any repayable advance has been
provided to him•by the Government, the amount referred to in sub-
section may be deducted from the amount of pension or any other
amount payable to such person under this Act."
