ACT
further to amend the Uttar Pradesh Public Services (Tribunals) Act, 1976.
Ir IS HEREBY enacted in the Thirty-second Year of the Republic of India
as follows :-
(1) This Act may be called the Uttar PradeSh Public Services
(Tribunals) (Amendment) Act, 1982.
(2) It shall be deemed to have come into force on July 16, 198'1.
In section 4 of the Uttar Pradesh Public Services (Tribunals) Act, 1976,
hereinafter referred to as the principal Act,—
(1) in the existing proviso, between the words "Provided" and "that",
The word "further" shall be inserted; and

Constitution of India,
1T 15 HEREl3Y enacted in the Thirtv-second Year of the Republic of India
as follows :—
Short title and 1.’ (1) This Act may be called the Untar Pradesh Public Services
commencement. (Tribunals) (Amendment) Act, '1982.
(2) It shall be deemed to have come into force on July 16, 1981.
Amendment of 2. In section ‘4 of ’the Uttar Pradesh Public Semices(Tribunals)'Act,1976,
section 4 of UP; '
Act no. 17 of hereinafter referred to as the pnncrpal Act,—
1976.‘ (i) in the existing proviso, between ‘the words “Provided" and “that”,

shall be inserted, namely:
"Provided that no reference shall, subject to the terms of any con-
tract, be made in respect of a claim arising out of the transfer of a
public servant."
.3. Any reference in respect of a claim arising out of the transfer of a
publieservant pending before the Tribunal on the date of the commencement
of this Act shall stand abated and all stay orders or other interim orders,
passed by The - Tribunal in such reference shall stand vacated as if the provi-
- sions of section 4 of the principal Act, as amended by this Act, Have always
been in force.
(1) The Uttar Pradesh Public Services (Tribunals) (Second Amend- Repeal and say-
meat) Ordinance, 1981 is hereby repealed. logs.
of . • ;• (2) Notwithstanding such repeal, but subject to the provisions of this
Act, anything done or any action taken under the principal Act as amended
.by the Ordinance referred to in sub-section (1) or the Uttar Pradesh Public
Servites (Tribunals) (Amendment) Ordinance, 1981 shall be deemed to have
Inee -been done or - taken under the corresponding provisions of the principal Act,
-as amended by this Act, as if the provisions of this Act were in force at all
material dines.
