further to amend the Uttar Pradesh Krishi Utpadan Mandl &mitts (Alpakalik
Vyawastha) Adhiniyam, 1972 and the Uttar Pradesh ,Krishi Utpadan Mandl
Adhiniyam, 1964.
It is hereby enacted in the Twenty-ninth Year of the Republic of India as
follows :—
Short title and
commencement.
Amendment of
section 2 of.U. P.
Act 7 of 1972.
CHAPTER I
Preliminary
1. (1) This Act may be called the Uttar Pradesh Krishi Utpadan Mandl
Laws (Amendment) Act, 1978.
(2) It shall be deemed to have come into force on December 29, 1977.
CHAPTER II
Amendment of the Uttar Pradesh Krishi Utpadan Mandl Samitis (Alpakalik
Vyawastha) Adhiniyam, 1972
2. In section 2 of the Uttar Pradesh Krishi Utpadan Mandl! Samitis
(Alpakalik Vyawastha) Adhiniyam, 1972—
(1) for sub-section (1), the following:sub-section shallibeisubstItuted,
namely:—
(1) with effect from the date of commencement of the Otter
Pradesh Krishi Utpadan Mandl Laws (Amendment) Act, 1978,
the provisions of the Uttar Pradesh Krishi Utpadan Mandi Adhini-
yam, 1964 (hereinafter in this Chapter referred to as the said Adhi-
niyam), shall for a period of one year or until the constitution of an
elected Mandi Samiti under section 13 of the said Adhiniyam, which-
ever is earlier, have effect in relation to every market area existing
on the date of such commencement or declared to be so during
the said period, subject to the following provisions, namely:—
Except as 'provided in clause (e), all powers functions ,
and duties of a Market Committee shall be exercised,
and discharged by an ad hoc committee to be nominated by the
State Government ;
The ad hoc committee referred to in clause (a) shall consist
of seven members one of whom shall be designated as the Chair-
man;
The State Government may at any time replace any member
of the ad hoc committee by making a fresh nomination in his
place;
Subject to the provisions of this section the ad hoc
committee shall be deemed for all purposes to be the Market
Committee;
The ad hoc committee shall not transfer or acquire any
immovable property without prior permission of the Director
of Mandis Uttar Pradesh, Lucknow ;
If there is a difference of opinion amongst the members of
the ad hoc committee the decision of the majority shall prevail;:

The State Government may from time to time by noti-
fication make such incidental and consequential provisions, in-
cluding provisions for adapting, modifying or suspending, in
whole or in part, the operatibn of any provisions of the said
Adhiniyam, but not affecting the substance, as may appear to
it to be necessary or desirable for any of the foregoing or con-
nected purposes;
Until the nomination of ad hoc committee under clauses
(a) and (b), the arrangement in force - immediately before the
commencement of the Uttar Pradesh Krishi Utpadan Mandi
Laws (Amendment) Act, 1978 for the exercise, performance
and discharge of the powers, functions and duties of a market
committee shall continue."
(ii) in sub-section (2), for the word "clause (d)", the word "clause (g)"
shall be substituted..
CHAPTER III
Amendment of the Uttar Pradesh ffrishi Utpadan Mandl Adhiniyam, 1964
In section 2 of the Uttar Pradesh Krishi Utpadan Mandi Adhiniyam,
1964, hereinafter in this Chapter referred to as the principal Act, for clause (x),
the following clause shall be substituted,-andte deemed always to have been
substituted, namely—,
"(x) 'trade-charge' means any charge, by whatevegiame called, which
is realised or may be realised by, or may be payable to, a trader in respect
of any transaction of sale or purchase of any specified agricultural produce
under or purporting to be under any 'custom or usage of trade, or other-
wise;
Explanation—Every deduction other than a deduction made on account
of deviation from sample when the purchase is made by sample, or on
account of deviation from standard when the purchase is made by refe-
rence to a known standard, or on account of difference between actual
and the standard weight or measure shall be deemed as a trade charge".
In Section 9 of the principal Act, after sub-section (2), the following
sub-section shall be inserted, and be deemed always to have been inserted, namely—
"(3) The provisions of sub-sections (1) and (2) shall not-apply in relation
to any specified agricultural produce pledged or hypothecated in favour
of a bank as security for any amount advanced by such bank.
Explanation—For the purposes of This sub-section, the word "bank"
shall have the meaning assigned to it in the Uttar Pradesh Regulation
of Money Lending Act, 1976."
In section 17 of the principal Act; in clause (iii), for sub-clause (b), the
following sub-clause shall be substituted and be deemed to have been substituted
with effect from the 12th day of June, 1973 namely—
"(b) market fee, which shall be payable on transactions of sale of spe-
cified agricultural produce in the market area at such rates, being not less
than one percentum and not more than one and half percentum
of the price of the agricultural produce so sold, as the State Government
may specify by notification, and such fee shall be realised in the following
manner:—
if the produce is sold through a commission agent, the commis-
sion agent may realise the market fee from the purchaser and shall
be liable to pay the same to the Committee;
if the produce is purchased directly by a trader from a producer,
the trader shall be liable to pay the market fee to the Committee;
if the produce is purchased by a trader from another trader,
the trader selling the produce may realise it from the purchaser and
shall be liable to pay the market fee to the Committee ; and
in any other case of sale of such produce, the purchaser
shall be liable to pay the market fee to the Committee."

as if this Act were in force at all material times.
