IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translaticn of the tfitar Pradesh Audyogik Thaaara (Sanshodhan) Adhiniyam, 1978 (Uttar Pradesh Adhiniyam

. Sankhya 34 of 1978), as passed by the Uttar Pradesh Legislature and assented to by the President on October 23, 1978:

THE UTTAR PRADESH INDUSTRIAL DISPUTES (AMENDMENT) ACT, 1978

[U. P. ACT No. 34 oF 1978]

(As passed by the Uttar Pradesh Legislature)

AN ACT

• further to amend the U. P. Industrial Disputes Act, 1947 IT IS HEREBY enacted in the Twenty-ninth Year of Republic of India as

follows :—

I. This Act may be called the Uttar Pradesh Industrial Disputes (Amend- Short title.

2. After section 2 of the U. P. Industrial Disputes Act, 1947, hereinafter referred to as the principal Act, the following section shall be

inserted, namely

"2-A. Where any employer discharges, dismisses, retrenches of other- wise terminates the services of an individual workman any dispute or difference between that workman and his employer connected with or arising out of such dis- charge, dismissal, retrenchment or termination shall be deemed to be an industrial dispute notwithstanding that no other workman nor any union of workmen is a

party to the dispute."

• 3. In section 4-E of the principal Act,—

(a) in sub-section (1), after clause (iii), the following clause shall be inserted, namely --

• "(iii-A) the Labour Commissioner, Uttar Pradesh (b) in sub-section (3), for the words "or the State Judicial Service, or

the State LaboureService" the words “or the Uttar Pradesh Nyayik Sewa or the State Labour Service Or who is not or who has not been such member of the State Civil Service (Executive Branch) as has experience of working for at least three years in the Labour Department of the State" shall be substituted.

4. In section 6 of the principal Act, after sub-section (2), the following sub- Amendment of section shall be inserted, namely . section 6. "(2-A) An award in an industrial dispute relating to the discharge or

dismissal of a worlcman may direct the setting aside of the discharge or dismissal and reinstatement of the workman on such terms and conditions if any, as the atithority making the award may think fit, or granting such other relief to the workman, including the substitution of any lesser punish- ment for discharge or dismissal, as the circumstances of the case may require."

5. In section 6-0 of the principal Act; for sub-section shall be substituted, namely :_....

(l) The State Government may by order in writing for reasons to be recorded withdraw and transfer a preceeding from— ' (i) one Labour Court to another Labour Court or any Tribunal ;

Transitory provision.

(ii) one Tribunal, to another Tribunal or to a Labour Court, if the dispute is within the jurisdiction of the Labour Court, for the disposal of the proceeding and the Labour Court or Tri- bunal to which the proceeding is so transferred may, subject to any special directions in the order of transfer, proceed either de novo or from the stage at which the proceeding was so transferred."

After section 14 of the principal Act, the following section shall 6; inserted, namely :—

"14-A. Any person who commits a breach of any term of any settle- ment or award, which is binding on him under this Act ,

breach of ta Penalty for shall be punishable with imprisonment for a term which

m of award. - may extend to six months, or with fine, or with both,

and where the breach is a continuing one, with further fine which may extend to two hundred rupees for every day during which the breach continues after the conviction for the first; and the court trying the offence, if it fines the offender, may direct that the whole or any part of the fine realised from him shall be paid by way of compensation, to any person who, in its opinion has been injured by such breach."

A reference made under section 10 of the Industrial Disputes Act, 1947, arising out of an industrial dispute referred to in section 2-A of that Act and pending on the date of commencement of this Act shall be deemed to be a reference made under section 4-K of the principal Act, arising out of an indus- trial dispute referred to in section 2-A of the principal Act as inserted by this Act as if the provisions of that section were in force at all material times and any such reference may be withdrawn and transferred under the provisions of the principal Act for disposal by a Labour Court or Tribunal, as the case may b; appointed under, the principal Act.
