English translation of the Societies Registration (Uttar Pradesh Sanshadhan)

AN
ACT
(2) It extends to the whole of Uttar Pradesh.
(3) It shall be deemed to have come into force on February 27, 1978:
In section 3 of the Societies Registration Act, 1860, as amended in its appli-
cation to Uttar Pradesh, hereinafter referred to as the principal Act, in sub-section
(I), after the words "one hundred rupees" the words "or such smaller fee as the
State Government may notify in respect of any class of societies" shall be inserted.
In section 3-A of the principal Act, in sub-section (3), in clause (a), for
-• the words "a fee of ten rupees" the words "a fee equal to the registration fee
payable under section 3 or rupees ten, whichever is less" shall be substituted.
In section 25 of the principal Act, in sub-section (1), the following proViso
shall be inserted, namely:
"Provided that the election of an office bearer shall be set aside where
the prescribed authority is satisfied—
that any corrupt practice has been committed by such: office
bearer; or
that the nomination of any candidate has been improperly
rejected; or
that the result of the election in so far it concerns such office
bearer has been materially affected by the improper acceptance of
any nomination or by the improper reception, refusal or rejection
of any vote or the reception of any vote which is void or by any non-
compliance with the provisions of any rules: of the society.
Explanation 1—A person shall be deemed to have committed a corrupt
practice who, directly or indirectly, by himself or by any other person— •
(i) induces, or attempts to induce, by fraud, intentional misrepresenta-
tion, coercion or threat of injury, any elector to give or to refrain

he, or any person in whom he is interested, will become or will be reit-
dered an objedi Of divine displeasure or spiritual censure ;
canvasses, on grounds of caste, community, sect or religion;
(vi), commits such other practice. as the State , Government may
prescribe to be a corrupt Practice.
ExpkinatiOn .11A 'promise Of individual advantage or profit to a person'
includes a promise for the benefit of the person himself, or of any one in

E4i1anation 111—The State Government may prescribe the procedure
for hearing and decision of doubts or.disputes in respect of such elections and
make provision in respect of any other matter relating to such elections for
which insufficient provision''exists in this Act or in the rules of the
society:"
5. (1) The Societies Registration (Uttar Pradesh Amendment) Ordinance,
1978, is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under
the principal Act, as amended by the said Ordinance, shall te deemed to have
been done or taken- under the corresponding provisions obthe principal Act as
amended by this Act.
