further to amend the Uttar Pradesh Zamindari Abolition and Land Reforms')
Act, 1950 and the Kumaun and Uttarakhand Zamindari Abolition and Land-
Reforms Act, 1960.
IT IS HEREBY enacted in the Twenty-ninth Year of the Republic of Indiat
as follows :—
CHAPTER I
Preliminary
Short title and
1. (1) This Act may be called the Uttar Pradesh Zamindari Abolition;
commencement. Laws (Amendment) Act, 1978.
(2) It shall be deemed to have come into force:on November 30, 1977.g
',CHAPTER II
Amendment of
section 2 of U.!'-
Act no. 1 of 1951.
Amendment of the Uttar Pradesh Zamindari Abolition:and Land Reforms Act, l950 :
2. In section 21of the Uttar PradeskZamindari Abolition [and Land Reforme.
Act, 1950_ •-•10
(i) after sub-section (1), the following sub-section shall be inserted A n d ber.

substituted, namely :—
"(2) Where the declaration made by the State Government under clause(c)k
of sub-section (1) is in respect of any area held on the seventh day Of.4.
July, 1949, for the purposes of a housing scheme by a co-operative society;
registered under the U.P. Co-operative Societies Act, 1965 or a societY;9
registered under the Societies Registration Act, 1860 or a limited
company under the Companies Act, 1956, the State Government may by:A
notification, in public interest, rescind or supersede the declaration ih41
respect of such area as has not actually been utilised in execution of af.'
housing scheme fill the date of the notification whether on account of an)4
default on the part of such society or company Or for any other reasohl:r4
whatsoever.
Explanation—An area shall, for purposes of this sub-section, be deemerM
to have not been actually utilised, in execution of a housing scheme if ono,
the date of the notification under this sub-section:—

at least up to the stage of completion of foundation; and

(1) after sub—section (1), the following sub-section shall be inserted and bei
deemed always to have been inserted, namely: —-im
“(1- A-) The power of the State Government inder s 1b—section (1) t
make exceptiOns or modifications in the provisions of this Act may 11

(ii) for sub-section(2)and the Explanation thereto, the following sub-sectiov
and Explanation shall be substituted and be deemed always to have bee
substituted, namely: —
"(2) Where the declaration made by the State Government under clause(c
of sub-section (1) is in respect of any area held on the seventh day 6111
July, 1949, for the purposes of a housing scheme by a co- Operative societ
registered ’under the U. P. Co-operative Societies Act, 1965 or a societ 1
registered under the Societies Registration Act, 1860 or a limited liabilit .
company under the Companies Act, 1956, the State Government may by ,1
notification, in public interest, rescind or supersede the declaration i'
respect of such area as has not actually been utilised in execution of 111‘
housing scheme till the date of the notification whether on account of anti?
default on the part of such society or company or for any other reaso
whatsoever.
Explanation—An area shall, for purposes of this sub—section, be deem w;
to have not been actually utilised, in execution of a housing scheme if 01115
the date of the notification under this sub— section: — “
(a) in the case of a building site, constructions have not been mad
at least up to the stage of completion of foundation; and
{ b) in any other case, the land is not covered by any road‘or parka”

(3) The area of land in respect of which a notification under sub-section (2)
is issued may be utilised by the State Government for the purposes of
housing and urban development in such manner as may be prescribed."
CHAPTER III
' -.Amendment of the Rumaun and Uttarakhand Zandndari Abolition and Land
Reforms Act, 1960
3. Aft er section 4 of the Kumaun and Uttarakhand Zamindari Abolition and Insertion of new
Land Reforms Act, 1960, hereinafter in this Chapter referred to as the principal section 4-A In
Act, the following section shall be inserted, namely:— u. P. Act
no. XVII of 1960.
"4-A. With effect from January 1, 1978 the rights, title and interest of
every hissedar in respect of forest land shall cease Vesting of into
and shall vest in the State Government free from all rest of Itissedar in
the forest land. encumbrances, and the provisions of this Chapter and
Chapter V shall mutatis mutandis apply to a forest land
1' as they apply to a khaikari land."
In section 6 of the Principal Act,—
in sub-section (1), clause (iv) shall be deemed to have;beemvpmitted
with effect from the first day of January, 1978.
sub-section (2) shall be deemed to have been omitted with effect
from the first day of January, 1978.
5. In section 18 of the principal Act, in sub-section (1), after clause (c) the • Amendment of
following clause shall be inserted, namely:-- section 18.
' "(cc) in the case of a private forest, the average annual income therefrom
. which shall be computed on the basis of the income from such forest for a
period of twenty agricultural years immediately preceding the date of
vesting ;"
- 6. In section 19 of the Principal Act,—
(i) for sub-section (1), the following sub-section shall be substituted,
namely:—
"(1) The compensation payable to a hissedar under section 12 shall
be—
(a) in the case of khaikari land, thirty times of the amount
arrived at after deducting the land revenue, cesses and local rates
payable by such hissedar from the rental income referred
to in sub-section (2) of section 18 ;
(b) in the case of a private forest, eight times of the amount of
average annual income from such forest." :
(ii) in sub-section (3), for clause (d), the following clause shall be
substituted, namely:—
"(d) the rental income and average annual income of the
khaikari land and the private forest under the the/ca;".
' 7. In section 47 of the principal Act after sub-section (2), the following Amendment of
sub-section shall be substituted, namely:— -ection 47.
"(3) The State Government may, by a subsequent notified order,
7 supersede or modify an order issued under sub-section (I) wholly or partly,
and any such supersession or modification may be made retrospectively to
a date not earlier than the date of the order issued under that sub-section."
' • 8. In section 52 of the principal Act, in sub-section (2) the following proviso
Shall be inserted, namely:
"Provided that every such order shall have effect in relation to a forest
land from such date as may be specified by the State Government in this
—behalf".

CHAPTER III

Reform Act, 1960
,. . '3. Aftersection4oftheKumaunand UttarakhandZamindariAbolitionand
. Land Reforms Act, 1960, hereinafter in this Chapter referred to as the principal
”Act, the following section shall be inserted, namely:—
“4-A. With eficot from January 1, 1978 the rights, title and interest of

4. In section 6 of the Principal Act,—

6. In section 19 of the Principal Act,—

arrived at after deducting the land revenue, ceSses and local rates
payable by such hissedur from the rental income referred
to in sub-section (2) of section 18 ;
(b) in the case ofa private forest, eight times oftlie amount of .
average annual income from such forest." ;
(ii) in sub-section (3), for clause (d), the following clause shall be
substituted, namely:—
“(d) the rental income and average annual income of the
khaikari‘ land and the private forest under the theka;”e
, ' 7. In section 47 ofrthe principal Act after sub-section (2), the following
“Subsection shall be substituted, namely:—
“(3) The State Government may, by a subsequent notified order,
-, supersede ormodifyan order issued under sub—section (1) whollyor partly,
and any such supersession or modification may be made retrospectively to
a date not earlier than the date ofthe order issued under that sub-section."
' 8 In section 52 ofthe principal Act, in sub-section (2) thefollowing proviso

CHAPTER IV
Miscellaneous
Validation. 9. Notwithstanding any judgment, decree or order of any court a notifica-
tion made by the State Government discontinuing orDpurporting to discontinue
any exemption from the operation of the Uttar Pradesh Zamindari Abolition ct.s
and Land Reforms Act, 1950 in -respect of an area as had not actually been „11
utilised in execution of a housing scheme before the date of such notification :7.
shall be deemed to be and always to have been made in exercise of powers under
sub-section (2) of section 2 of that• Act as herebyq amended where the area to
which the notification relates was such as had, within the meaning of sub-
section (2) of section 2 of the said Act as amended by Chapter II of this
Act not been actually utilised for execution of a housing scheme till the date
of the notification so made.
Repeal and 10. (1) The Uttar Pradesh Zamindari • Abolition Laws (Amendment) lqa,
saving. Ordinance, 1977 is hereby repealed. eana 'ot
(2) Notwithstanding such repeal, anything done or any action taken under
any of the principal Acts mentioned in Chapters II and III as amended by the
Ordinance referred to in sub-section (I) shall be deemed to have been done or .
taken under the corresponding provisions of the principal Acts as amended by
this Act, as if the provisions of this Act, were in force at all material times.

,10. (1) The 'Uttar Pradesh Zamind'ari ' Abolition Laws (Amendment)
Ordinance, 1977 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under
any of the principal 'Acts mentioned in Chapters 11 and III as amended by the
Ordinance referred to in sub-section (1) shall be deemed to have been done or
taken under the corresponding provisions of the principal Acts as amended by
this Act, as if the provisions of this Act, were in force at all material times.
