CHAP TER I Preliminary

I. (1) This Act may be called the Uttar Pradesh Urban Local Self- 'Poverarnent Laws (Third Amendment) Act, 1978.

' dent in the area of a ward merely by reason of his absence from that :area in connection with the duties as such member.

(iv). Any other factors that may be prescribed shall be taken into consideration for deciding as to what persons may or may not be

is of unsound mind and stands so declared by a competent court ; or

is for the time being disqualified from voting under the pro- 1 visions of any law relating to corrupt practices and other offences in

connection with elections." ‘4.

Amendment of 5. In section 38 of the principal Act, offer sub-section (2), the following section 38. A sub-section shall be inserted, namely:—

"(3) No person shall be entitled to be registered in the electoral 4, roll for any ward, if his name is entered in any electoral roll pertaining to

11 any other city, or to any Municipality, Notified Area, Town Area, Can- tonment or Gaon Sabha unless he shows that his name has been struck:4g off such electoral roll.".

Substitution of sections 39 and 40.

6. For sections 39 and 40 of the principal Act, the following sections shall be substituted, namely

"39. (I) The Nirvachak Registrikaran Adhikari (Electoral Registra- preparation and tion Officer) shall prepare and publish the electoral

publication of roll in the manner prescribed, and upon its publication electoral rolls. it shall, subject to any alteration, addition or modifica- tion made under or in atcordance with this.Act, be the electoral roll for the ward prepared in accordance with this Act.

Where the Nnvachak Registrikaran Adhikari is satisfied, after making such inquiry as he may think fit, whether on an application made to him or on his own motion, that any entry in the electoral roll should be corrected or deleted or that the name of any person entitled to lie registered should be added in the electoral roll, he shall subject to the provisions of this Act and rules and orders made thereunder and such general or special directions, if any, as may be given in this behalf by the Nirvachan Sanchalak (Stbaniya Nikaya), delete or correct or add the entry, as the case may be :

Provided that no such deletion, correction or addition shall be made after the last date for making nomination for an election in the ward and before the completion of that election :E

Provided further that no deletion or correction affecting the interest of any person adversely shall be made without giving him reasonable opportunity of being heard in respect of the action proposed to be taken in relation to him.

An appeal shall lie within such time and in such manner as maybe prescribed, to the District Magistrate, against any order of the Nirvachak Registrikaran Adhikari in regard to inclusion, deletion:set correction of a name in the electoral roil.

40. The Nirvachan Sanchalak (Sthaniya Nikaya) may, if he thinks Revision of it necessary so to do for the purposes of a generalpt

(a) for sub-section (I), the following sub-section shall be substituted, namely :—

"(1) The provisions of sections 125, 126, 127, I27-A, 128, 129, 130, 132, 134, 134-A, 135 and 136 of Chapter III of Part VII of the

Representation of the People Act, 1951 shall have effect as if— the reference therein to an election were a reference to an

election held under this Act ; for the word 'constituency' the word 'ward' had been

substituted; (bb) in section 127-A in sub-section (2) in clause (b), in sub- clause (i), for the words 'the Chief Electoral Officer' the words

'the Nirvachan Sanchalak (Sthaniya Nikaya)' had been substituted ;

(c) in sections 134 and 136 for the words `by or under this Act' the words `by or under the Uttar Pradesh Nagar 'Maha- palika Adhiniyam, 1959' had been substituted." ;

(b) in sub-section (2), after the figures "134" the word, figures and letter "or 134-A" shall be inserted ;

(c) in sub-section (3), after the figures '134" the words, figures and letter "or under section I34-A" shall be inserted.

10. For section 49 of the principal Act, the following section shall be substituted, namely :—

"49. No civil court shall have jurisdiction— to entertain or adjudicate upon the question whether any

In section 61 of the principal Act, in sub-section (1) and in the marginal heading, the words "Nagar Pramukh or" shall be omitted.

In section 177 of the principal Act, in clause (e), after the words "in the same city" the words "and provided further that in the case of a building situated within thirty metres from the main or branch sewer line of the Maha- palika it has a latrine with arrangements for flushing" shall be inserted, on and 'from such date as the State Government may, by notification, appoint in this ;behalf.

In section 472 of the principal Act, in sub-section (1), the following proviso shall be inserted at the end, namely:—

"Provided that any such appeal pending at any stage before the Judg -

e may be transferred by the District Judge for hearing and disposal, to any Additional Judge of the Court of Small Causes or Civil Judge or Addi- tional Civil Judge having jurisdiction in the city."

T.orders made thereunder and such general or special directions, if any, as may be given in this behalf by the Director of Elections (Local Bodies), delete or correct or add the entry, as the case may be :

Provided that no such deletion, con ection or addition shall be made , after the last date for making nomination for an election in the ward and'. before the completion of that election :

Provided further that no deletion or correction affecting the interest of any person adversely shall be made without giving him reasonable Opportunity of being heard in respect of the action proposed to be taken in relation to him.

(2) An appeal shall lie within such time and in such manner as may be , prescribed, to the District Magistrate, against any order Of the Electoral -Registration Officer in regard to inclusion, deletion or correction of a name in the electoral roll.

(a) the date on which the electoral rolls first prepared and subse- quently prepared under this Act shall come into force and their period of operation ;

the correction of any existing entry in the electoral rolls on the--- application of the elector concerned ;

the correction of clerical or printing errors in the electoral rolls;: the inclusion in the electoral rolls of the name of any person—. (i) whose name is included in the Assembly rolls for the area

relatable to the ward but is not included in the electoral roll or the wai d or whose name has been wrongly included in the ele- toral roll of some other ward ; or -

,(ii) ,whose name is not so included in the Assembly rolls and who is otherwise qualified to be registered in the electoral roll or the ward;'-

For section 5-A of the:U. P. To ,vn Areas Act, 1914, hereinafter in this Chapter referred to as the principal Act, the following section shall be substituted,

CHAPTER V

Miscellaneous

Notwithstanding anything contained in section 8-A of the Uttar Pradesh Nagar Mahapalika Adhiniyam, 1959 or any other law for the time being in force, the elections for reconstitution of all Mahapalikas, the powers, functions

, and duties where of stand vested in the administrators on the date of commence- sment of this Act, shall be held in accordance with the provisions of that adhini- yam as amended by this Act, by March 31, 1979.

25. (1) The Uttar Pradesh Urban Local Self-Government Laws (Amend- ment) Ordinance, 1978, is hereby repealed.

(2) Notwithstanding such repeal any thing done or any action taken under ,any of the principal Acts mentioned in Chapters II, III and IV, as amended by the Ordinance referred to in sub-section (I), shall be deemed to have been done or taken under the corresponding provisions of such principal Acts as amended by this Act as if the provisions of this Act, were in force at all material times.
