Jr IS HEREBY enacted in the Twenty-ninth Year of the Republic of India

as follows: (1) This Act may be called the Uttar Pradesh Water Supply

Sewerage (Amendment) Act, 1978, (2) It shall be deemed to have come into force on August 1, 1978.

In section 1 of the Uttar Pradesh Water Supply and Sewerage Act, 197, • hereinafter referred to as the principal Act, for sub-section (3), the following

In section 1 of the Utmr Pr‘adesh Water Supply and Sewerage Act, 1975'! " section 1 ofUl P, hereinafter referred to as the princrpal Act, for sub-section (3), the follonE_, Act “0 43 “1975- sub-section shall be substituted, namely z—— ‘ “(3) It shall be deemed to have come into force on June, 18, 1975-”;

3. In section 4 of the principal Act—

(I) in sub-section (2), in clause (g), for the word "three" the word "five" shall be substituted ;

(ii) for sub-section (4), the fo:lowing sub-section shall be substituted, namely

"(4) Instead of attending a meeting of the Nigam himself, a mem- ber referred to in clause (c) or clause (d) of sub-section (2) may depute an officer not below the rank of Deputy Secretary in his department, a member referred to in clause (e) of that sub-section may depute an officer not below the rank of Deputy Director in his department and a member referred to in clause (f) of that sub-section may depute an officer not below the rank of Joint Director in his department, to attend the meeting. The officer so deputed shall have the right to take part in the proceedings of the meeting and shall also have the right to vote."

4. In section 18 of the principal Act, in sub-section (3), after the words "A Sal Sansthan" the words "not being a Sal Sansthan referred to in sub- section (I) or sub-section (2) of section 20," shall be inserted.

5. For section 19 of the principal Act, the following section shall be substituted, namely :—

"19. The State Government may, by notification, direct that in such rural areas as are specified in the notification, for

Jai Sansthan. which no Jai Sansthan has been established under section 18, all or any of the powers, duties and

functions of a Jal Sansthan under any provisions of this Act shall be exercised, discharged or performed by the Jal Nigam ; and thereupon for the purposes of exercising, discharging or performing such powers, duties or functions the Jal Nigam shall be deemed to be the Sal Sansthan and the date of such notification shall be deemed to be the date of constitu- tion of the Sal Sansthan."

6. For section 20 of the principal Act, the following section shall be subs- tituted, namely:—

"20. (1) A Jai Sansthan constituted to have jurisdiction over the local area of a Nagar Mahapalika shall consist of a Chairman who shall be the Nagar Pramukh of the Nagar Mahaplika (ex-officio), and the following

other members, namely—

a General Manager, to be appointed by the Nigam with the approval of the State Government who shall be a qualified engineer having administrative experience and experience of water supply and sewerage works ;

a Joint Director of Medical and Health Services to be nomi- nated by the Director of Medical and Health Services, Uttar Pradesh ;

three Sabhasads of the Nagar Mahapalika nominated by the State Government ;

two representatives of the Nigam ;

(ef the Director of Local Bodies, Uttar Pradesh ;

(f) the Mukhya Nagar Adhikari of the Nagar Mahapalika.

(2) A Jal Sansthan constituted to have jurisdiction over the local area of a Municipal Board shall consist of a Chairman who shall be the President of the Municipal Board (ex officio), and the following other members, namely:—

an officer subordinate to the District Magistrate nominated by the latter ;

two elected members of the Municipal Board, to be nominated by the State Government.

(3) Any other Jal Sansthan shall consist of a Chairman appointed by the State Government, and the following other members, namely: —

the Collector of the District in which the head office of the Jai Sansthan is situate, ex officio ;

the senior-most officer of the ComMunity Development Department having his headquarter within the area of the Jal' . Sansthan ;

• a General Manager, to be appoined by the Nigam with the

approval of the State Government, who shall .be a qualified engineer having administrative experience and experience of water supply and sewerage works ;

two representatives of the Nigam ;

one nominee of the State Government from amongst the elected heads or members of the local bodies of each district within , the jurisdiction of the Jal Sansthan :

Provided that where the number of districts within the jurisdic- tion of the Jal Sansthan is less than five, the number of such nomi- nees shall be five out of which at least one shall be from each district ;

the Chief Medical Officer of the district in which the head'

Amendment of 7. In section 25 of the principal Act, in sub-section (2), in Clause (vi), thc section 25. following proviso shall be inserted, namely:—

"Provided that no decision to introduce or amend such tariff shall be, taken except by a special resolution in that behalf brought after giving such notice as may be prescribed, and passed by the majority of twot., thirds of the members of the Jal Sansthan."

8. In section 49 of the principal Act—

after sub-section (2), the following sub-section shall In, inserted, namely : —

"(2-A) If at any time the State Government is satisfied that a Jal Sansthan or a beat body has mismanage the water supply or-, sewerage services or both, as the case may be, or . has occasioned F. loss to its property, it may, after giving an opportunity of explana- tion to the . Jal Sansthan or local body, by order, transfer the' , management of water supply or sewerage services of that all Sans- than or local body direct to the Nigam, and such order shall have effect for such period not exceeding three years as may be spec!' fled by the State Government:

in sub-section (2), for the word and figures "August 15, 1976", the word and figures -September 30, 1978" shall be substituted and be deemed always to have been substituted;

sub-section (3) shall be omitted. 10. Where the powers of a Sal Sansthan have been conferred on a Nagar Transitory pro-

Mahapalika under section 19 of the principal Act as it stood before the corn- ViSi011S. mencement of this Act, the Mahapalika shall notwithstanding any amendment in the principal Act, made by this Act, continue to exercise such powers until a Sal Sansthan is constituted to have jurisdiction over the local area of such Nagar Mahapalika under the provisions of the principal Act as amended by this Act.

Repeal and savings.

Amendment of section 99.

,nrdi• it. (1) The Uttar Pradesh Water Supply and Sewerage (Amendment) 4.13°. Ordinance, 1978, is 'hereby repealed. , (2) Notwithstanding such repeal, anything done or any action taken under

the principal Act as amended by the aforesaid Ordinance shall be deemed to have been done or taken under the corresponding provisions of the principal Act, as amended by this Act, as if the provisions of this Act were in force at all material times.
