IT is HEREBY enacted in the Twenty-eighth Year of the republic of India

CHAPTER I
Preliminary
(1) This Act may be called the Uttar Pradesh Homoeopathic Medicine
(Amendment) Act, 1977.
(2) It shall be deemed w have come into force on August 8, 1977.
CHAPTER II
Amendment of the Uttar Pradesh Homoeopathic Medicine Ad,
1951
In section 2 of the Uttar Pradesh Homoeopathic Medicine Act, 1952,
hereinafter in this Chapter referred to as the principal Act, clause (bb) shall
be omitted.
In section 41 of the principal Act, for clauses (1) and (2), the follow-
tng clauses shall be substituted, namely:—
" (I) to recognise homoeopathic educational or instructional institu-
tions for purposes of affiliation and to suspend or withdraw such recog-
nition;
to prescribe courses of study and curriculla for general instruction
or special or refresher courses ire-institutions affiliated to the Board in
such branches of the Medical Science of Homoeopathy as the Board may
think fit;
to hold examinations, and to grant diplomas to persons who shall
have successfully pursued a course of study in the institutions affiliated
to the Board;
(5-A) to exercise general supervision over the residence and disciplinary
arrangements made by the educational institutions affiliated to the Board
and to make arrangements for promoting the health and general welfare
of their students: •

CHAPTER IV
Transitory provisions
11. With effect from the date of commencement of this Act the monies
credited to the Faculty Fund established under sub-section (5) of section 41-A
of the Uttar Pradesh Homoeopathic Medicine Act, 1951, as it stood before its
repeal by section 4, shall stand transferred to the Homoeopathic Fund estab-
lished under section 44 of the said Act.
CHAPTER V
Miscellaneous
12. (1) The Uttar Pradesh Homoeopathic Medicine (Amendment) Ordi-
nance, 1977 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under
the principal Acts as amended by the said Ordinance shall be deemed to have

CHAPTER III
Amendment of the U. P. State Universities Act, 1973
In section 5 of the Uttar Pradesh State Universities Act, 1973, herein- Amendm;n1, of

" (5) Notwithstanding anything contained in sub-section (I) the
homoeopathic educational or instructional institutions throughout Uttar
Pradesh may be affiliated to the University of Agra or the Kanpur
University."

7. In section 55 of the principal Act, in subsection (1) , the second proviso Amendment or

“(5) Notwithstanding anything contained in sub-section (1) the
homoeopathic educational or instructional institutions throughout Uttar
Pradesh may be affiliated to the University of Agra or the Kanpur
University.”

10. After section 7 of the principal Act, the following section shall be section 7-A.

”7~A. Upon being authorised by the State Government by notification

prescribed by the Board of Homoeopathic Medicine constituted
under the said Act , and granting diplomas. and exercise and
perform all the powers and functions of such Board under the said
Act with respect to holding of such examinations and granting of
diplomas."
CHAPTER IV

1]. With effect from the date of commencement of this Act the monies Family Fund w
credited to the Faculty Fund established under sub-section (5) of section 41:A HOmoeopathic
of the Uttar Pradesh Homoeopathic Medicine Act, 1951, as it stood before its Fund-
repeal by section 4, shall stand transferred to the Homoeopathic. Fund estab-

CHAPTER V
Miscellaneous
12. (1) The Uttar Pradesh Homoeopathic Medicine (Amendment) Ordi- 5:572:23 and

(2) Notwithstanding such repeal, anything done or any action taken under
the principal Acts as amended by the said Ordinance shall be deemed. to have
been done or taken under the corresponding provmons of the princrpal Acts
as amended by this Act, as if this Act were in force at all material times.
