rtner to amend the Opium Act, 1878 as applicable to Uttar Pradesh and to
provide for levy of duty of excise on Opium
IT IS HEREBY enacted in the Thirty-third Year of the! Republic of India
as follows :-
1. (1) This Act may be called the Opium (Uttar Pradesh Amendment)
Act, 1982.
It extends to the whole of Uttar Pradesh.
It shall be deemedkto:have come into force on July 1, 1969.
2. After section 5 of the Opium Act, 1878 as amended in its application to Insertion of sec-
Uttar Pradesh, hereinafter referred to as the principal Act, the following Itions 5-A to 5-C
sections shall be inserted, namely:— in -1878Act no. 1 of
"5-A. (1) There shall be levied and paid a duty of excise on opium
produced in Uttar Pradesh at such rates not exceeding
Excise Duty:on two rupees per kilogram as the State Government may
itilDnium. notify from time to time, and different rates may be
notified in respect of different forms of opium.
(2) Until a notification is issued under sub-section (1), the duty of
excise on poppy heads produced in Uttar Pradesh shall be levied and paid
at the following rates, namely:—
On poppy heads exported outside Uttar Pradesh Twenty-five
paise per
Kilogram.
On poppy heads other than those mentioned in Fifty paise
clause (a) per Kilogram.
5-B. (1) There shall be levied and paid countervailing duty on opium
produced outside bit imported into Uttar Pradesh at
Countervailing such rates as the State Government may from time to
duty on opium, time notify, and different rates may be notified in
respect of different forms of such opium:
Provided that the rate of duty notified under this sub-section shall
not exceed-the rate fixed for similar forms of opium produced in
Uttar Pradesh.
(2) Until a notification is issued under sub-section (1), the counter-
vailing duty on poppy heads produced outside but r.noorted into Uttar
Pradesh shall be levied and paid at the rate of fifty paise per kilogram.
5-C. The State Government may, by notification, make rules to

section (1), all duties levied or collected under the rules referred to in the
section shall be deemed to have been validly levied and collected, and a, ingly—

no court or authority shall enforce a decree or crder
