further to amend the Uttar Pradesh Tendu PattaiVyapar Viniyaman) Adhiniyam,

IT Is HEREBY enacted in the Thirty-first Year .of the Republic of India as
follows:-
1. (1'j This Act may be called the Uttar Pradesh Tendulatta (Vyapt r
Viniyaman) (Sanshodhan).Adhiniyam, -1980.

(2) It.:shall;be deemed to have come into force:on:September 28, 1979.
•
2. In section 5 Of the Uttar Pradesh Tendu Patta (Vyapar Viniyaman)
Adhiniyam, 1972, hereinafter referred to as the principal Act, for sub-
section (3), 'the fcillowing sub-section shall be substituted and be deemed
always to have been substituted, namely:—
"(3) A person to whom a permit referred to in clause (b) or clause (c)
or clause (d) of sub-section (2) is granted shall be liable to pay, in the
manner 'prescribed, a tax at the rate of three rupees per standard bag of
tendu leaves."

In section '18 of the principal Act, in sub-section (2), for clause(d), the AtnendRen I
following clause shall be substituted and be deemed. always to have been subs- secu" "
tituted, namely:—
, "(d) the authority by whom, the manner in which, and the conditions
subject to which, permits may be issued under section 5 and the. manner
in which tax under -sub-section (3) of section 5 shall be paid or realised;"
(1) Notwithstanding anything contained in any judgment, decree or Validation.
order .of any court to the contrary, anything done or purporting to have been
done and any action taken or purporting to have been taken (including any order
made, proceedings taken, jurisdiction exercised) under the principal Act, as it
existed immediately before the commencement of this Act, shall be deemed
to be and always to have been done or taken under the principal Act as amended
,by this Act and to be and always to have been as valid and lawfully done
or-- taken as if the-provisions of this Act were in force at all material times.

(2) Without prejudice to the generality of the provisions contained in sub-
section (1), fecs,for permits levied or collected or purported to have been levied
or collected under the principal Act, rules or notifications thereunder shall be
deemed to have been validly levied or collected as tax in accordance with law
under the principal Act as amended by this Act as if the provisions of this
Act were in force At all material times, and accordingly— •
(a) 'no suit or other proceeding shall be maintained or continued in
any court for the refund of any fees paid or purported to have been paid
under the provisions of the principal Act or rules made or notifications
issued thereunder ;
.(b) no court or authority shall enforce a decree or order directing re-
fund of. any fee paid or purported to have been paid Wider the said Act,

Adhyadesh, 1979, is hereby repealed.
(2) NOtwithstanding such repeal—
(a) every application for review Sled under section 5 of the said Adhya-
desh and pending on the date .of publication of this Act in the official
Gazette shall be disposed of in accordance with the said section as if the
provisions of the said Adhyadesh continue to be in force; and
r (6) anything done or any action taken under the provisions of the prin-
