ACT
further to amend the Uttar,Pradesh State Legislature (Members' ,Emoluments and
Pension) Act, 1980 the Utiar Pradesh State Legislature (Officers Salaries and Allowances)
Act, 1952 and the Uttar Pradesh Ministers (Salaries, Allowances and Miscellaneous
Provisions) Act, 1981. •
IT IS HEREBY enacted in the Fifty-fifth Year of the Republic of India as
• follows :—
CHAPTER I
Short title and
commencement
PRELIMINARY
1. (1) This Act may be called the Uttar Pradesh State Legislature Members and
Officers and Ministers Amenities Laws (Amendment) Act, 2004.
(2) It shall come into force with effect from April 1, 2004.
CHAPTER II
AMENDMENT OF THE UTTAR PRADESH STATE LEGISLATURE
(MEMBERS' EMOLUMENTS AND PENSION) ACT, 1980 •
, 2. In section 3 of the Uttar Pradesh State Legislature (Members' Emoluments
and Pension) Act, 1980, hereinafter referred to in this ehapter as the principal Act, in
Sub-section' (1) for
the words "two thousand rupees" the words "three thousand rupees"
shall be substituted.
. - 3. In section 4 of the principal Act, for
the words "five thousand rupees" the
words "seven thousand five huadredrupees" shall be substituted.
4. In section 5 of the principal Act,—
(a)- in sub-section (1) for the words and figures "and not exceeding
eighty eight
rupees per annum from Jane 1, 1998" the words and
figures "not exceeding -eighty-eight theitiSand • rupees per annuli' from
June 1, 1998 and not exceeding one latch twenty thousand rupees per annum
from April 1,2004"; •
(b) in sub.decion.(2),, .

CHAPTER IV
AMENDMENT OF THE UTTAR PRADESH MINISTERS ( SALARIES, ALLOWANCES AND
MISCELLANEOUS PROVISIONS) ACT, 1981
12. In section 3 of the Uttar Pradesh Ministers ( Salaries, Allowances and
Miscellaneous Provisions) Act, 1981,—
in sub-section (1) for the .words "two thousand and five hundred
rupees" the words "five thousand rupees" shall be substituted;
in sub-section (2) for the words "two thousand two hundred and
twenty-five rupees" the words "four thousand rupees" shall be substituted.

STATEMENT OF OBJECTS AND REASONS
In view of price rise and increase of responsibilities, it has been considered expedient in public
interest to revise, the pay, allowances, railway coupons and other amenities admissible to the members,
-officers and Ministers of the State Legislature and to increase the pension and railway coupons admissible
to ex-members. It has therefore,, been decided to amend the Uttar Pradesh State Legislature (Members'
Emoluments and Pension) Act, 1980 and Uttar Pradesh State Legislature (Officers Salaries and Allowances)
Act, 1952 and the Uttar Pradesh Ministers (Salaries, Allowances and Miscellaneous Provisions) Act, 1981
to revise the Salaries and allowances and other amenities of the members and officers and Ministers of the
State Legislature.
The Uttar Pradesh State Legislature Memebers and Officers and Ministers Amenities Laws
(Amendment) Bill 2004 is introduced accordingly.

5. In section 14 of the principal Act, in clause (d), in the second proviso for
the words "two members" the words "five members" shall be substituted.
6.. In section 15 of the principal Act,—
in sub-secion (1)for the words "two hundred fifty rupees" the words
"three hundred rupees" shall be substituted;
in sub-section (2)for the words "two hundred rupees" the words "two
hundred fifty rupees" shall be substituted;
in sub-section (3)for the words "two hundred rupees" the words "two
hundred fifty rupees" shall be substituted.
In section 15-A of the principal Act, for the words "one thousand rupees"
the words "two thousand five hundred rupees" shall be substituted.
In section 18-A'of the principal Act, in clause (a) for the words "one
thousand rupees" the words "two thousand rupees" shall be substituted.
In section 24 of the principal Act,—
(q) in sub-section (1) for the words "one thousand five hundred rupees"
the words "into thousand rupees" shall be substituted;
in the proviso for the words "two hundred rupees" the words "two
hundred fifty rupees" shall be substituted;
after the first proviso the following proviso shall be inserted,
namely:—
"Provided further that in the event of dissolution of Assembly, the period
from the date of dissolution of Assembly, till the date of first meeting of the
new Assembly, shall be counted for pension purposes of a member who has
been the speaker ofthe dissolved Assembly and has continued to be in office as
such during the said period ".
after the aforesaid proviso the following Explanation shall be
inserted, namely:—
"Explanation—Where a person have served as a member of the
Assembly or the Council for a term of six months and above and have not
completed one year then such person shall for the purposes of calculating the
pension, be deemed to have served as a member for one year".

CHAPTER III

AND ALLOWANCES) ACT, 1952 •
In section 2 of the Uttar Pradesh State Legislature (Officers Salaries and
Allowances) Act, 1252, hereinafter in this Chapter referred to as the principal Act, in
sub-section (1) for the words "two thousand and five hundred rupees" the words ,"five
thousand rupees" shall be subslituted
In section 4 of the" principal Act in sub-section (3) for the words "two
thousand and five hundred rupees" the words "five thousand rupees" shalt be substitated.
