The 27th June, 1956 No. 24-Leg/56.—The following Act of- the Legislature of 'the State of Punjab received the assent of the President on 21st June, 1956, and is hereby published for general information :— Punjab Act No. 15 of 1956

THE PUNJAB'PROHIBITION OF COW

SLAUGHTER ACT, 1955

AN

ACT

to prohibit the slaughter of cow and its progeny in Punjab.

BE it enacted by the Legislature of the State of Punjab in the Seventh Year of the Republic of India as follows. :—

£ 1. (/) This Act may be called the Punjab Pro- hibition of Cow Slaughter Act, 1955.

(2) It extends to the whole of the State of Punjab.

(c) which is subjected to experimentation in the interest of medical and public health research by a certified medical practitioner of the Animal Husbandry Department.

• (2) Where it is intended to slaughter a cow for the reasons specified in clause (a) or clause (b) of subsection (/) it shall be incumbent for a person doing so to obtain the prior permission in writing of the Veterinary Officer of the area or such other Officer PL fit of the Animal Husbandry Department as may be 3v4*^!«* ?y prescribed. tstf^AaJLauAMf-t *> **"

5. Except as herein excepted and notwithstand- prohibition .ing anytlung contained in any other law for the time of sale of *being in force, no person shall sell or offer for sale ^beef- or cause to be sold beef or beef-products in any form except for such medicinal purposes as may be pres- cribed.

7. The State Government or the local authority, if so authorised, may levy such fees as may be pres- cribed for care and maintenance of uneconomic cows in the institution.

. 8. (7) Whoever contravenes or attempts to contravene or abets the comravention of the provi- sions of section 3 or_5. sji&l be guilty of an offence punishable with rigorous imprisonment for a term which may extend to^/two veajs or with fine which may extend to one thousand rupees or with both.

(2) Whoever fails to lodge the information in the man^ QazU*^ 4 shall-be-gtiiUy-of-an- offence -punishable with simple imprisonment for a term which may extend to one .ye.ar or with fine which may extend to two hundred rupees or with both.

(3) In any trial for ap^offence punishable under subsection (/),or, subsection\2) the burdern of ^rov- ing that the slaughtered cow'belonged to the class specified in clause (a) or (b) of subsection (/) of section 4 shall be on the accused.

AN .ACT to amend the Punjab Prohibition of Cow Slaughter Act, 1955. BBit enacted by the Legislature of the State of Punjab in the Thirty- second Year of the Republic of India as follows: —

Provided that an application for the grant of a permit shall not be refused unless the applicant has been afforded an opportunity of being heard and the reasons for the refusal are "recorded.

5. After section 9 of the principal Act, the following sections shall be inserted, namely :—

4i 9A. Any police officer not below the rank of Head Constable or any person authorised in this behalf by the

P ° y < g •n^t«r» Government may, with a view to securing seize, etc, . compliance with the provisions of this Act, or for satisfying himself that the provisions of this Act have been complied with,—

(a) enter, stop and search, or authorise any person to enter, stop and search any vehicle used or intended to be used for the export of cows ;

(6) seize or authorise the seizure of "Cows in respect of which he sus- pects that any provision of this Act has b3eu, is being or is about to be contravened, along with the vehicles in which such cows arc found and thereafter take or authorise the taking of all measures necessary for securing the production of the cows * and vehicles so seized, in a court and for their safe custody pending pro- duction ; •^"

(c) the provisions of section 100 of the Code of Criminal Procedure 1973, relating to search and seizure shall, so far as may be, apply to searches and seizures under this section.

9B. No suit, prosecution or other legal proceedings shall lie against any officer of the Government for anything

1. (1) This Act may be called the Punjab Prohibition of Cow Slaughter Short title and (Amendment) Act, 2011. commencement

(2) It shall come into force on and with effect from the date of its publication in the Official Gazette.

2. In the Punjab Prohibition of Cow Slaughter Act, 1955, in Amcndmentof section 8,— ^scction8 of

(i) for sub-section (1), the following sub-section shall be substituted, ^{of 1956} namely:—

"(J) Whoever contravenes or attempts to contravene or abets the constrravention of the provisions of section 4-B shall be punished with regorous imprisonment for a term, which may extend to two years or with fine which may extend to one thousand rupees or with both.
