Preamble Whereas it is expedient further to amend the Assam Assam Acquisition of Land for Flood Control and Prevention
of Erosion Act, 1955, hereinafter called the principal
Act, in the manner hereinafter appearing ;
It is hereby enacted in the Thirteenth Year of the
Republic ol India as follows :—
Short title,
extent and
commence-
ment.
1. (1) This Act may be called the Assam Acquisi- tion of Land for Flood Control and Prevention of Erosion (Amendment) Act, 1962.
(2) It shall have the like extent as the principal Act.
(3) It shall come into force at once. Amendment 2. In section 2 of the principal Act, for clause (2), of Section 2 the following shall be substituted, namely :— of Assam

°f" (2) 'Collector' means the Deputy Commissioner, the Subdivisional Officer in-charge of Subdivision or any other officer empowered under Section 3 to perform the functions of a Collector."
Amendment 3. In section 3 of the principal Act, for the words of Section 3 officer as is empowered in this behalf", the Act VS1Iofwor
ds" the Collector or such other officer as is 1955. empowered to perform the functions of the Collector"
shall be substituted.
Insertion of 4, After section 16 of the principal Act, the Section 17 fo ]]o w jn g shall be inserted as section 17, namely:— in Assam 0 Act VI of
1955.
"Validation. 17. Notwithstanding anything contained in this Act, as originally enacted before the coming into force of the Assam Acquisition of Land for Flood
Control and Prevention of Erosion (Amendment) Act, 1962, any action taken or purported to have been taken by any officer in pursuance of any notification issued under Section 3 of this Act, shall be deemed to hav.e been validly taken, as if this Act had been in force, as amended by the Assam Acquisition of Land for Flood Control and Prevention of Erosion (Amendment) Act, 1962, and as if the officer empowered under the said Section was legally com- petent to act under this Act and shall not be called in question in any Court on the ground of incompe- tency of the officer to act under this Act."
