to provide for certain temporary arrangements for the administration of the
Municipalities, Notified Areas and Town Areas of the State
IT Is HEREBY enacted in the Twenty-eighth Year of the Republic of India
as follows :-
This Act may be called the Uttar Pradesh Municipalities,
Notified Areas and Town Areas (Alpakalik Vyavastha) Adhiniyarn, 1977.
(I) With effect from the 10th day of August, 1977 , the provisions
of the U.P. Municipalities Act, 1916 (hereinafter in this section referred to as the
said Act), shall, for a period of one year or until the reconstitution of the Muni-
cipal Boards under the provisions of the said Act, whichever is earlier, have effect
in relation to each of the Municipalities subject to the following provisions,
namely:—
notwithstanding anything in the said Act, all members of the Muni-
cipal Board including the President shall cease to hold their respective
offices;
all powers, functions and duties of the Municipal Board, its President
and Committees shall be vested in and be exercised, performed and dis-
charged by the District Magistrate, and the District Magistrate [including
the person or authority to whom the District Magistrate delegates his
powers under sub-section (2) of section 4] shall be deemed to be the
Municipal Board, its President or the Committee concerned, as the
occasion may require.
(2) With effect from the 10th day of August, 1977, the provisions of
the said Act shall for a period of one year or until the reconstitution of the

of the U. P. Town Areas Act, 1914, hereinafter in this section referred to as the
said Act shall for a period of one year or until the re-constitution of the Town
Area Committees under the provisions of the said Act whichever is earlier, have
effect in relation to each Town Area subject to the following provisions namely:—
notwithstanding anything- in the said Act, the Chairman and all
members of the Town Area Committee shall cease to hold their respective 4%
offices ;
all powers, functions and duties of the Town Area Committee and
its Chairman shall be vested in and be exercised, performed and dis-
charged by the District Magistrate and the District Magistrate [including
the person or authority to whom the District Magistrate delegates his
powers under sub-section (2) of section 4] shall be deemed to be Town
Area Committee or its Chairman as the occasion may require.
4. (1) The provisions of this Act shall also apply where a Municipal
Board, Notified Area Committee or Town Area Committee had already been
dissolved or superseded under any other provisions of the relevant Act and
such dissolution or supersession was in force immediately before the 10th day
of August, 1977.
Subject to any general or special orders of the State Government,
the District Magistrate may in respect of all or any of the powers conferred on
him by clause (b) of sub-section (1) or clause (b) of sub-section (2) of section 2,
or by clause (b) of section 3 delegate, subject to such conditions as he may think
fit, to impose, the powers so conferred, to any one or more person or authority
to be specified by him in that behalf.
The State Government may from time to time by notification make such
incidental and consequential order for the removal of any difficulty as may appear
to it to be necenry or desirable for any of the foregoing and connected
purposes.
Every hutification issued under sub-section (3) shall, as soon as may
be after it is issued, be laid before each House of the State Legislature while it is
in session, for a total period of not less than thirty days extending in its one sessior
or more than one successive sessions, and shall unless some later date is appointed,
take effect from the date of its publication in the Gazette, subject to such modi-
fications or annulments as the two Houses of the Legislature may during the
said period agree to make so, however, that any such modification or annulment
shall be without prejudice to the validity of anything previously done thereunder.
5. (1) The Uttar Pradesh Municipalities, Notified Areas and Town
Areas (Alpakalik Vyavastha) Adhyadesh, 1977, is hereby repealed.
(2) Notwithstanding such repeal anything done or any action taken
under the said Adhyadesh shall be deemed to have been done or taken under
this Act as if this Act were in force at all material times.

31531135353311:ng of the U P- Town Areas Act 1914, hereinafter in this section referred to as the
Tow“ Areas. said Act shall for a period of one year or until the re-constitution of the Town
Area Committees under the provisions of the said Act whichever is earlier, have
effect in relation to each Town Area subject to the following provisions namely :—~
(a) notwithstanding anything in the said Act, the Chairman and all
mgmbers of the Town Area Committee shall cease to hold their respective
o ices .
(b) all powers, functions and duties of the Town Area Committee and
its Chairman shall be vested in and be exercised, performed and dis-
charged by the District Magistrate and the District Magistrate [including
the person or authority to whom the District Magistrate delegates his
powers under sub-section (2) of section 4] shall be deemed to be Town
Area Committee or its Chairman as the occasion may require.
Additional 41 (1) The provisions of this Act shall also apply where a Municipal
Pm"”'°”5' Board, Notified Area Committee or Town Area Committee had already been
dissolved or superseded under any other provisions of the relevant Act and
such dissolution or supersession was in force immediately before the 10th day
of August, 1977.
(2) Subject to any general or special orders of the State Government,
'the District Magistrate may in respect of all or any of the powers conferred on
him by clause (b) ofsub-section (I) or clause (b) of sub-section (2) of section 2.
or by clause (b) of section 3 delegate, subject to such conditions as he may think
fit, to impose, the powers so conferred, to any one or more person or authority
to be specified by him in that behalf.
(3) The State Government may from time to time by notification make such
incidental and consequential order for the removal of any d1fiieulty as may appear
to it to be neccstary or desirable for any of the foregoing and connected
purposes.
(4) livery notification issued under sub-section (3) shall, as soon as may
be after it is issued, be laid before each House of the State Legislature while it is
in session, for a total period ofnot less than thirty days extending 1n its one session
or more than one successive sessions, and shall unless some later date IS appointed,
take eFfect from the date ofits publication 1n the Gazette. subject to such modi-
fications or annulments as the two Houses of the Legislature may during the
said period agree to make so, however, that any such modification or annulment
shall be without prejudice to the validity ofanything previously done thereunder.
Re?” and 5. (1) The Uttar Pradesh Municipalities, Notified Areas and Town 9“

(2) Notwithstanding such repeal anything done or any action taken
under the said Adhy adesh shall be deemed to have been done or taken under
this Act as if this Act were in force at all mateiial times.
