English translation of the Uttar Pradesh Nagar Swayatta Shasan Vidhi (Dwitiya
Sanshodhan) Adhiniyam, 1978 (Uttar Pradesh Adhiniyam Sanlchya 10 of
1978) as passed by the Uttar Pradesh Legislature and assented to by the Governor
on April 24, 1978.

further to amend the Uttar Pradesh Nagar Mahapalika Adhiniyam, 1959, the UP.
Municipalities Act, 1916, the Uttar Pradesh Water Supply and Sewerage Act,
1975 and the Uttar Pradesh Alias Evani Yikas Par/shad Adhiniyam, 1965.
It is HEREBY enacted in the Twenty-ninth Year of the Republic of India as
follows :—
CHAP TER I
Preliminary
1. (1) This Act may be called the Uttar Pradesh Urban Local Self-Govern
ment Laws (Second Amendment) Act, 1978.

(2) This section and sections 3 and 5, and that part of section 4 which insert
clause (b) in section 108-A of the Uttar Pradesh Nagar Mahapalika Adhiniyain
1959 shall come into force atonce while the rest of this Act shall be deemed te
have come into force on December 1, 1977.
CHAPTER II
Amendment of the Uttar Pradesh Nagar Mahapalika Adhiniyam, 1959
of 2. In section 8-A of the Uttar Pradesh Nagar Mahapalika Adhiniyam, 195
of hereinafter in this Chapter referred to as the principal Act, in sub-section (n:ifi
of clause (a), the words "the Vishistha Sadasyas" shall be omitted.

further to amend the Utlar Pradeslz Nagar Mahapalika Adhiniyam, 1959, the U.P-‘
Municipalities Art, 1916, the Uttar Pradeslv Water Supply and Sewerage Act,’
1975 and the ' Uttar Pradesh Avas Evam Vikas Paris/lad Adl1iniyam, 1965.
It IS HEREBY enacted in the Twenty~ninth Year of the Republic of India as'
follows :—— .
CHAPTER I
Preliminary
1. (1) .This Act may be called the Uttar Pradesh Urban Local Self-Govern-
ment Laws (Second Amendment) Act, 1978.
(2) This section and sections 3 and 5, and that part of section 4 which inset
clause (b)in Section 108-A of the Uttar Pradesh Nagar Mahapalika Adhiniya
1959 shall come into force atonce While the rest of this Act shall be deemed I
have come into force on December 1, 1977.
CHAPTER II
AMendment 0f the Uttar Pradesh Nagar Malzapalika Ad/Iiniydm, 1959
2. In section 8-A of the Uttar Pradesh Nagar Mahapalika Adhiniyam, 195
hereinafter in this Chapter referred to as the principal Act, in sub—section (1
clause (a), the words “the Vishistha Sadasyas" Shall be omitted. ,
3. In section 107 of the principal Act,—
(i)' in Suh-section (2),,farthe words “rupees two hundred”, the
“three hundred and one rupees” shall be substituted;
(ii) in sub-Section (5),far the Words “rupees fifty‘”, the words
hundred and eighty rupees” shall be substituted.

4. After section 108 of the principal Act, the following section shall be Iasetrdonof new
inserted, namely :—
"108-A. Notwithstanding anything in sections 107 and 108,—

(b) the appointment of a teacher or Head of an institution re-
cognised in accordance with the Intermediate Education Act, 1921,
and maintained by a Nagar Mahapalika shall be made in accordance
with the provisions of that Act."
5. In section 110 of the principal Act, for sub-section (1), the following
sub-section shall be substituted, namely:—
"(1) No officer or servant of the Mahapalika shall be dismissed or
removed or otherwise punished by an authority subordinate to that by
which he was appointed :
Provided that in the case of an officer or servant whose appointment
is required to be made in consultation with the State Public Service Com-
mission under section 107, it shall be necessary for the authority
concerned to consult the Commission in the manner prescribed, before
passing an order for the dismissal, removal Or reduction in rank of any
such officer or servant."
6. For section 175 of the principal Act, the following section shall be
substituted, namely
"175. The imposition of a ta; und..r chaise (b ) of sub-section (I)
of section 173 shall be subject to the restriction that the lax shall not be
imposed—.
on any land exclusively for agricultural purposes, unless the
water is supplied by the Mahapalika for such purposes or
on a plot of land or building the! annual alt 1.0..enof does

is supplied by the Mahapalika; or
on any plot or building, no part of which is within the
radius prescribed for the city, from the nearest stand-pipe or other
water-works whereat water is made available to the public by the
Mahapalika.
Explanatioy—For the purposes of this section—.
(a) 'building' shall include the compound, if any, thereof,
and, where there are several buildings in a common compound,
all such buildings and the common compound;
(b) 'a plot of land' means any piece of land held by a single
occupier, or held in common by several co-occupiers, whereof
no one portion is entirely separated from any other portion by
the land of another occupier or of other occupiers or by
public property.'"
7. In section 177 of the principal Act, for clause (e), the 'following clause

.8. In Section 73 of the U. P. Municipalities Act, 1916, hereinafter in this
N-Aapter, referred to as the principal Act, in sub-section (2), the foHowing proviso shattibe inserted, namely
"Provided that the appointment of a teacher or Head of an institution
shall be governed by the provisions of the Uttar Pradesh State Univer-
sities Act, 1973, or the Intermediate Education Act, 1921, as tke case
may be?.

5. In section 110 of the principal Act, for sub-section (1), the following
sub-section shall be substituted, namely;—

In section 62 of the Uttar Pradesh Avas Evam Vikas Parishad Adhi-
niyam, 1965, in sub-section (5), for the words "shall to the extent of any repug-
nancy with the provisions of this section cease to have effect", the words "shall
not apply in relation to any local area in which this Act is in force" shall be
substituted and be deemed always to have been substituted.
CHAPTER VI
Miscellaneous
(1) The Uttar Pradesh Urban Local Self-Government Laws (Second v Amendment) Ordinance, 1977 is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under ° any of the Acts mentioned in Chapters II, III and IV as amended by the
Ordinance referred to in sub-section (1), shall be deemed to have been done or
taken under the corresponding provisions of the aforesaid Acts, as amended
by this Aot, as if this Act were in force at all material times.
9. For
section 129 of the principal Act, the following section shall be substituted, namely :—
"129. The imposition of a tax under clause (x) of sub-section (i)
of section 128 shall be subject to the restriction that the tax shall not be imposed—
® on land exclusively used for agricultural purposes unless water,
is supplied by the board for such purpose; or
on a plot of land or building the annual value whereof, does
not exceed rupees three hundred and sixty, and to which no water a9
