to amend the Prisons Ac t, 189 4 in its application to Assam.* f Whereas i t is ex ped ient to amend the Prisons Act, 1894 (Act IX of
1894), her einafte r referred to as the Pr inc ipa l Ac t, in its app lica tion to ”• Assam in the m ann er here inafter a ppe arin g ;
I t is hereby enacted in the Seve nth Year of the Repub lic of India as follows:—
1. Sh or t ti tl e , ex te nt an d co m m en ce m en t. — (1) This Act may b e called the Pr isons (Assam Am endmen t) Act, 1956.
(2) It extends to the whole of Assam. (3) I t shall come into force at once. 2. A m en dm en t o f S ec tion 46 o f Act IX o f 1894 .— (I) In Section 46 of
the Princi pal Act, clause (12) and the words “or to w hip pin g” appea ring in the proviso to the sa id section shal l be omitted and a full stop shall be substituted for the comma appea ring afte r the word “ fe tte r” in the said proviso.
(2) In section 46 o f the Prin cipal Act, add the following clauses afte r clause (11) , namely :—
“ (12) forfe iture of class, grade, or prison privileges for a perio d not exceeding thr ee m onths ;
(13) permanen t or tem porary red uct ion f rom a higher to a lower class or grade” .
3. A m en dm en t of S ec tio n 47 o f Act IX o f 1894 —I n sub-section (1) of Section 47 of th e Prin cipal Act, clause (4) shall be omitted .
4. A m en dm en t o f Sec tion 50 o f Ac t IX o f 1 8 9 4 . In sub-section • (1) of Section 50 of the Principal Act the words an d comma “ or of
whipp ing ,” shall be omitted. 5. A m en dm en t o f S ec tion 51 o f Act IX o f 1894 — In sub-section (2)
■ of Section 51 o f the Prin cipal Act the words “ in the cases o f offences for which whipp ing is aw ard ed” and the comm as befo re these words and thereafter shall be omitted .
6. A m en dm en t o f Se ct ion 53 o f Act IX o f 1894.— Section 53 of the P rincipal Act shal l be omitted .
