[दिमांक १४ अगस्त, १४९७२ को राज्यपाल की अनुमति प्राप्त हुई, अनुमति "मध्यप्रदेश राजपतन” (असाधारण) में दिनांक २२ अगस्त, १९७२ को प्रथमबार प्रकाशित की गई] मंत्रियों के चेतन तथा भत्तों के लिये उपबंध करने हेतु अधिनियम भारत गणराज्य के तेईससें वर्ष में मध्यप्रदेश विधान-मंडेल द्वारा निम्नलिखित रूप में यह अधिभियमित हो पल ₹. यह अधिनियम मध्यप्रदेश मंत्री (वेतन तथा भत्ता? अधिनियम, १९७२ कहीं जी सकेगा, २. इस अधिभियम में, जब सेक कि संदर्भ से अन्यथा अपेक्षित न हो, “मंत्री” के अंतर्गत "मुख्य मंत्री” आता है. *३. मुख्यमंत्री को त्तीद्भा हजार रुपये, प्रत्येक मंत्री को सत्ताईस हजार रुपये, राज्य मंत्री को पच्चीस हजार रुपये तथा उप मंत्री एवं संसदीय सचिव को बीस हजार रुपये, प्रतिमास सेतन दिया जाएगा. ४, (३१) मुख्यमंत्री को पचास हजार रुपये, प्रत्येक मंत्री को तीस हजार रुपये, प्रत्येक राज्य मंत्री, उप मंत्री तथा संसदीय सचिव को पर्वचीस हजार रुपये प्रतिमास सत्कार भत्ता दिया जाएगा. (२) मुख्यमंत्री तथा प्रत्येक मंत्री को सत्ताईस हजार रुपये निर्वाचन क्षेत्र भत्ता तथा प्रत्येक सम्य मंत्री, उप मंत्री तथा संसदीय सचिव को स्ाईस हजार रुपये प्रतिमास निर्दासन-क्षेत्र भत्ता दिया जाएगा, (३) मुख्यमंत्री, प्रत्येक मंत्री, राज्य मंत्री, उप मंत्री तथा संसदीय सचिव को उसकी परदावधि के दौरान राज्य के भीतर एक हजार दो सौ रुपए तथा राज्य के बाहर एक हजार पांच सौ रुपये प्रतिदिन दैनिक भत्ता दिया जाएगा. ५. (३) प्रत्येक मंत्री, राज्य मंत्री, उप मंत्री तथा संसदीय सचिव भोपाल में, अपने पद की पूरी अवधिभर और उसके अव्यवहित पश्चातू एक मास की कालावधि तक, किराये का भुगतान किये बिना-सुसच्ित निवास स्थान का उपयोग करने का हकदार होगा और ऐसे भिवास स्थान के अनुसक्षण की बाबत मंत्री या उप मंत्री था राज्य मंत्री या संसदीय सचिव को वैयव्तिक रूप से कोई प्रभार नहीं देना पड़ेगा, ‘ स्पष्टीकरण.--इस धारा के प्रयोजनों के लिये निवास स्थान में उससे अनुलग्न कर्मचारी क्वार्टर तथा अन्य भवन एवं उसका उद्यान सम्मिलित है और किसी निवास स्थान से संबंधित * अनुरक्षण'' में स्थानीय रेटों तथा करों का भुगतान और विद्युत एवं जल की व्यवस्था सम्मिलित है. (२) यदि कोई मंत्री या कोई राज्य मंत्री या कोई उप मंत्री या कोई संसदीय सचिव उपधारा (१) का फायदा न उठाये, तो वह उसके बदले में उतना गृह किराया भत्ता प्राप्त करने का हकदार होगा जी कि धारा 3 के अधीम उसे देय चेतन के बीस प्रतिशत के बराबर है. * लिधि विभाग की अधिसूचना क्र. २५३६-२२७-इक्कोस-अ (प्रा., दिनाक 3 जून रे०१० द्वारा संशोधित, ** लिधि विभाग को अधिसूचना क्र, २८र९-१८८-इक्कीस-अ (प्रा.), दिमाक १६ मई र०१२ द्वार संशोधित, संकिप्त नाम. परिभाषा, मंत्रियों, राग्य मंत्रियों 'उप मंजियों सथा' संसदीय सचियों के चेतन, मंत्रियों आदि को सत्कार भत्ता, निर्वाधिन झेत्र भत्ता और दैनिक भत्ता, मंतियों आदि का निवास स्थाम,
मंत्रियों आादि के लिये वाहन, मेंजियों, रान्य संप्रियों, उप मंत्रियों और संसदीय सचिवों के लिये चिशिंस्सीय 'प्ररिचर्था सा उपचार आदि, किसी चुत्ति के करने सदस्य के रूप में 'वेतम आप्त करेंगे आईि का प्रतिषेध, 3 (३) उपधारा (१) के अधीन भोपाल में निःशुल्क सुसस्लित निवास स्थान के अतिरिक्त, प्रत्येक मंत्री, राण्य मंत्री, उप मंत्री कथा संसदीय सचिव किसी ऐसे अन्य स्थान पर जिसे राज्य सरकार, समय-समय पर इस अधिनियम के प्रयोजन के लिये मंत्री, राज्य मंत्री, उप मंत्री या संसदीय सचिव के शासकीय निवास का स्थान घोषित करें, सुसस्जित निवास स्थान का, किसये का भुगतान किये बिना, उस समय तक के लिये जब तक कि ऐसी घोषणा प्रवृत्त रहे, उपयोग करने का भी हकदार होगा, (४) यथास्थिति किसी मंत्री, किसी राज्य मंत्री, किसी उप मंत्री यथां किसी संसदीय सचिव को उपधास (O के अधीन दिये गये निवास स्थान को सुसण्चित करने के बारे में किया जाने वाला व्यय मिम्मलिखित आर्थिक सीमाओं के अध्यधीन होगा: मंत्री , .... पैंतीस हजार रुपये राज्य मंत्री .. पश्यीस हजार रुपये उप मंत्री L. बीस हजार रुपये संसदीय सचिव .. फेन्द्रह हजार रुपये (५) निवास-स्थाम ऐसे उद्यान के, जिनके लिये कि उपधारा (१) के अधीन उपबंध किया गया है, समारक्षण, लार्षिक मरम्मतों तथा अनुसक्षण के बारे में किये जाने वाले वार्षिक व्यय ऐसी आर्थिक सीमाओं के अस्यशीन होगा जो कि राज्य सरकार झ्लारा इस संबंध में बनाये गये नियम ट्वास अधिकथशित की जाय. ६ (१) प्रत्येक मंत्री को, प्रत्येक राज्य मंत्री को, प्रत्येक उप मंत्री को सथा प्रत्येक संसदीय सचिव को उसके उपयोग के लिए एक-एक उपयुक्त मोटरयान दिया जायेगा जिसका क्रय तथा अनुपक्षण उन नियमों के अमुसार जो कि राज्य सरकार द्वारा उस संबंध में बनाये जाय, सरकारी व्यय से किया जायगा. * (२) राज्य सरकार, ऐसे प्रत्येक मोटरयान के लिये सरकारी व्यय से दो मोटर चालक (शोफर) की भी व्यवस्था करेगी और प्रत्येक मोटरयान के लिये, ऐसे प्रत्येक मोटरयान द्वार की गई यात्राओं (जो उन यात्राओं से भिम्म हो जिनके लिये कि यात्रा-धत्ता अनुज्ेय है) के लिये उपयुक्त मोटर ईंधन का भी प्रदाय करेगी जो मंत्री को दिये गये मोटरयान की दशा में प्रतिमास अधिक से अधिक तीन सौ पचास लीटर, राज्य मंत्री को दिये गये मोटरयान की दशा में प्रतिमास अधिक से अधिक सीन सौ सीटर, उप मंत्री को दिये गये मोटर यान की दशा में अधिक से अधिक दो सौ पचहत्तर लीटर और संसदीय सचिव को दिये गये मोटर यान की दशा में प्रत्तिमास अधिक से अधिक दो सौ पचास लीटर होगा. +* ७ (१) कोई भी मंत्री, कोई भी राज्य मंत्री, कोई भी उप यंत्री तथा कोई भी संसदीय सचिव और यथास्थिति संत्रीराज्य मंत्री, उप मंत्री या संसदीय सचिव के कुटुम्ब के सदस्य जिकित्सीय परिचर्या एवं उपचार ऐसे पैमाने सथा ऐसी शर्तीं पर, निःशुल्क प्राप्त करने के हकदार होंगे जो अखिल भारतीय सेवा के सदस्यों तथा उनके कुटुम्ब के सदस्यों को अखिल भारतीय सेवा अधिनियम, १९५१ (१९५१ का से, ६१) के अधीन समय-समय फर बनाए गए चिकित्सीय परियर्या एवं उपचार संबंधी नियमों के अधीन लागू होती हैं. (२१ कोई भी मंत्री, कोई भी राज्य मंत्री, कोई भी उप मंत्री तथा कोई भी संसदीय सचिव, जबकि बह भारत से बाहर ऐसे दौरे पर हो, जो उसके द्वारा अपने पदीय कर्तव्यों के निर्वहन में किया गया हो, ऐसीं चिकित्सीय परिचर्या एवं उपचार का भी मिः्शुल्क हकदार होगा जो उस स्थान पर भारत मिशन (इंडिया मिशन) के प्रधान को अनुस्ेय हो. , ८. कोई भी मंत्री, कोई भी राज्य मंत्री, कोई भी उप मंत्री सथा कोई भी संसदीय सचिव -- (क) अपने पद की, जिसके लिये कि वह St तथा भत्ते प्राप्त करता है, अवधि के दौरान कोई वृत्ति नहीं करेगा या किसी व्यापार में नहीं लगेगा था मंत्री, राज्य. मंत्री, उप मंत्री या संसदीय सचिव के रूप में अपने कर्तश्यों से भिन्न कोई नियोजन पारिश्रमिक प्राप्त करने के लिये ग्रहण नहीं करेगा, और (ख)? मध्यप्रदेश विधान सभा के सदस्य के रूप में कोई वेतन या भत्ता प्राप्त करने का उस दशा में हकदार महीँ होगा जबकि वह अपने पद के लिये वेतन तथा भत्ता प्राप्त करता हो. * अधिसूचना क्रमांक १०६४८/इक्कौस/अ (प्रा, दिनांक ५ मई ६९८७ द्वारा संशोधित, ** लिधि विभाग की अधिसूचना क्र. प६७१-इक्कीस-अ (प्रा४, दि. ए४-५-१९८९ द्वारा संशोधित,

(३) कोई भी मंत्री, कोई भी राज्य मंत्री, कोई भी उप मंत्री तथा कोई भी संसदीय सचिव, रान्य सरकार द्वारा इस संबंध में बनाये गये नियमों के अनुसार,-- (के) (एक) पद ग्रहण करने के लिये, भोपाल के बाहर अपने सामान्य निवास-स्थान से भोपाल तक की गई यात्रा के संबंध में, और (दी) पद मुक्त होने पर भोपाल से, भोफाल के बाहर अपने सामान्य मिवास-स्थान तक की गईं यात्रा के संबंध में अपने स्वयं के लिये तथा अपने कुट्म्ब के ऐसे सदस्यों के लिये जो उस पर आश्रित हो और अपनी तथा अपने कुटुम्ब की चीज वस्तु के परिवहन के लिये यात्रा भत्ता प्राप्त करने का, और (ख) उन दौरों के संबंध में, जो कि उसने अपने पदीय कर्तव्यों के मिर्वहन में धल, जल या वायु मार्ग द्वारा किये हो, यात्रा तथा दैनिक भत्ता प्राप्त करने का, रकदार होगा, (२) इस धारा के अधीन किसी भी यात्रा भत्ते का नकद भुगतान किया जा सकेगा या उसके बदले में निःशुल्क शासकीय परिवहन की व्यवस्था की जा सकेगा. (३) कोई भी मंत्री, कोई भी राज्य मंत्री, कोई भी उप मंत्री तथा कोई भी संसदीय संचिव उपधारा (१) के खण्ड (ख) में विनिर्दिष्ट किये गये दौरों के लिये देय यात्ना तथा दैनिक भत्ते प्रात करने के अधिरिकत इस खात का हकदार होगा कि जब वह ऐसे दौरों के दौरान विश्राम भवनों (सरक्रिट हाउसेज) तथा विश्राम गृहों (पेस्ट हाउसेज) में, जो कि राज्य सरकार द्वार अनुरंक्षित हो, ठहरे तो उसे उन विश्राम भवनों तथा विश्राम गृहों में वास-सुविधा तथा विद्युत को व्यवस्था उस उदहरने की कालावधि के लिये निशुल्क सपलब्ध रहे, * ** दु.क. इस अधिनियम के अधीन किसी मंत्री, किसी सज्य मंत्री, किसी उपपंत्री तथा किसी संसदीय सचिव को देव समस्त भत्तों की बाबत और किसए का भुगतान किए बिना सुसख्चित निवास स्थान की उस सुविधा की बाबत एवं उन अन्य परिसण्धियों को बाबत जो किसी मंत्री, किसी राज्य मंत्री, किसी उपमंत्री या किसी संसदीय सचिव को इस अधिनियम के अधीन अनुसेय हैं, यथास्थिति किसी मंत्री, किसी राज्य मंत्री, किसी उपरमंत्री या किसी संसदीय सचिव से आय कर नहीं लिया जाएगा और वह आय-कर यथास्थिति किसी मंत्री, किसी राज्य मंत्री, किसी उपमंत्री या किसी संसदीय सचिव द्वास देय अधिकतम दर पर राज्य सरकार द्वारा देय होगा. किसी मंत्री, किसी राज्य मंत्री, किसी उपमंत्री या किसी संसदीय सचिव को देव उक्त भत्तों तथा परिलब्धियों से प्रोद्भूत आय की कुल रकम में से, समय-समय पर अनुज्ञेय आय-कर से छूट की सीमा की रकम और मानक करटौतियों की रकम, जौ भी हों; घटाई नहीं जाएंगी. *', इ०. सह तारीख, जिसको कि कोई व्यवित मंत्री, सज्य मंत्री, उप मंत्री था संसदीय सचिव हो जाय अथवा मंत्री, राज्य मंत्री, उप मंत्री था संसदीय सचिव मे रहे जाय, राजपत्र में अधिसूचित की जायगी और कोई भी ऐसी अधिसूचना इस तथ्य को निश्वायक साक्ष्य होगी कि चह उस तारीख को इस अधिनियम के समस्त प्रयोजनों के लिये मंत्री, सज्य मंत्री, उप मंत्री या संसदीय सचिव हुआ था इस अधिनियम के समस्त प्रयोजनों के लिये मंत्री, सज्य मंत्री, उप मंत्री या संसदीय सचिव नहीं रह गया था, ११. (१) राज्य सरकार, अधिसूचना हारा इस अधिनियम के प्रयोजनों को कार्यान्वित करनें के लिये नियम बना सकेगी. (२१ इस अधिनियम के अधीन बनाये गये समस्त नियम विधाम सभा के मटल पर रखे जायेंगे. इ२. धारा ९ की उपधारा (३५ के उपबेध २१ जनवरी १९५७ को प्रबृत् हुए समझे जाएंगे. ३. मध्यप्रदेश सैलसेज एण्ड अलाउन्सेज मिनिस्टर्स एक्ट, १९७६ (क्रमांक ५ सन् १९५७) एतदूद्वारा निरस्त किया जाता है. * विधि एवं विधायी कार्य विभाग की अधिसूचना क्र. ७८३१-२६-अ (M), दि. र०-८-१९९७ द्वारा संशोधियें, मंज्ियों आदि के लिये यात्रा तथा सैनिक भप्ता, भरते, परिसब्धियों में से आय-कर नहीं लिंका जाएगा. सम्सियों, शाण्य मंत्रियों, उपमंत्रियों तथा संसदीय संचियों की निधुद्ित आदि से संबंधित अधिसूचना उनकी नियुक्ति आदि का निश्यायक साय होमी, नियम खनाने को i, धारा ९ (३४ के उपबंधों का भूतलझी प्रभाव, निरसन,

Be it enacted by the Madhya Pradesh Legislature in the Twenty-third Year of the Reublic of India as follows (o L. This Act may be called the Madhya Pradesh Mantri (Vetan Tatha Bhatta) Adhiniyam, 1972. 2 In this Act unless the context otherwise requires, “Ministers” includes "Chiel Minister”. #3, There shall be paid a salary per mensem of rupees thirty thousend to the Chief Minister, rupees twenty seven thousand to cach Minister, rupees twenty five thousand to Minister of State, rupees twenty thousand to Deputy Minister and Parliamentary Secretary. % 4. (1) There shall be paid to the Chief Minister a Sumptuary Allowance of fifty thousand rupees, to each Minister thirty thousand rupees and to each Minister of State, Deputy Minister and Parliamentary Secretary twenty five thousand rupees per Mensem. (2) There shall be paid to the Chief Minister and to each Minister a Constituency Allowance of twenty seven thousand rupees per mensem and to each of Minister of State, Deputy Minister and Parliamentary Secretary a Constituency Allowance of twenty seven thousand rupees per mensem. (3) There shall be paid to the Chief Minister, each Minister, Minister of State, Deputy Minister and Parliamentary Secretary a Daily Allowance of one thousand two hundred rupees within the State and one thousand five hundered rupees outside the State per day during the term of office. 5. (1) Each Minister, Minister of State, Deputy Minister and Parliamentary Secretary shall be entitled, without payment of rent, to the use of a fumished residence throughout his term of office at Bhopal and for the period of the one month immediately thereafter, and no charge shal} fall on the Minister or Minister of State or Deputy Minister or Parliamentary Secretary personally in respect of the rnaintenance of such residence. Explanation.—¥For the purposes of this Section "residence” includes the staff quarters and other building appurtenant there to and the garden thereof and “maintenance” in relation to a residence includes the payment of local rates and taxes and the provision of electricity and water. Prohibition against Practicing any Profession, drawing Salary ay member etc. an {3) In addition {0 a free furnished residence at Bhopal under sub-section (1), each Minister, Minister of State, Deputy Minister and Parilamentary Secretary shall also be entitled to the use of a furnished residence without payment of rent at any other place which the Mate Government may, from time to time for purpose of this Act, declare to be the place of official residence of the Minister, Minister of State, Deputy Minister or Pariiamentary Secretary, as the case may be, so long as such declaration remains in force. (4) The expenditare to be incurred in respeet of furnishing of the residence provided 1o a Minister, & Minister of State, a Deputy Minister or a Parliamentary Secretary, as the case may be, under sub-section (1} shall be sublect to the following monetary Hmits — Minister .. Thirty-five thousand rupees. Minister of State .. Twenty-five thousand rupees. Deputy Minister - Twenty thousand rupees. Parliamentary Secretary .. Fifteen thousand rupees. (5) The annual expenditute to be incurred in respect of upkeep, annual repair and maintenance of the residence and garden provided under sub-section {1) shall be subject to such monetary limits 85 may be laid down by mile made in this behalf by the State Government. 6. {1} There shall be provided to each Minister, 10 each Minister of State 10 each Deputy Minister and to each Parlimentary Secretary for his use a suitable motor-vehicle purchased and maintained at public expenses in accordance with फिट miles to be made by the State Goveroment in that behalf. # (2} The State Government shall also provide at public expense two chauffer for each such motor vehicle and also supply for each motor vehicle, motor fuel consumed for journeys (other than journeys for which travelling allowance is admissible) performed by each such motor vehicle subject to a maximum of three hundred and fifty litees per month in the case of motor vehicle provided to a Minister, three hundred litres per month in the case of motor vehicle provided to a Minister of State, two hundred and seventy five litres per month in the case of a motor vehicle provided to a Deputy Minister and two hondred and fifty litres per month in the case of motor vehicle provided to a parliamentary Secretary. i £ %7 (1) A Minister, a Minister of State, a Deputy Minister, and a Parliamentary Secretary and the members of the family of the Minister, the Minister of State, the Deputy Minister or Parliamentary Secretary, as the case may be, shall be entitled to medical attendance and treatment, free of charge, on the scale and conditions applicable to, the members of the All India Services and members of them families under the rules relating to medical attendance and treatment, made from time to time, under the All India Service Act, 1951 (XXI of 1951). (2) While on tour underiaken by him in the discharge of his official duties outside India, a Minister, 2 Minister of State, a Deputy Minister and a Parliamentary Secretary shall also be entitled to such medical attendance and treatment, free of charge, as may be admissible to the Head of the India Mission at that place.”. 8. (b) While he draws salary and allowance for his office be entitled to any salary or allowance as member of the Madhya Pradesh Legislative Assembly. 9. (1) A Minister, a Minister of State, a Deputy Minister, and a Parliamentary Secretary shall in accordance with the made rule made in this behalf by the State Government, be entitled to— (a) travelling allowance for himself and the members of his family dependent upon him and for the transport of his and his family's effects— (i} in respect of the journey to Bhopal from his usual place of residence out of Bhopal for assuming office ; and (ii) in respect of the journey from Bhopal to usual place of residence out of BHOPAL on relinquishing office; and (b) travelling and daily allowances in respect of tours undertaken by him in the discharge of his official duties whether by land, Isea, or air. (2) Any travelling allowance under this section may be paid in cash or free official transport provided in lieu thereof. (3} In addition to travelling and daily allowances payable in respect of tours specified in clause (b) of sub-section (1), a Minister, a Minister of State, a Deputy Minister, and a Parliamentary Secretary shall be entitied, without payment of any charge, to accommondation in and provision of electricity at circuit houses and Rest Houses maintained by the State Government, for the period of their stay during such tours. * 9.A. All allowance payable and furnished residence without payment of rent and other prequisities admissible to a Minister, a Minister of State, a Deputy Minister, and a Parliamentary Secretary under this Act shall be exciusive of Income Tax which shall be payable by the State Government at the maximum rate payable by a Minister, a Minister of State, a Deputy Minister, or a Parliamentary Secretary as the case may be. Out of the total amount of income ACCTUNE from the above allowance and perquisites payable to a Minister, a Minister of State, a Deputy Minister, or a Parliamentary Secretary the amount of the limit of exemption from Income Tax and standard deduction, what soever as admissible from time to time, shall not be deducted.”. 10. The date on which any person becomes or ceases to be a Minister, a Minister of State, a Deputy Minister, or a Parliamentary Secretary, shall be potified in the Gazette and any such notification shall be conclusive evidence of the fact that he became or ceased to a Minister, a Minister of State, a Deputy Minister, or a Parliamentary Secretary on that date for all the purposes of this Act. 11. (1) The State Government may, by notification, make rules for carrying out the purposes of this Act. (2) All rules made under this Act shall be laid on the table of the Legislative Assembly. 12. The provisions of sub-section (3) of Section 9 shall be deemed to have come into force on the 21st Jamuary, 1957, 13.
