Preamble
An Act further to amend the Uttar Pradesh State Legislature (Members' Emoluments and Pension) Act, 1980
It is hereby enacted in the Sixty-seventh Year of the Republic of India as follows-
SOR Statement of Objects and Reasons
Prefatory Note - Statement of Objects and Reasons.- The members of either House of State Legislature are entitled to get monthly emoluments and other facilities under the Uttar Pradesh State Legislature (Members' Emoluments and Pension) Act, 1980. Ex-members are also entitled to get pension and other benefits under the said Act. Spouses of ex-members are also entitled to get family pension under the said Act.
In view of the price rise and increase of responsibilities, it has been decided to amend the said Act to revise, pay, allowances, railway coupons and other amenities admissible to the members of the State Legislature and to increase pension and railway coupons admissible to ex-members and to give facility of cash payment out of the coupons admissible to them.
The Uttar Pradesh State Legislature (Members' Emoluments and Pension) (Amendment) Bill, 2016 is introduced accordingly.
Section 1. Short title
1. Short title.- This Act may be called the Uttar Pradesh State Legislature (Members' Emoluments and Pension) (Amendment) Act, 2016.
Section 2. Amendment of Section 3 of U.P. Act No. 23 of 1980
2. Amendment of Section 3 of U.P. Act No. 23 of 1980.- In Section 3 of the Uttar Pradesh State Legislature (Members' Emoluments and Pension)_Act, 1980 hereinafter referred to as the principal Act in sub-section (1) for the words "ten thousand rupees" the words "twenty-five thousand rupees" shall be substituted.
Section 3. Amendment of Section 4
3. Amendment of Section 4.- In Section 4 of the principal Act for the words "thirty thousand rupees" the words "fifty thousand rupees" shall be substituted.
Section 4. Amendment of Section 5
4. Amendment of Section 5.- In Section 5 of the principal Act,-
(a) in sub-section (1),
(i) for the words "three lakh twenty-five thousand rupees" the words "four lakh twenty-five thousand rupees" shall be substituted;
(ii) for the words "members of his family" the words "members of his family or his companion" shall be substituted;
(b) in sub-section (2),-
(i) for the words "eighty thousand rupees" the words "one lakh rupees" shall be substituted;
(ii) in the explanation after third proviso the following proviso shall be inserted, namely-
"Provided also that an ex-member shall be paid out of the Railway coupons to be supplied to him an amount in cash not exceeding fifty thousand rupees annually for petrol or diesel for his own vehicle";
(c) in sub-section (2) in the proviso, in clause (b) for the words "eighteen thousand rupees" the words "twenty-five thousand rupees" shall be substituted.
Section 5. Amendment of Section 15
5. Amendment of Section 15.- In Section 15 of the principal Act,-
(a) in sub-section (1) for the words "one thousand rupees" the words "two thousand rupees" shall be substituted.
(b) in sub-section (2) for the words "eight hundred rupees" the words "one thousand five hundred rupees" shall be substituted.
Section 6. Amendment of Section 15-A
6. Amendment of Section 15-A.- In Section 15-A of the principal Act for the words "fifteen thousand rupees" the words "twenty thousand rupees" shall be substituted.
Section 7. Amendment of Section 18-A
7. Amendment of Section 18-A.- In Section 18-A of the principal Act in clause (a) for the words "twenty thousand rupees" the words "thirty thousand rupees" shall be substituted.
Section 8. Amendment of Section 24
8. Amendment of Section 24.- In Section 24 of the principal Act,-
(a) in sub-section (1) for the words "ten thousand rupees" the words "twenty-five thousand rupees" shall be substituted.
(b) in the proviso for the words "one thousand rupees" the words "two thousand rupees" shall be substituted.
