An Act to Validate Certain Actions Taken by the Revenue Courts Under the Different Tenancy Laws and to Provide for Certain Ancillary Matters
Be it enacted by the Legislature of the State of Orissa in the Twenty-seventh Year of the Republic of India, as follows:-
Section 1. Short title, extent and commencement
1. Short title, extent and commencement.- (1) This Act may be called the Orissa Rent-Suits (Validation) Act, 1976.
(2) It extends to the whole of the State of Orissa.
(3) It shall come into force at once.
Section 2. Validation of actions taken by Revenue Courts under certain tenancy laws and continuance of pending proceedings
2. Validation of actions taken by Revenue Courts under certain tenancy laws and continuance of pending proceedings.- Notwithstanding anything contained in the Orissa Land Reforms Act, 1960 (Orissa Act of 1960) or in any judgment, decree or order of any Court,-
(a) all suits for the recovery of rent filed after the commencement of the said Act before any Revenue Court under any other tenancy law in force in any part of the State and disposed of by such Court prior to the date of commencement of this Act and all decrees passed in such suits and executed prior to that date shall, for all intents and purposes, be deemed to have been validly disposed of or, as the case may be, executed and no such disposal or execution shall be liable to be called in question in any Court merely on the ground that the said Revenue Court had no jurisdiciton for such disposal or execution;
(b) all such suits which are pending on the date of commencement of this Act, shall he proceeded with and disposed of by the Revenue Courts in accordance with the provisions of such other tenancy law; and
(c) all decrees passed in any suit referred to in clause (a), either before or after the date of commencement of this Act, may be executed in accordance with the provisions of such other tenancy law.
