An Act to amend the Andhra Pradesh Oil Palm (Regulation of Production and Processing) Act, 1993
Be it enacted by the Legislative Assembly of the State of Andhra Pradesh in the Fifty-first Year of the Republic of India as follows:-

STATEMENT OF OBJECTS AND REASONS
The Government of India through Technology Mission on Oil Seeds and Pulses, have been promoting the large scale cultivation of Oil Fain Crop for attaining self sufficiency in edible oils. Andhra Pradesh has done pioneering work for Oil Palm Development in the State. This crop was taken up as a project sponsored by Government of India.
Contrary to earlier concept of import substitution, Government of India started allowing import of huge quantities of edible oils under O.G.L. The duty was also reduced. This has seriously hampered the interests of Oil Palm as well as other oil seed growers.
The Chief Minister of Andhra Pradesh addressed Government of India pointing out the crisis faced by the Oil Palm growers of the State. The Government of India has indicated that early help may perhaps be extended to the Oil Pain farmers of the State only through Barret intervention operations. This envisages sharing of loss between Governtment of India and Government of Andhra Pradesh an 50:50 basis and the proposal for Market Intervention Scheme with 501 sharing has been approved by the Government.
Therefore, in order to implement the market intervention Scheme and to designate agencies to by and sell Oil Palm F.F.Bs. in areas so declared as factory zones, it has been decided to amend the provisions of the Andhra Pradesh Oil Palm (Regulation of Production and Processing) Act, 1993, suitably.
As the Legislative Assembly of the State was not that in Session having been prorogued and as it has been decided to give effect to the above decision ??? the Andhra Pradesh Oil Pain (Regulation of Production and Processing) (Amendment) Ordinance, 1999 (Andhra Pradesh Ordinance a of 1999) has been promulgated by the Governor on 24th December, 1999 and published on 27th December, 1999.
This Bill seeks to repeal the said Ordinance.
Section 1. Short title and commencement
1. Short title and commencement.- (1) This Act may be called the Andhra Pradesh Oil Palm (Regulation of Production and Processing) (Amendment) Act, 2000.
(2) It shall be deemed to have come into force with effect from the 27th December, 1999.
Section 2. Insertion of new section 11A
2. Insertion of new section 11A.- In the Andhra Pradesh Oil Palm (Regulation of Production and Processing) Act, 1993, (Act 3 of 1993) after section 11, the following new section shall be inserted, namely:-
11A "Market Intervention Scheme.- (1) Notwithstanding anything contained in section 11 where the Government notifies any Market Intervention Scheme approved by the Government of India for any specified period for all the factory zones in the State, and designates an agency or agencies for the purpose, such designated agency may buy specified quantities of Oil Palm F.F.Bs. produced by the Oil Palm growers or their co-operative societies in all the zones as are offered for sale by them at a price fixed by the Government under the Market Intervention Scheme.
(2) The designated-agency may supply the said Oil Palm F.F.Bs. to the occupiers of the factories in the concerned factory zones and the occupier of the factory shall buy all the Oil Palm F.F.Bs. so supplied by the designated agency, which shall be deemed to be an Oil Palm growers in the factory zone under the provisions of this Act, in relation to such supply and buying.".
Section 3. Repeal of Ordinance 8 of 1999
3. Repeal of Ordinance 8 of 1999.- The Andhra Pradesh Oil Palm (Regulation of Production and Processing) (Amendment) Ordinance 1999 is hereby repealed.
