PEOPLE OF THE STATE OF MICHIGAN,

Plaintiff-Appellee, v ETHAN ROBERT CRUMBLEY,

Defendant-Appellant.

On order of the Court, the application for leave to appeal the May 6, 2025 order of the Court of Appeals is considered. Pursuant to MCR 7.305(I)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for consideration, as on leave granted, of: (1) whether defendant’s trial counsel rendered ineffective assistance by failing to adequately direct, prepare, and supervise the expert testimony of Dr. Colin King; (2) whether the trial court erred in its application of the factors outlined in Miller v Alabama, 567 US 460, 477-478 (2012), or otherwise abused its discretion in determining that the prosecution had overcome the presumption against life without parole by clear and convincing evidence, see People v Taylor, 510 Mich 112, 129 (2022); and (3) whether the trial court correctly held that statements made by defendant during allocution operated as a waiver of his ability to challenge his sentence on appeal. In all other respects, leave to appeal is DENIED, because we are not persuaded that the remaining questions presented should be reviewed by this Court. The motion to remand to the trial court is DENIED.
