DULLES Town CENTER MALL, L.L.C. Plaintiff v. AUTOMALL ONLINE, INC. Defendant

Thomas D. Horne, Judge

MEMORANDUM OPINION

This case came before the Court for trial on the Motion for Judgment filed by the Plaintiff, Dulles Town Center Mall, L.L.C. and Answer of the Defendant, Automall Online, Inc. Upon a consideration of the evidence and arguments of counsel, the Court is of the opinion that the plaintiff is entitled to recover judgment in the amount of $221,550.10, plus interest and attorney's fees in the amount of $7,592.50.

Although the terms of the lease required the signature of the secretary of the corporate defendant, the evidence shows that the tenant entered upon the demised premises in accordance with the written agreement signed by its vice president, and thereafter, paid rent consistent with its terms. Rather than promptly disavowing the terms of the lease, the defendant accepted its benefits. The tenant, estopped by its actions, may not now be heard to modify the lease and thereby avoid payment of rent in accordance with its terms.

Ms. Charvet may draw a Final Order consistent with this opinion to which Mr. Miller may note his exception.
