Ellen Holt, Appellant, v. Chicago Hair Goods Company, Appellee.

LANDLORD AND TENANT, § 50 — holding over under one month lease as not creating new tenancy under old lease terms. In action of forcible detainer, where defendant contended that by holding over, new tenancy was created for like term as under old lease, and it appeared that defendant was not agreeable to paying proposed increased rental and landlord consented to extend lease for thirty days, and that although new lease was received by defendant and rental paid, defendant turned lease over to lawyer without executing and returning same, held that under evidence, defendant clearly understood that landlord's intention was not that defendant's holding over should create new tenancy on terms of old lease.
