ANTOINETTE HARRISON v. SEA RIVER MARITIME, INC.

FINAL JUDGMENT Pursuant to Rule 9(h) of the Federal Rules of Civil Procedure — Admiralty

SAMUEL B. KENT, United States District Judge

On the basis of the Findings of Fact and Conclusions of Law this date entered herein, it is the Judgment of this Court that Plaintiff ANTOINETTE HARRISON shall have and recover of and from Defendant SEA RIVER MARITIME, INC., the total amount of Five Hundred Forty-three Thousand Five Hundred Eighty-three and eighty/100 ($543,583.80), together with pre-judgment interest at the rate of four percent (4%) per annum, together with post-judgment interest until this Judgment is paid in full, at the rate of three percent (3%) per annum. Further, Plaintiff shall have and recover of and from Defendant all taxable costs of court, such to be set upon Plaintiffs timely submission of a Bill of Costs and the Court's consideration of any timely opposition thereto. Each and all of these recoveries are predicated upon the ascribed negligence of Defendant, having heretofore subtracted the ascribed contributory negligence of Plaintiff. All of said recoveries are based upon negligence as defined in the Jones Act, 46 U.S.C. § 688. All claims whatsoever based upon the unseaworthiness of the vessel, or further entitlement to maintenance, are DISMISSED WITH PREJUDICE.

THIS IS A FINAL JUDGMENT. Any relief not herein expressly granted is denied.
