1. The Appellant filed an RTI application dated 29-05-2024 seeking the following information:
"(2) Hence as per Section 7(1) Right of Information Act-2005, the applicant wants information duly certified/attested by a Gazetted officer as mentioned below ;-
i) Whether, in compliance of Rly. Bd's letter No. E(NG)I-2008/IC 2/1 dated 21/02/2008 (annexure-2 of this RTI application), the applicant's remaining 4 advance increment has been sanctioned till date, in favour of applicant or not ?
ii) If applicant's remaining 4 advance increments, in compliance of Rly. Bd's letter No. E(NG)I-2008/IC 2/1 dated 21/02/2008 (annexure-2 of this RTI application), has already been sanctioned, then kindly 1 / 6

iii) If till now applicant's remaining 4 advance increments, in compliance of Rly. Bd's letter No. E(NG)I-2008/IC 2/1 dated 21/02/2008 (annexure-2 of this RTI application), not been sanctioned till date, then kindly intimate, till how long it will be sanctioned ?
iv) If till now applicant's remaining 4 advance increments, in compliance of Rly. Bd's letter No. E(NG)I-2008/IC 2/1 dated 21/02/2008 (annexure-2 of this RTI application), has not been sanctioned till date, then kindly Intimate, reasons of so much delay.
v) If applicant's remaining 4 advance Increments in compliance of Rly. Bd's letter No. E(NG)I-2008/IC 2/1 dated 21/02/2008 (annexure-2 of this RTI application), has already been sanctioned, then kindly provide photo-stat copy (duly attested by Gazetted officer) of the complete steps taken for :-
a. Revising applicant's basic pay w.e.f. 04/05/1990 to 28/02/2010 &
b. Making payments for differential Pension & differential retiral dues etc."
2. The CPIO reply is not on record.
3. The Appellant filed a First Appeal dated 01-07-2024. The F.A.A vide order dated 08-08-2024 stating as under:
"आपकी िवषयगत अपील तथा सɾİɀत अिभलेखो ं का अवलोकन िकया तथा पाया िक आपके संदिभŊत आर.टी.आई. आवेदन िदनांक 29-05-24 Ȫारा माँगी गयी सूचना के सɾɀ मŐ सकािध/राज. एवं सहायक लोक सूचना अिधकारी/कािमŊक के पũ िदनांक 07-08-24 Ȫारा सूचना उपलɩ करायी गयी है। सूचना की छाया Ůित कुल 03 पृʿो ंमŐ संलŤ कर भेजी जा रही है।
उपरोƅ के आलोक मŐ Ůथम अपीलीय Ůािधकारी के ˑर पर अब अɊ कोई कारŊवाई अपेिƗत नही ंहै।"

4. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.
Relevant Facts emerged during Hearing:
The following were present:-
Appellant: Not Present.
Respondent: Shri Yagesh Kumar Srivastava, APO & APIO present through Video- Conference.
5. Proof of having served a copy of Second Appeal on Respondent while filing the same in CIC on 03.09.2024 is not available on record. Respondent confirms non-service.
6. Updated reply dated 30.03.2026 of the Respondent are taken on record and the same is reproduced hereinbelow:
"01. इस काया[लय ɮवारा जारȣ £ापन Ǒदनांक 04.01.2024 के अनुसार सेवापुिèतका मɅ लेखा ͪवभाग ɮवारा ͪवͬधͯ¢न ĤǓत कȧ छायाĤǓत ।
02. इस काया[लय ɮवारा जारȣ जापन Ǒदनांक 30.09.2024 के अनुसार सेवापुिèतका मɅ लेखा ͪवभाग ɮवारा ͪवͬधͯ¢त ĤǓत कȧ छायाĤǓत ।
03. इम काया[लय ɮवारा जारȣ पुनः वेतन Ǔनधा[रण के वेतन भुगतान Ĥपğ Ǒदनाकं 07.10.2024 पर लेखा ͪवभाग ɮवारा ͪवͬधͯ¢त ĤǓत कȧ छायाĤǓत |

7. Respondent while defending their case inter alia submitted that the RTI application of the Appellant was received in their office on their portal along with his first appeal. On 08.08.2024, complete point-wise reply/information, as per the documents available on record has been provided to the Appellant. The Respondent further apprised the Commission that the benefits/final payment had also been disbursed to the Appellant on 01.10.2024, and therefore, his grievance stands redressed.

8. The Commission upon perusal of records observes that the main premise of instant Appeal was non-furnishing of complete and correct information by the PIO as per the RTI application. The Commission observes that complete factual position in the matter has already been informed to the Appellant as per his RTI application and as per the documents available on their record at relevant time.
9. It is an admitted fact that the PIO is only a communicator of information based on the records held in the office and hence, he is not expected to create information as per the desire of the Appellant. The PIO can only provide information which is held by them in their records within the Public Authority. It was further informed that final payment was also made to the Appellant and his grievance stands redressed.
10. The Commission finds no infirmity in the reply of the PIO and the same was found to be in consonance with the provisions of RTI Act.
11. No intervention of the Commission is warranted in the matter. The appeal is disposed of accordingly.
