Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus in declaring the in action of the respondents in not conducting the enquiry or investigation in the case registering FIR No. 9 of 2018 dated 09-01-2018 under Sec. 408, 420 IPC on the complainant referred Under Sec. 156 (3) of Cr.P.C. in C.F. NO. 1926 of 2016 on the file of Hon'ble V Additional Judicial First Class Magistrate at Nellore made by the petitioner is being illegal, arbitrary and unconstitutional and consequently direct the respondents to complete the investigation and file charge sheet by taking action against accused in the said crime and to pass

The Court made the following:
ORDER:
The instant Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief:
" ... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus in declaring the in action of the respondents in not conducting the enquiry or investigation in the case registering FIR No.9 of 2018 dated 09-01- 2018 under Sec. 408, 420 IPC on the complainant referred Under Sec. 156 (3) of Cr.P.C. in C.F. NO. 1926 of 2016 on the file of Hon'ble V Additional Judicial First Class Magistrate at Nellore made by the petitioner is being illegal, arbitrary and unconstitutional and consequently direct the respondents to complete the investigation and file charge sheet by taking action against accused in the said crime and to pass ...."
2. Learned Assistant Government Pleader for Home appearing for respondents on instructions would submit that the writ petition may be disposed of giving appropriate directions to the concerned Police.
3. As can be seen from the material on record, this Court by order dated 18.09.2018 directed respondent No.3 to take appropriate steps for expeditious investigation and file a report.
4. Learned counsel for the Petitioner would submit that recording the said submission, this Writ Petition may be disposed of.
5. In that view, the Writ Petition is disposed of directing the concerned police to conclude the investigation according to law and file a report in that regard, in case, investigation is still pending, within a period of two weeks from the date of receipt of a copy of this Order. No order as to costs. Pending applications, if any, shall stand closed.
