Present applicant- Nikku @ Maninder Pal Singh, S/o Amarjeet Singh is praying for regular bail in relation to FIR dated 10.02.2025, registered as FIR No. 43 of 2025 at P.S. Nanakmatta District Udham Singh Nagar wherein the present applicant has been implicated for the offences punishable under Sections 137(2), 96 and 64 of BNS 2023 read with Section 5/6 of the POCSO Act. 4. It is submitted by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and, in fact, the applicant was in love with the victim and whatever be the physical relations in between both of them that were consensual. Even in the statement of the victim, recorded under Section 183 of BNSS, she admits that she was in love with the present applicant. He further submits that though the victim was minor at the time of the incident and the applicant was major but he was also of tender age of 21 years and due to their love affair both of them subsequently married with each other in Gurudwara which has also been admitted by the victim in her statement. He further submits that charge sheet has already been filed therefore there is no need of custodial interrogation of the applicant. 5. On the other side, learned A.G.A. fairly submits that the charge sheet has |

already been filed therefore there is no need of custodial interrogation, and, furthermore with regard to the love angel and marriage he submits that the victim herself admitted this fact in her statement.
6. After hearing the arguments of the learned counsel for the parties and further taking into consideration the fact that the charge sheet has already been filed and there is no need of custodial interrogation of the applicant, this Court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
8. Let the applicant Nikku @ Maninder Pal Singh be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
